HomeMy WebLinkAbout10-15-84 Hastings, Minnesota October 15, 1984 199 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, October 15, 1984 at 7:30 p.m. in the Council Chambers of the City Hall. r-- Members Present: Councilman Karnick, Nesbitt, Klimek, Pike, Plan, Kulzer, Trautmann, and Mayor Stoffel. Members Absent: Councilmen Werner. The Mayor called for any additions or corrections to the minutes of the meeting of October 1, 1984 and hearing none declared the minutes approved as presented. C\J (.D CD o CD <t The Mayor opened the public hearing at 7:33.p.m. The purpose of the public hearing was to consider and pass on all objections, written or oral, if any, regarding ordinance amendments for the Hastings Industrial Park. ~ll persons de- siring to speak on the issue were given the opportunity to do so. No one wished to speak on the matter. The Mayor closed the public hearing at 7:34 p.m. Moved by Councilman Trautmann, seconded by Council- man Karnick to pass the 3rd and final reading of ordinance No. 164, amending section 2.04, subdivision 5, sub-section B, having to do with special use permits; ordinance No. 165, amending section 10.07, subdivision 7, sub-section A, of the City Code having to do with general requirements for the In- dustrial Park; and ordinance No. 166, amending section 10.19, subdivision 3, of the City Code having to do with Industrial Park zoning regulations. Ayes, 7; Nayes, None. ~ The Mayor opened the public hearing at 7:34 p.m. to hear and pass on all objection~written or ora1Jto the ordinance amending section 3.20, subdivision 6, having to do with liquor establishments being open on Election Day. Everyone wishing to speak on the issue was given the oppor- tunity to do so. No one wished to speak on the matter. The Mayor closed the public hearing at 7:35 p.m. Moved by Councilman Pike, seconded by Councilman Plan to pass the 3rd and final reading of an ordinance No. 167 amending section 3.20, subdivision 6, of the City Code having to do with the beer, liquor, and wine licensing and regulation on Election Day. PUBLIC HEARING - ORDINANCE AMENDMENTS - INDUSTRIAL PARK 3RD AND FINAL READING - ORDINANCES # 164, 165, & 166 - INDUSTRIAL PARK PUBLIC HEARING - LIQUOR SALES ON ELECTION DAY 3RD AND FINAL READING - ORDINANCE #167 - LIQUOR SALES ON ELECTION DAY The Mayor opened the public hearing at 7:35 p.m. to PUBLIC HEARING - hear and pass on all objections/written or ora~ to the proposed EXCESS PROPERTY - sale of excess property on Prairie Court. PRAIRIE COURT Moved by Councilman Pike, seconded by Councilman Nesbitt to table the public hearing until the November 5, 1984 regular City Council meeting. The Planning Commission, due to lack of quorum, did not mee4 therefore had no recommendation for the Council. Ayes, 7; Nayes, None. ,...-. The Mayor declared the public hearing open at 7:36 p.m. for consideration of the 1985 Federal Revenue Sharing Funds. Everyone wishing to speak on the matter was given the opportunity to do so. No one wished to do so. The Mayor closed the public hearing at 7:37 p.m. Moved by Councilman Pike, seconded by Councilman Plan to adopt Resolution No. 84-84 awarding the bid for the lease of approximately 102 acres in the Industrial Park to the apparent high bidder, Carlson Brother's, in the amount of $14,280.00. Ayes, 7; Nayes, None. Copy of Resolution on file. PUBLIC HEARING - 1985 FEDERAL REVENUE SHARING FUNDS AWARD BID - RESOLUTION NO. 84-84 - LEASE INDUSTRIAL PARK LAND 200 October 15, 1984 . AWARD BID - RESOLUTION NO. 85-84 - REPAIR OF RED BUOY - 117 E. 2ND STREET HIRE CONSULTANT FOR INCINERATOR 2ND READING - ORDINANCE AUTHORIZING DAKOTA COUNTY HRA/CITY OF HASTINGS - SINGLE FAMILY MORTGAGE REVENUE BOND HOUSING PROGRAM 2ND READING - ORDINANCE AMENDMENT - MOBILE HOME YARD SIZE INCREASE STREET VACATION - VERMILLION AND 4TH STREETS SET SPECIAL MEETING - CANVAS OF ELECTION RETURNS USE OF CHAMBERS - TRAVELERS PROTECTIVE ASSOCIATION Moved by Councilman Nesbitt, seconded by Councilman Klimek to adopt Resolution No. 85-84 awarding the bid for the repair of the front of the building at 117 East 2nd Street to keep the bricks from falling on the pedestrian area to Parker Construction, the only bidder, in the amount of $4,275.00. The cost of this repair will be assessed to the property owners on next years taxes. Ayes, 7; Nayes, None. Copy of Resolution on file. Moved by Councilman Trautmann, seconded by Councilman Klimek to enter into a contract with the consulting firm of Foth and Van Dyke to do the feasibility study for the incinerator. The City Council directed the staff to convey to the consulting firm the urgency of the feasibility study and to prepare as soon as possible, however, expressing their concern that the quality not be sacrificed. [ Moved by Councilman Klimek, seconded by Councilman Pike to pass the 2nd Reading of an ordinance authorizing Dakota County HRA to exercise on the behalf of the City of Hastings the powers confirmed by Minnesota Statutes relating to planning and implementation of a Single Family Mortgage