The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, November 5, 1984 at 7:30 p.m. in the Council
Chambers of the City Hall.
Members Present: Councilmen Karnick, Klimek, Pike, Kulzer,
Trautmann, Werner, and Mayor Stoffel.

Members Absent: Councilmen Nesbitt and Plan.
The Mayor called for additions or corrections to the minutes
of the meeting of October 10, 1984, meeting of October 15, 1984, and
Special Meeting of October 23, 1984 and October 24, 1984. Hearing none
the minutes were approved as presented.

The Mayor opened the public hearing at 7:32 p.m.
The purpose of the public hearing was to consider and pass
on all objections, written or oral, if any, regarding
declaring the part of Outlot A as surplus property on Prairie
Court. The City Administrator/Clerk and the City Planner
reviewed the Prairie Court extension. Pastor Fair, of Haven
Homes, urged the Council to favorably recommend the declar-
ation of part of Outlot A as surplus property and the approval
of the preliminary plat. No one else wished to speak on the
matter. The Mayor closed the public hearing at 7:44 p.m.

The Mayor declared the public hearing open at
7:45 p.m. The purpose of the public hearing was to consider
and pass on all objections relating to planning and implement-
ation of a Single Family Mortgage Revenue Bond Housing
Program. All persons desiring to speak on the issue were
given the opportunity to do so. No one wished to speak on
the matter. The Mayor closed the public hearing at 7:47 p.m.

The purpose of the public hearing was to hear and pass on all
objections, written or oral, if any/regarding the vacating
of a one (1) foot by sixty (60) foot strip on the corner of
Vermillion and Fourth Street. All persons desiring to speak
on the issue were given the opportunity to do so. No one
wished to speak on the matter. The Mayor closed the public
hearing at 7:48 p.m.
Moved by Councilman Pike, seconded by Councilman
Klimek to adopt Resolution No. 90-84 accepting and awarding
the bid for the Parks Department Dump Truck to Joe O'Brien
Chevrolet-Cadillac for the net bid of $7,660 and for the
Street Department Dump Truck to Lakeland Ford Incorporated
for the net bid of $33,240. Ayes, 7: Nayes, None. Copy of

Moved by Councilman Klimek, seconded by Councilman
Werner to pass the third and final reading of ordinance #168
authorizing the Dakota County Housing and Redevelopment
Authority to exercise on behalf of the City of Hastings
the powers conferred by Minnesota Statutes, Section 462 C.Ol
to 462 C.08 relating to Planning and Implementation of a
Single Family Mortgage Revenue Bond Housing Program. Ayes,
7; Nayes, None.
Moved by Councilman Kulzer, seconded by Councilman
Plan to table the second reading of an ordinance amending the
mobile home yard size setback requirements until the December
3, 1984 regular City Council meeting. Ayes, 7; Nayes, None.

Plan to adopt Resolution No. 91-84 vacating a one (1) foot by
sixty (60) strip on the corner of Vermillion and Fourth Street.

Klimek to authorize staff to sign a loan agreement between the
Metropolitan Council and the City of Hastings for a no
interest loan that the City applied for to carry out the
feasibility study of a waste to energy project. Ayes, 7;
Nayes, None. Copy of Agreement on file in the office of
the City Administrator/Clerk.
Moved by Councilman Kulzer, seconded by Councilman
Pike to table the matter of a resolution authorizing the
signing of a joint powers agreement creating the Lower St.
Croix Watershed Management Organization. Ayes, 7; Nayes,
None.
Moved by Councilman Plan, seconded by Councilman
Klimek to approve the preliminary plat of a re-plat elim-
inating interior lot lines to provide common property for
a proposed four-plex condominium unit and improving the legal
description by designating the structures by lot and block
to clarify the description and design of the properties
on Lincoln Lane. Ayes, 7; Nayes, None.

Moved by Councilman Trautmann, seconded by Councilman
Plan to accept the Planning Commission's and the staff's
recommendation and deny the annexation request for Lot 9,
Sunset View (Marshan Township) for Mr. nad Mrs. Ries and
Mr. Dahlbotton because the area cannot be serviced with
utilities within a one (1) year time frame. Ayes, 7; 0 .

