HomeMy WebLinkAbout02-16-70 459 Hastings, Minnesota February 16, 1970 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, February 16, 1970 at 7:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Soleim, Novak, Kane, Hallberg, Christenson, Driscoll, Fischer and Gunderman. n I Members absent: Mayor Rotty. Acting Mayor Soleim presiding. Minutes of the last meeting were read and approved. The City Clerk presented affidavits showing the due publication of the notice of a Public Hearing for the 1970 Improvements: Proposal I - Street Surfacing and Concrete Curb and Gutter 20th Street and 21st Street within Townsview Estates and 22nd Street from Westview Drive to Pleasant Drive - Bituminous Surfacing and Concrete Curb and Gutter. Westview Drive, Sun Valley Drive, 14th Street, Hillside Street, View Court, and Hillside Court within Dakota Hills 2nd Addition- Bituminous Surfacing and Concrete Curb and Gutter. Forest Street from 17th Street to 18th Street - Bituminous Surfacing and Concrete Curb and Gutter. The Council heard all persons ,interested in said improvements. All persons present were afforded an opportunity to present their views and objections to the making of said improvements. The City Clerk read a letter from Leo Schumacher requesting the deletion of the following: Imperial Estates - Sanitary Sewer, Watermain, Storm Sewer, Street Gradimg and Gravel Base Construction. 460 and a letter from Hastings Construction Company requesting the deletion of the following: Westview Drive, Sun Valley Lane, 14th Street, Hillside Street, View Court and Hillside Court within Dakota Hills 2nd Addition.- Bituminous Surfacing and Concrete Curb and Gutter. 14th Street from Dakota Hills 2nd Addition to Hastings Oak Park Addition and 13th Street, 13th Place within Dakota Hills 2nd Addition - Sanitary Sewer,Watermain, Storm Sewer and Street Grading and Gravel Base Construction. o Moved by Councilman Gunderman, seconded by Councilman Fischer to delete the above listed projects as requested by Leo Schumacher and Hastings Construction Company. Ayes, all; Nays, none. The Council then discussed at length the portion of the pro- posed 1970 Improvements dealing with installation of sidewalks along Pine Street. The Clerk advised the Council that the petition for this particular improvement did not contain the signatures of thirty-five percent (35%) or more of the property owners involved. Moved by Couricilman Kane, seconded by Councilman Driscoll to delete from the 1970 Improvement Program the portion dealing with the installation of sidewalks on Pine Street. Ayes, Councilmen Novak, Kane, Christenson and Driscoll; Nays, Councilmen Soleim, Hallberg, Fischer and Gunderman. The motion was declared to fail for lack of a majority voting in the affirmative. Moved by Councilman Hallberg, seconded by Councilman Novak to postpone action on that portion of the 1970 Improvement Program dealing with Pine Street sidewalks to allow further study by the Council. Ayes, Councilmen Soleim, Novak, Hallberg, Christenson, Driscoll and Fischer; Nays, Councilmen Kane and Gunderman. The motion was declared to pass. o The following resolution was then introduced by Councilman Hallberg who moved its adoption: RESOLUTION ORDERING IMPROVEMENT, APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS WHEREAS, after due notice of Public Hearing on the 1970 Improve- ments for the following streets: 20th Street and 21st Street within Townsview Estates and 22nd Street from Westview Drive to Pleasant Drive. Such plans and specifications, a copy of which is on file in the City Clerk's Office are made a part hereof are hereby approved. 2. The City Clerk shall prepare and cause to be inserted in the official paper an advertisement f~r bids upon the making of such approved plans and specifications. The advertisement shall be published for three (3) weeks and shall specify the work to be done and shall state that bids will be opened and considered by the Council at 2:00 o'clock P.M. on Thursday, April 16, 1970 in the Council Chambers of the City Hall and awarded on Monday, April 20, 1970 at 8:00 o'clock P.M. and that no bids will be considered unless sealed and filed with the Clerk and accompanied by a cash depository, cashier's check, bid bond or certified check payable to the Clerk for five (5) percent of the amount of such bids. Adopted by the City Council this 16th day of February, 1970. Councilman Christenson seconded the motion to adopt said resolu- tion and the same was passed by the following vote: ' Ayes, all; Nays, none. ATTEST: i).p. {wv~ City Clerk ~ .JA 'A Acting Mayor 7 r I ' I Councilman Fischer introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS BE IT RESOLVED, By the City Council of Hastings, Minnesota as follows: That it is advisable; expedient, and necessary that the City of Hastings construct the following: 462 Water Well, Well Pump and Pump House and appurtenances thereto on the three and one-half acre site of the ground storage tank on T.H. 55, and a Water Strengthening Main across and parallel to T.H. 55, as are fully described in the plans and specifications on file with the City Clerk of Hastings, Minnesota; AND, WHEREAS, Pursuant to a resolution duly passed on the 19th day of January, 1970, the City Engineer has prepared plans and specifica- tions for said improvements and has presented such plans and specifications to the City Council of Hastings, Minnesota for its approval; NOW THEREFORE, BE IT RESOLVED, By the City Council of Hastings, Minnesota: o 1. That such plans and specifications, a copy of which plans and specifications are on file in the office of the City Clerk of Hastings, Minnesota, and which plans and specifications are made a part hereof by reference herein, are hereby approved. 2. That the City Clerk shall prepare and cause to be inserted in the official newspaper an : advertisement for bids upon the making of such improvements under such approved plans and specifications. The advertise- ment shall be published for three (3) weeks and shall specify the work to be done and shall state that the bids will be received by the City Clerk of the City of Hastings, Minnesota until 2:00 o'clock P.M., Thursday, April 16, 1970, and be opened and considered by the Council at this time and awarded at 8:00 o'clock P.M., Monday, April 20, 1970 in the Council Chambers of the City Hall. No bids will be considered unless sealed and filed with the City Clerk and accompanied by a cash depository, cashier's check, bid bond or certified check payable to the City Clerk for five per- cent (5%) of the amount of such bids. AND, FURTHER, that with reference to the following property: That part of the NE 1/4 of SE 1/4, Section 29, Tl15N, R17W, West of Westview Drive and fronting on the South Frontage Road South of T.H. 55 containing 804 front feet; and the Easterly 300 feet of the NW 1/4 of SE 1/4, Section 29, T1l5N, R17W fronting on the South Frontage Road South of T.H. 55 containing 300 front feet. [ The intent of the Council is that at such future time as said property is served by the subject Water Strengthening Main, the Council will institute a Special Assessment proceeding regarding said property, with notices, hearings, etc., as required by appxpriate Statutes, to effect assessment against said property of a proportionate share of the cost of said main, plus interest thereon from date of final acceptance at eight (8) percent per annum. The City Clerk is hereby authorized and directed to return forth- with to all bidders the deposits made with their bids, after a contract has been signed. Moved by Councilman Driscoll, seconded by Councilman Kane that the petition for vacation of the following alley: From Ashland to Forest Street, between 8th and 9th Streets be at this time denied, without prejudice, however, to the right of the petitioners to again petition for the vacation at a later time. Ii Moved by Councilman Fischer, seconded by Councilman Gunderman that an Amendment to Section 6 of "AN ORDINANCE FOR THE PURPOSE OF PRO- MOTING HEALTH, SAFETY, ORDER, CONVENIENCE AND GENERAL WELFARE BY REGU- LATING THE USE OF LAND, THE LOCATION, SIZE, USE AND HEIGHT OF BUILDINGS, THE ARRANGEMENT OF BUILDINGS~ON LOTS, THE DENSITY OF POPULATION AND DESIGNATING THE BOUNDARIES OF HASTINGS, MINNESOTA, ALL IN ACCORDANCE WITH A COMPREHENSIVE PLAN", passed and adopted August 6, 1956, pass its second reading, zoning the following property to Residential 3: Ayes, all; Nays, none: Lots 1 to 14 inclusive, and that portion of Lot A adjacent to Lots 9 and 10, King Midas Addition, except the North 35 feet of the West 150 feet of Lot 1. Moved by Councilman Kane, seconded by Councilman Gunderman that the City Engineer and Clerk present to the Metropolitan Council the follow- ing statement on solid waste: The City of Hastings can and desires to develop and operate a type of sanitary solid waste disposal system proposed by the State Legislature, M. P. C. A. and Metropolitan Council. We do ask that consideration be given to the problems directly affecting the citizens of the City of Hastings in implementation of such a plan, and that detailed interpretation be made regarding certain sections of the Development Guide as presented. In particular as related to "Existing Sanitary Landfills". n