The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday, April 20, 1970 at 8:00 o'clock P.M. in the Council Chambers
of the City Hall.

Minutes of the last meeting were read and approved.
Councilman Fischer introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING BID - Street Surfacing and Concrete Curb
(Proposal 1) and Gutter
WHEREAS, pursuant to an advertisement for bids for bids for the
improvement of 20th Street and 2l~t Street within Townsview Estates and 22nd
Street from Westview Drive to Pleasant Drive and Forest Street from 17th to
18th Street for bituminous surfacing and concrete curb and gutter, bids were
received, opened and tabulated according to law, and the following bids were
received complying with the advertisement:

enter into a contract with the Alexander Construction Co., Inc.
for the improvements as stated above according to the plans and
specifications therefore approved by the City Council and on file
in the office of the City Clerk.
2. The City Clerk is hereby authorized and directed to return forth-
with to all bidders the deposits made with their bids except that
the deposits of the successful bidder and the next lowest bidder
shall be retained until a contract has been signed.

Councilman Novak introduced the following resolution and moved
its adoption:
RESOLUTION
ESTABLISHING WORKING CONDITIONS, WAGES AND HOURS
FOR PUBLIC WORKS DEPARTMENT EMPLOYEES IN THE
CITY OF HASTINGS FOR 1970
WHEREAS, the City Council feels that it is for the best interest
of the City of Hastings, the Public Works Department employees, and for their
designated bargaining representatives, Local No. 49, International Union of
Operating Engineers, AFL-CIO, for the purpose of establishing conditions of
employment of the employees of the Public Works Department and to insure a
friendly spirit of cooperation between the City, its employees, and their des-
ignated bargaining representatives, andt~~oid disruption in the service and
operation of said Public Works Department, and to secure the benefits intended
to be derived by the City, its employees, and their designated bargaining repre-
sentatives, to adopt the hereinafter set out rules and regulations covering the
employment and working conditions of the employees of the Public Works Depart-
ment,

NOW THEREFORE, BE IT RESOLVED by the City Council that the following
rules and regulations covering the employment of the employees of the Public
Works Department be adopted and placed in affect as follows, to wit:
ARTICLE I
Recognition
The City hereby agrees to recognize Local No. 49, International Union
Operating Engineers, AFL-CIO, as the bargaining representative of all
employed in the Public Works Department.

ARTICLE II
The City hereby does recognize seniority rights and employees shall be pro-
mo te d, demoted, laid off, and returned to service according to their length
of service, providing however, that such employees qualify to perform the work,
and provided further, that such employees shall not establish seniority rights
until they have been employed for thirty (30) days.
ARTICLE III
Vacations
The employees shall be granted the following vacation schedule:
1 year of service 5 days vacation
2 to 5 years of service 10 days vacation
6 years of se1:'vice 11 days vacation
7 years of service 12 days vacation
8 years of service 13 days vacation
9 years of service 14 days vacation
10 ye~rs of service 15 days vacation
11 years of service 16 days vacation

All vacation pay shall be accrued, and in the event an employee's employment
is terminated for .any reason, the employee shall receive, upon his termination,
the vacation pay which he has coming to him at that time on a pro-rata basis.
No more than four consecutive weeks vacation can be taken at one time.
In computing vacation pay, length of service shall be based upon the anniversary
date of the day an employee commences employment.

All employees are to be paid their vacation pay prior to their leaving for
their vacation.
ARTICLE IV
Grievances

Should any grievance arise as to the interpretation of or adherence to the terms
and provisions of this resolution, the employees affected may, either directly
or through their designated bargaining representative, take the matter up with
the department head in an effort to effect a satisfactory settlement. If the
department head and the employees are unable to agree, then the matter shall
be referred to the designated bargaining representative, who shall endeavor to
effect a satisfactory settlement with the City Councilor its authorized repre-
sentative.

Discrimination
No employee shall be discriminated against and no employee shall be discharged
for giving information regarding alleged violation of this resolution.
ARTICLE VI
Sick Leave and
Other Leave of Absence

All employees of the City shall be entitled to aecumulate one day of sick leave
for each month of employment and allowed accumulation of sick leave up to one
hundred twenty (120) days. Employees shall bank an additional one-half (1/2)
day per month after the accumulation of the 120 days to be used only in cases
of very prolonged illnesses. Sick leave will be granted for actual sickness,
temporary physical disability, quarantine, and death in the immediate family.
The City may require a doctor's certificate on sick leave claims of three days
or more.
ARTICLE VII
Severance Pay
If an employee retires at age 65, or as otherwise provided by law, or is forced
to retire due to physical condition not allowing him to continue gainful employ-
ment, but not if discharged or resigns by the request of the City, after ten
(10) years of service, they will receive 35% of unused sick leave, based on
their current hourly rate,as severance pay. The one-half day per month accum-
ulated after the 120 days, will not be considered for severance pay purposes.
ARTICLE VIII
Hours of Employment
The regular work day shall consist of eight (8) hours per day and the regular
work week shall consist of forty (40) hours in anyone (1) week. Overtime
shall be paid at the rate of one and one-half (1-1/2) times the regular hourly
rate of pay for all work performed after eight (8) hours in anyone day, and
forty(40) hours in anyone (1) week.

