The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, April 6, 1970 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Soleim, Novak, Kane, Hallberg,
Christenson, Driscoll, Fischer, Gunderman,
and Mayor Ratty.
Members absent: None.

Moved by Councilman Gunderman, seconded by Councilm~n Christenson
to pass the second reading to revoke an Ordinance entitled "AN ORDINANCE
CREATING AND ESTABLISHING A WATER HYDRANT RENTAL". Ayes, all; Nays, nOne.
Moved by Councilman Soleim, seconded by Councilman Fischer to
pass the second reading to amend Section 7 of an Ordinance entitled "AN
ORDINANCE LICENSING AND REGULATING THE SALE OF INTOXICATING LIQUORS WITH-
IN THE CITY OF HASTINGS, DAKOTA COUNTY, MINNESOTA, REPEALING INCONSISTENT
ORDINANCES AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF" to conform
with 8:00 o'clock P.M. closing of Off Sale Liquor establishments. Ayes,
all; Nays, none.
Moved by Councilman Gunderman, seconded by Councilman Novak that
the second reading of an Ordinance entitled "AN ORDINANCE SPECIFYING TYPES
OF LOCKS ACCEPTABLE FOR USE ON APARTMENT, HOTEL AND MOTEL DOORS" be tabled
until April 20, 1970, and that an informal hearing to discuss this Ordin-
ance be set for 8:00 o'clock P.M., April 20, 1970 in the Council Chambers
of the City Hall. Ayes, all; Nays, none.
Councilman Driscoll introduced the following resolution and moved
its adoption.

BE IT RESOLVED, That pursuant to statutory authority, that John
Davidson, Municipal Engineer for and on behalf of the Municipality of the
City of Hastings is hereby authorized to request and obtain from the
Minnesota Department of Highways, needed engineering and technical service
during the year of 1970; for which payment will be made by the Municipality
upon receipt of verified claims from the Commissioner of Highways.
Adopted by the City Council this 6th day of April, 1970.

and the same was passed by the follewing vote: Ayes, all; Nays, none.
Moved by Councilman Soleim, seconded by Councilman Fischer to
refer to the Planning Commission Leo Schumacher's request for a Residential 1
to a Residential 3 rezoning of the following area: Ayes, all; Nays, none.

The City Clerk read a letter from Paul Gunderman, Second Ward
Councilman, resigning his position as Councilman effective April 21, 1970.
Moved by Councilman Soleim, seconded by Councilman Kane that the resignation
be accepted, and that-the vacancy be announced and letters of intent from
persons interesfed in filling this vacancy should be directed to the City
Clerk, postmarked no later than April 20, 1970. Ayes, all; Nays, none.
Councilman Gunderman introduced the following resolution and
moved its adoption:

RESOLUTION ON DUMPING AND BURNING
BE IT RESOLVED BY THE CITY COUNCn. OF THE CITY OF HASTINGS, MINNESOTA:
THAT the present City dump be converted to a temporary sanitary
landfill. That when the County plan is formulated and the closest landfill
is nore than ten (10) miles distant, a transfer station will be considered;

THAT consideration to a no burning ordinance may be enacted within
three (3) months in accordance with M.P.C.A. regulations.
THAT regular dump hours be established and a total fee system be
enacted for the disposal site.
THAT the citizens have the option of collection service or privately
dumping for a fee. If indiscriminate dumping (off site) is prevalent, then
mandatory collection will be considered.
Adopted by the City Council this 6th day of April, 1970.

Councilman Hallberg seconded the motion to adopt said resolution
and the same was passed by the following vote: Ayes, all; Nays, none.
Mr. Walter Petersen, Chairman of the Charter Commission of the
City of Hastings addressed the Council. He reported that the Charter
Commission had passed a proposed amendment to the City Charter, which the
Commission is this date certifying and recommending to the Council for
passage as a Charter Amendment by Ordinance, pursuant to M.S.A. 410.31
(Laws 1967, Ex. Sess., C 33, Section 3). The text of the proposed Charter
change, as recommended by the Charter Commission, is as follows:

CHAPTER X
Section 1. In addition to the powers otherwise granted by Minnesota Laws
and this Charter, the City of Hastings shall bave the power to acquire by
purchase, gift or devise, and develop, on such terms as the City Council
may in its sole discretion from time to time determinea11 necessary right,
title and interest in and to land, including air rights, and any buildings
and equipment thereon, necessary or desirable for the purpose of promoting
industry, and providing employment and in order to promote, attract, en-
courage and develop economically sound industry and commerce through govern-
mental action for the purpose of preventing so far as possible, the emergence
of blight and marginal lands and areas of chronic unemployment.
Section 2. The City may pay for the acquisition and development of the
property acquired for the purposes and pursuant to the provisions of
Section 1 above out of such funds as may from time to time be available
and appropriated by the City Council for such purposes, including but not
limited to funds acquired through the issuance of general or special obli-
gation bonds. If the acquisition and development of lands acquired puraaant
to Section 1 is paid for from the proceeds of general obligation bonds, the
development of such land may include provision for utility services, in- 'l
cluding water, sanitary sewers, storm sewers or other drainage facilitie~, l
and transportation, power and communications facilities, which are necessary ___
and incidental to the use of such lands for the foregoing purposes, but
except with respect to such facilities may not include provision for the
construction of structures or buildings on the premises or furnishing or
equipping thereof.
If acquisition and development are paid for from the proceeds
of general obligation bonds, such bonds shall be authorized, issued, sold
and accounted for in the manner and upon the terms, conditions, and pro-
visions prescribed by Chapter 475 Minnesota Statutes and acts amendatory
thereof and supplemental thereto. The general obligation bonds authorized
by this section shall not be subject to any limitation contained in this
City Charter prescribing or fixing any limit upon the bonded indebtedness
of this City.
Section 3. Notwithstanding any other prov~s~on of this Charter to the
contrary, any properties acquired or owned by the City and not required
for municipal purposes may be sold or leased without approval of the elect-
orate to achieve the purposes set forth in Section 1 above on such terms
and conditions as the City Council in its sole discretion shall determine.
When such property is sold or leased to non-governmental corporations or
agencies, it shall not be exempt from taxation.
Section 4. Nothing contained herein shall be construed to restrict the
power and authority of the City to develop, lease and sell property 0
acquired pursuant to this chapter in accordance with the further provisions . i
of Chapter 474,Minnesota Statutes, as amended or supplemented, or such ~
other laws as may from time to time be adopted, or to restrict in any way
the powers granted to the City under Chapter 474, Minnesota Statutes, and
acts amendatory and supplemental thereto, or such other laws as may from
time to time be adopted.
After discussion by the Council, a motion was made by Councilman
Fischer, seconded by Councilman Soleim to pass the first reading of the
Ordinance amending the City Charter, as set forth above, and to set a public
hearing on the matter for April 27, 1970 at 8:00 P.M. o'clock at the City
Hall, with publication of said hearing to appear in the legal newspaper
on April 9th and 16th, 1970. Ayes all; Nays, none.
Moved by Councilman Kane, seconded by Councilman Driscoll that the
bills as audited be approved and the City Clerk be instructed to issue
warrants for the same. Ayes, all; Nays, none.