Revenue Bond Housing Program and to set a public hearing for the November 5, 1984 regular City Council meeting. Ayes, 7; Nayes, None. Moved by Councilman Karnick, seconded by Councilman Nesbitt to table the 2nd Reading of an ordinance amendment dealing with mobile home yard size increases until the November 5, 1984 regular City Council meeting, due to lack of quorum, the Planning Commission had not make a recommendation. Ayes, 7; Nayes, None. Moved by Councilman Karnick, seconded by Councilman Kulzer to set a public hearing for consideration of a street vacation at 4th and Vermillion Streets for the November 5, 1984 regular City Council meeting. Ayes, 7; Nay~s, None. o Moved by Councilman Karnick, seconded by Councilman Kulzer to set a special Council meeting for November 7, 1984 at 4:30 p.m. for the purpose of canvassing the General Election Returns. Moved by Councilman Pike, seconded by Councilman Karnick to authorize the use of the Council Chambers on May 4, 1985 by the Travelers Protective Association of America during the hours of 3:00 p.m. to 5:00 p.m. Ayes, 7; Nayes, None. LEGAL SERVICES AGREEMENT - Moved by Councilman Kulzer, seconded by Councilman HOLMES AND GRAVEN - Pike that the City of Hastings enter into a legal services MASTER/INCINERATOR agreement with the law firm of Holmes and Graven Chartered, for the purpose of the development of a tax increment district/ Industrial Park. Copy of this agreement is on file in the office of the City Administrator/Clerk. Ayes, 6; Nayes, Trautmann. RESOLUTION NO. 86-84 DEFEASANCE OF 1967 BOND ISSUE LIONS CLUB REQUEST - CAR ON LAKE REBECCA AUTHORIZE ADVERTISEMENT FOR BIDS - INFRARED HEATING - CIVIC ARENA Moved by Councilman Trautmann, seconded by Councilman Klimek to adopt resolution no. 86-84 requesting the bonding con- sultant Springsted, Incorporated to prepare the necessary documents enabling a defeasance of the 1967 Bond issue. Bids to be opened on October 31, 1984 and considered for award at the November 5, 1984 regular City Council meeting. Ayes, 7; Nayes, None. October 15, 1984 Moved by Councilman Trautmann, seconded; by Council- man Karnick to authorize the advertisement for bids for dump trucks for the Street and Park Departments. Bids to be opened on October 31, 1984 at 10:00 a.m. and considered for award at the November 5, 1984 regular City Council meeting. Ayes, 7; Nayes, None. r- I Moved by Councilman Pike, seconded by Councilman Klimek to not accept the resignation of A1 Duratti, Civic Arena Manager, but to give him a ninety (90) day leave of absence to 1-15-85. Moved by Councilman Pike,. seconded by Councilman Nesbitt to appoint Jim McGree as the interim arena manager at a salary of $24,000 per year and to accept the job description for the interim arena manager as on file in the office of the City Administrator/Clerk. The Council also approved hiring of a temporary full-time position at the arena at a rate of $8.00 per hour. Ayes, 7; Nayes, None. Moved by Councilman Pike, seconded by Councilman Plan to adopt Resolution No. 88-84 authorizing the City Administrator/Clerk and Mayor to indicate an interest in joining the out-state cities hiring of a lobbyist. Moved by Councilman Pike, seconded by Councilman Nesbitt to refer the matter of an annexation petition for lot 9 of Sunset View in Dakota County by Michael and Patricia Ries and Neil Dah1botton to the Planning Commission for their review and recommendation. Moved by Councilman Klimek, seconded by Councilman Plan to request that the lease agreement, between the City of Hastings and the State of Minnesota, for the Veteran's Park be amended by eliminating Section 7.3 that states; Lessee shall not erect, build, or install lighting to facilitate night time re- creational events. The Mayor and City Administrator/Clerk are directed to submit a letter to Mr. Strunt, State of Minnesota, with their request. Ayes, 7; Nayes, None. There was no action by the City Council. Moved by Councilman Klimek, ?econded by Councilman Plan to pay Keller Construction for the 1984 Construction Program in the amount of $78,997.13. Moved by Councilman Trautmann, seconded by Council- man Kulzer to adopt Resolution No. 89-84 authorizing the preparation of the feasibility studies for the 1985 petitioned projects. The Council will review the report completed by Bonestroo and Associates with regard to the additional water storage facility in the City. of Hastings. The matter will be discussed at the November 5, 1984 regular City Council meeting. There was no action by the Council. Councilman Trautmann pointed out that the City had not yet appointed their representative to the Joint Planning Board for the Orderly Annexation Area. Mayor Stoffel asked for volunteers, and hearing none, placed the appointment on the November 5, 1984 agenda. Moved by Councilman Kulzer, seconded by Councilman Plan to 1) Pay all bills as audited; 2) Partial Sidewalk Reimbursement - Steve Urman, 307 East 6th Street -$320.00; and 3) Partial Sidewalk Reimbursement - Mike Pechacek, 715 Ramsey - $352.50.