All hours worked on Saturdays, Sundays, holidays and days observed as legal
holidays will be paid at one and one-half times the regular hourly rate.
An employee called back to ~ork after he has completed his regular work day or
called out on his day off shall receive a minimum of two (2) hours' pay at the
overtime rate.
On all classifications when full time work is available, senior employees shall
be given the first opportunity to work the full week if the senior employees
are available. There shall be no discrimination in favor of junior employees.
This shall operate within the classification only. "Full time" work shall be
construed to mean the regular work week or day as defined in this Article. No
part-time employees shall be permitted to work until all regular employees
have been given opportunity to work a full eight (8) hours that day or a full
forty (40) hours that week. Nothing contained herein shall be construed to
permit a pyramiding of overtime.

When mechanical work is being performed, the employee shall be paid the Heavy
Equipment Operator's rate.
ARTICLE X
Holidays

All regular employees of the City who have been in the employment of the City
for more than thirty (30) days shall be entitled to the following holidays
with pay: New Year's Day, Lincoln's Birthday, Washington's Birthday, Good
Friday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans'
Day, Thanksgiving Day, and Christmas Day, providing that such employee shall
work his regular work -day preceding such holiday and the day succeeding such
holiday, unless the employee is on vacation or absent from work because of an
excused sick leave, or on -account of an industrial accident. In the event that
New Year's Day, Memorial Day, Independence Day, or Christmas Day should fall on
a Sunday, the following Monday shall be celebrated as the holiday. In the
event that New Year's Day, Memorial Day, Independence Day, or Christmas Day
fall on a Saturday, the preceding Friday or the following Monday shall be
celebrated as the holiday. ' .
ARTICLE XI
Leave of Absence
Employees subpoenaed as witnesses or called and selected for jury duty shall
rece<ive their regular compensation and other benefits for their employment
less the amount received by them as jurors or witness fees.
The City agrees to grant the necessary time off without pay to any employee
designated to attend a labor convention or to serve in any capacity on other
official un~on business.
ARTICLE XII

Miscellaneous Working Rules
No supervisor shall be allowed to operate any equipment when any regular
employee is in a laid off status.

ARTICLE XIII
Job Classification
The City will forthwith undertake a job classification study of the Public
Works Department. At the conclusion of the study, the Union will be advised
of City findings and recommendations. The Union will be given an opportunity
to be heard before implementation of any recommendations arising from the
study.

ARTICLE XIV
Insurance Benefits
All regular employees will continue to be covered under the hospita1-medical-
surgical insurance plan adopted by the City. Full cost of employee coverage
to be paid by the City. Cost of dependent coverage to be paid by the employ-
ee. All regular employees will also receive a $5,000. Life Insurance policy
with the full cost of the premiums to be paid by the City.
ARTICLE XV
Amendments
Amendments may be made to this resolution at any time by the City Council,
with the approval of Local 49, International Union of Operating Engineers.
ARTICLE XVI
Effective Date
This resolution shall be considered to have been in full force and effective
as of January 1, 1970.

WHEREAS, it has been deemed advisable and necessary for the City of
Hastings, Minnesota to participate in the cost of a construction project located
on Trunk Highway 291, within the limits of said municipality, and,
WHEREAS, said construction project has been approved by the Depart-
ment of Highways and identified in its records as S.P. No. 1924-01,
NOW THEREFORE, BE IT RESOLVED, that we do hereby appropriate from
our Municipal State Aid Street Funds the sum of $6,951.61 to apply towards
the construction of said project and request the Commissioner of Highways to
approve this authorization.

Notice is hereby given that the City Council of Hastings, Minnesota
will meet in the Council Chambers of the City Hall at 8:00 o'clock P.M. on

Councilman Kane seconded the motion to adopt said resolution and the
same was passed by the following vote: Ayes, all; Nays, none.
Moved by Councilman Christenson, seconded by Councilman Hallberg
that a 1970 Cigarette License be approved for The Sports Spot and Perkins
Cake and Steak House. Ayes, all; Nays, none.
Moved by Councilman Fischer, seconded by Councilman Soleim to pass
the second reading of a Charter Amendment by Ordinance, pursuant to M.S.A.
410.31 (Laws 1967, Ex. Sess., C 33, Section 3), Chapter X, Sections 1, 2, 3,
and 4. Ayes, all; Nays, none.
Moved by Councilman Gunderman, seconded by Councilman Kane that the
bills as audited be approved and the City Clerk be instructed to issue warrants
for the same.

meeting on Monday, April 27, 1970 at 8:00 o'clock P.M. in the Council Chambers of

The Public Hearing.on the proposed change of the City Charter by
OrdiuancQ was called to order by Mayor Rotty at 8:00 o'clock P.M. on April 27,
1970~ pursuant to notices published pursuant to Statute on April 9 and April 16,
1970. The City Attorney reviewed the proposed Charter change. All persons present
were. given an opportunity to be heard. No one present spoke in opposition to the
proposed change. After all persons present were given an opportunity to be heard,
it was stated that the Council would further consider the matter at the next regular
meeting of the City Council on May 4, 1970 at 8:00 o'clock P.M.