Moved by Councilman Werner, seconded by
Councilman Karnick to deny declaring part of Outlot A as
surplus property and the preliminary plat of Prairie Court
in the City of Hastings. Ayes, 7; Nayes, None.
Moved by Councilman Kulzer to require a Planned
Residential Development plan before the R-3 zoning is
allowed for the l60th Street zoning petition. The motion
died for a lack of a second.
Moved by Councilman Trautmann, seconded by
Councilman Klimek to approve the first reading of a zoning
request to rezone the property of l60th Street to an R-3
zoning district. Ayes, Klimek, Trautmann, and Werner;
Nayes, Karnick, Plan, and Kulzer. Abstained, Pike. The
motion does not pass.
Moved by Councilman Werner, seconded by Councilman
Kulzer to deny the variance request for a sign height at
2929 Highway 316 for Joe O'Brien (O'Brien Chevrolet-
Cadillac) based upon the Planning Commission's recommendation
and the City's past practices. Ayes, 7; Nayes, None.
Moved by Councilman Karnick, seconded by
Councilman Kulzer to grant the variance for a side yard
setback at 914 West 5th Street, Loren Wical, to construct a
two-car detached garage that will extend no closer than 24
inches to the property line. Ayes, 7; Nayes, None.

Klimek to direct City staff to prepare two (2) applications
for community development block grants for two (2) projects;
1.) Acquisition of property - O'Connor/Kranz Building;
2.) Second Street Infrastructure Improvements. Ayes, 7;
Nayes, None.

Klimek to approve the variance for the addition of a fireplace
to within 4'5" of the side yard property line of 1180 West 4th
Street for Dick Stern. Ayes, 7; Nayes, None.
Moved by Councilman Trautmann, seconded by Council-
man Kulzer to adopt Resolution No. 92-84 for the 1985 Federal
Revenue Sharing Budget. Ayes, 7; Nayes, None. Copy of

Moved by Councilman Werner, seconded by Council-
man Kulzer to authorize the Lions Club to place a car on the
ice at Lake Rebecca and to sell raffle tickets to the public in
conjunction with the event. This would be subject to a thirty
(30) foot fenced area being placed around the car and the same
agreements that were reached with the Lions Club for the 1983
request. Ayes, 7; Nayes, None.
The matter of the Dakota County HRA proposal for
115 Franklin Street was forwarded to the Planning Commission
for their recommendation. There was no action by the Council.
Moved by Councilman Trautmann, seconded by Council-
man Karnick to appoint Councilman Nesbitt to represent the
City of Hastings on the Joint Planning Board for annexation.

Moved by Councilman Werner, seconded by Councilman
Pike to have the City of Hastings enter into a development
contract with Tansell Properties whereby a provision would
be made in the development contract with the City that would
provide reimbursement if lots were developed adjacent to the
watermain. Ayes, 7; Nayes, None.
Moved by Councilman Trautmann, seconded by Council-
man Kulzer to adopt Resolution No. 93-84 regarding Development,
Transmission, and Distribution of Electrical Power at the
proposed hydroelectric power plant on Lock and Dam No.2.
Ayes, 7; Nayes, None. Copy of Resolution on file.
Moved by Councilman Trautmann, seconded by Council-
man Plan to adopt Resolution No. 94-84 whereby the City of
Hastings' is requesting funding assistance for a special leaf
pickup for a compost program from the Dakota County Board.

Moved by Councilman Klimek, seconded by Councilman
Kulzer to authorize the City Staff to work with the Fire/EMS
Commission to compile statistics regarding the City of Hastings
converting from a BLS to ALS System. Ayes, 7; Nayes, None.

A Representative of the Bonestroo and Associates
Firm was present and gave a review of the additional water
storage facility in the City of Hastings. The Council re-
ferred the matter to the Operations Committee to review and
recommend a site location. There was no further action by
the City Council.
Moved by Councilman Trautmann, seconded by Council-
man Klimek to extend the contract for Frazer Construction
Company, doing the Ramsey/Tyler Street Construction, to
November 30, 1984. Ayes, 7; Nayes, None.
Moved by Councilman Kulzer to have the City hire
an appraiser for the Mn/DOT Trunk Highway 55 Construction.
The motion died for a lack of a second.

Trautmann to authorize the City Attorney's Office to appeal
the damages awarded Mr. Richard Olson for a permanent drainage

ordering final payment to Austin P. Keller Construction Company
