The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, September 17, 1984 at 7:30 p.m. in the Council
Chambers of the City Hall.
Members Present: Councilmen Karnick, Klimek, Pike, Plan,
Kulzer, Trautmann, Werner, and Mayor Stoffel.

Members Absent:
Councilman Nesbitt.
The Mayor called for additions or corrections to the minutes
of the meeting of September 4, 1984 and the Special Meeting of September
12, 1984 and hearing none declared the minutes approved as presented.
The Public Hearing that had been scheduled for the PUBLIC HEARING -
September 17, 1984 meeting was requested to be cancelled by the HYDROELECTRIC PLANT
developers.

Moved by Councilman Werner, seconded by Councilman
Kulzer to pass the 2nd Reading of an ordinance amending
section 11.07 of the City Code pertaining to public land
dedication requirements. Ayes, 7; Nayes, None.
Moved by Councilman Pike, seconded by Councilman
Werner to pass the 2nd Reading of an ordinance amending Section
10.02 Subdivision 27, 28, and 29 having to do with rear yard
setback requirements. The City Council also set a public
hearing for the October 1, 1984 regular City Council meeting.

Moved by Councilman Pike, seconded by Councilman
Klimek to approve the final plat to Bohlken Estates - 1st
Addition. The plat is consistent with the City's Comp-
rehensive Plan and subdivision ordinance, and the developer's
agreement will be signed and entered into with the City prior
to the final plat being signed. Ayes, 7; Nayes, None.
Moved by Councilman Trautmann, seconded by Council-
man Karnick to pass the 1st Reading of an ordinance amending
Section 2.04, Subdivision 5, Sub-section B of the City Code
having to do with special permits. Ayes, 7; Nayes, None.
Moved by Councilman Pike. seconded by Councilman
Plan to pass the 1st Reading of an ordinance amending Section
10.07. Subdivision 7, Sub-Section A of the City Code having
to do with general requirements of the Industrial Park. Ayes,
7; Nayes, None.
Moved by Councilman Trautmann, seconded by Councilman
Werner to pass the 1st Reading of an ordinance amending Section
10.19. Subdivision 3 of the City Code having to do with Industrial
Park Zoning Regulations. Ayes, 7; Nayes. None.

Kulzer to approve a home occupation permit for Jo1een Ellis
at 301 West 8th Street to operate a gift shop out of her home.

Moved by Councilman Trautmann, seconded by Counci1- CONSULTANTS ON
man Werner to have the City Staff review the proposals from the INCINERATOR
Consultant Engineering Firms concerning a waste to energy facility
for the City of Hastings. Staff will select three (3) to four (4)
Consultants to be interviewed by the Administrative Committee
of the City CounciJ.. The interview date will be October 4, 1984
at 7:00 p.m. in the Council Chambers of the City Hall. Ayes, 7;
Nayes, None.
The City Administrator/Clerk reviewed the procedures HYDROELECTRIC PLANT
of calling for an intent to finance the Hydroelectric Plant.
The Council requested more information be provided to them.
There was no Council action.

Werner to pass the 1st Reading of an ordinance amending Section
3.20, Subdivision 6 of the City code having to deal with beer,
liquor, and wine licensing and regulations. Ayes, 7; Nayes,
None.
Moved by Councilman Klimek, seconded by Councilman
Pike to approve the collateral from the F. & M. Marquette
National Bank, Minneapolis, Minnesota. Ayes, 7; Nayes, None.

Moved by Councilman Karnick, seconded by Councilman
Klimek to adopt Resolution No. 72-84 setting a public hearing
for the Northwest Ponding Basin and 1984 Construction for
October 10, 1984 at 7:30 p.m. at the Hastings Senior High
School Auditorium. Ayes, 7; Nayes, None. Copy of Resolution on file.
Moved by Councilman Trautmann, seconded by Councilman
Plan to have the City Staff review how the Pollution Control
Agency determined the rating of both class Band C with a priority
listing of 31. City Staff will make comment to the M.P.C.A. re-
questing that Hastings remain in a Class B rating. Ayes, 6;
Nayes, Karnick.
Moved by Councilman Trautmann, seconded by Councilman
Pike to award the bid for the reroofing of the Police, Fire and
Street Department buildings to Busse Company of Eden Prairie
in the amount of $63,300. The bid came in over budget so the
balance will be taken from Federal Revenue Sharing Funds or
from excess funds in the departments involved. Ayes, 7; Nayes,
None. Copy of Resolution on file.
Moved by Councilman Trautmann, seconded by Councilman
Karnick to pas Barbarossa and Sons partial payment No. 7 in
the amount of $83,025.30 which includes change order No.3.

Moved by Councilman Trautmann, seconded by Councilman
Karnick to adopt Resolution No. 74-84 making final payment
to the Barr Engineering Company in the amount of $18,050 for
the Northwest Ponding Basin and Storm Sewer Project. Ayes, 6;
Naye, Kulzer. Copy of Resolution on file.
Moved by Councilman Werner, seconded by Councilman
Pike to adopt Resolution No. 75-84 authorizing City Staff to
enter into a quit claim deeds to convey the property along
the northerly parts of Section 28, Township, 115, Range 17,
(approximately 12.7 feet) to adjoining land owners. Ayes, 7;
Nayes, None. Copy of Resolution on file.
FILL BORROWED BY AL SIEBEN Moved by Councilman Pike, seconded by Councilman
N.W. PONDING BASIN Klimek to have Mr. Sieben return the fill borrowed from the
Northwest Ponding Basin to low lying City land developed
between the proposed north frontage road and the private
property to the west along Highway 55 by October 15, 1984.

CITY ACQUIRE LINDEMANN
HOUSE - EAST 4TH STREET
Moved by Councilman Werner, seconded by Councilman
Kulzer to accept the Operation Committee's recommendation
that the City have legal staff draft a transfer of title of
the Lindemann home on East 4th Street from the Kiwanis to
the City of Hastings. The City of Hastings will include the
site and building under its liability insurance coverage and
have the site boarded up to prevent vandalism. The City
Council is requesting that the Natural Resources and Recreation
Commission review the site and building and make recommendation
for its use to the City Council. Ayes, 7; Nayes, None.