The City of Hastings has and does operate a landfill for residents of the City and by contract the Townships of Marshan, Nininger and Ravenna. Although considerable progress has been made toward the sanitary landfill concept, it does not meet M. P. C. A. Standards at the present time. Because of the economics involved, the City has not determined at this time which method of disposal system will be used: The upgrading of the landfill to meet M. P. C. A. requirements, or a pick-up' station con- cept to fit the County or Inter-County Plan. We take particular exception to Policy No.3: "Stockpile or disposal of hazardous and toxic wastes in a safe and nuisance-free manner, and do not mix them with other wastes in sanitary landfills." The City of Hastings in coordinating efforts to prevent pollution 464 by discharge of liquid waste into rivers is allowing H. D. Hudson Manufac- turing Company to deposit the sludge from their "brass-brite" process into the City Landfill. The M. P. C. A. has approved this discharge, provided it is mixed with the cover material each day. The material consists of dissolved metals including chromates and amounts to 150 gallons per day. , We would suggest amending Policy No. 3 by adding the following: "Except as approved by M. P. C. A." We also request clarification of Sections: 7. Select sites accessible by highways that have all-season nine-ton axle load classifications or that are capable of achieving an equivalent carrying load. Use of the road for hauling must meet safety standards of the'nppropriate road authority. o 9. Open disposal sites included in the Metropolitan Solid Waste Disposal System to all users irrespective of their place of residence or business. 10. Post at each disposal operation a schedule of rates for types of solid waste accepted at the operation. 11. Provide suitable disposal facilities for use by individuals who wish to transport their own solid waste. We do not take exception to these polic ies, but no;; mention is made to specific landfills operated by a municipality for only that muni- cipality. Further, if a municipality does provide for all waste generated within that community, the County within which the municipality lies should be given credit for that amount of waste being generated by the area it serves. This reduction should be allowed as a credit to the total require- ments under Paragraph 3, Page 15. We agree with the Dakota County Board Preliminary Report: '-1 u Strict controls and regulations should be established to control landfill sites, access routes, roadside dumping, and accessibility. Some system of licensing or policing should be established. A major landfill within 15 miles of downtown St. Paul would not be mandatory if suitable pick-up stations were provided within said distance. Economic and aesthetic well-being of the commu- nity in which the final landfill is located should take priority over haul distance and operational economy. We would suggest revising Paragraph 3, Page 15 as follows: "Dakota County: Generation area of Dakota County and South- western Ramsey County - 3,200 acre foot capacity needed, the major portion of which should be readily accessible to the northern part of the County and to St. Paul," We would further sugge~that Some guide lines and procedures establishing variance provisions be included with this development guide. As a practical matter, there will be a time lag between the County Plan and implementation. The communities will require a reasonable time to adjust to the County Plan. As a matter of economics, the City of Hastings may not upgrade its present facility if a pick-up station concept is provided. City Clerk The Chairman of the Planning Commission advised the City Council that the Planning Commission had determined that the Minnesota Highway Department should study the feasibility of two alternate routes for the Highway 55 by-pass, and he outlined the two routes, Whereupon it was moved by Councilman Hallberg, seconded by Councilman Fischer that the Minnesota Highway Department, and its consultants study the feasibility 465 the following alternates for the Highway 55 by-pass: 1. Through the swail West of the Augustine Hill and looping South and Southeast and then East to Highway 61. 2. Locating the by-pass just East of Jacobs Street, using Jacobs as a Westerly service road. and also study the feasibility of a third access at County Road 48. Ayes, all; Nays, none. ~ Moved by Councilman Fischer, seconded by Councilman Driscoll that the City Council go on record to the Minnesota Highway Department favoring the West T.H. 61 by~pass over the proposed East route.
