HomeMy WebLinkAbout09-04-84 Hastings, Minnesota September 4, 1984 173 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, September 4, 1984 at 7:30 p.m. in the Council Chambers of the City Hall. Members Present: Councilmen Karnick, Klimek, Pike, Plan, Kulzer, Werner, and Mayor Stoffel. r-- Members Absent: Councilmen Nesbitt and Trautmann. The Mayor called for additions or corrections to the minutes of the meeting of August 20, 1984 and hearing none declared the minutes approved as presented. The Mayor called for additons or corrections to the minutes of the Special Meeting of August 29, 1984 and Councilman Werner noted that in referencing the Energy Park it should be "an" Energy Park. The minutes were then declared approved as presented. C\J (.Q (.Q o CD <t The Mayor opened the public hearing at 7:31 p.m. The purpose of the public hearing was to consider the proposed rate increase for Tier I Cable Service by the Hastings Cable Television Company. Several people in the audience expressed their opposition to the Council with regard to the proposed rate increase. They felt that the Tier I level of service should continue to be a free service. Mr. Conrad Marks, of Hastings Cable TV Company, expressed to the Council the reason behind the proposed rate increase. All persons were offered the opportunity to address the matter. The Mayor closed the public hearing at 7:35 p.m. --- Moved by Councilman Werner, seconded by Councilman Kulzer to deny the proposed request for Tier I (Universal Service), the service will remain a free service to all those subscribing. The City reserves its future regulatory rights with regard to Tier II and Tier III. Ayes, 6; Nayes, None. PUBLIC HEARING - PROPOSED RATE INCREASE BY HCTV The Mayor declared the public hearing open at 7:36 p.m.. The City Planner reviewed the request for the zoning of the recently annexed territory. There was considerable dis- cussion between the City Council and residents that live contig- uous to the recently zoned annexed territory. Their concerns basically involved around living next to multiple dwelling units, decreasing the value of single family residences, traffic backup at peak times, subsidizing the possibility of sewer and water being put in, and their feeling that other areas were more adaptable to multiple dwelling units. All persons wishing to speak on the issue were given the opportunity to do so. The Mayor closed the public hearing at 8:49 p.m. Moved by Councilman Kulzer, seconded by Councilman Karnick to not recommend zoning the annexed territory at this time, but wait until it is brought in for development, then have it reviewed once again by the Planning Commission and sent to the Council for recommendation. Ayes, 4; Nayes, Werner; Abstained, Pike. PUBLIC HEARING - ZONED ANNEXED TERRITORY 160 TH STREET The Mayor declared the public hearing open at 8:52 PUBLIC HEARING - p.m.. All persons were given an opportunity YELLOW LINE to speak on the matter. No one wished to speak on the matter. The Mayor closed the Public hearing at 8:53 p.m. - Moved by Councilman Plan, seconded by Councilman Kulzer to pass the 3rd and final reading of the Ordinance #161 prohibiting vehicles crossing double yellow lines when parking a vehicle. Ayes, 6; Nayes, None. Moved by Councilman Werner, seconded by Councilman Kulzer to adopt Resolution No. 67-84 accepting and awarding the bid for the Ramsey/Tyler Street Construction to the apparent low bidder, Juran and Moody, Inc., for a Bond Sale price of $167,875.00 at a net interest cost of $108,821.67 at 8.9076%. This amendment would affect only corner lots platted after adoption of this ordinance. Ayes, 6; Nayes, None. This item was requested to be cancelled by the developer. The Council discussed a Capital Improvements program and directed the City Planner to discuss the capital improvements program with the Planning Commission and have the Planning Commission make a recommendation to the Council. It was also suggested that the City Council review the C.I.P. with the Council's Planning Committee. l to set a p.m. for returns. Moved by Councilman Plan, seconded by Councilman Klimek special Council meeting for September 12, 1984 at 7:00 the purpose of canvassing the 1984 Primary Election Ayes, 6; Nayes, None. Moved by Councilman Pike, seconded by Councilman Werner to set a public hearing for the October 1, 1984, regular City Council meeting, for the purpose of certifying unpaid accounts to the County Auditor. Ayes, 6; Nayes, None. Moved by Councilman Klimek, seconded by Councilman Pike to approve Staff developing a policy listing as many pieces of equipment the City feels might be used by private citizens and setting a fare rate of rental for these pieces of equipment and/or compensation for the people who would operate the equip- ment. After Council consideration and discussion the motion and 0 the second were withdrawn. City Staff was directed to use discretion upon the use of City equipment. . The Council discussed the use of City equipment and the disposition of Street Sweepings being used as fill for private individuals. The City Council directed the Staff to continue with the practice that has been used in the past, which would be discretionary for the disposition of the fill and would be distributed on a first come first service basis when it was feasible and economical for the City to do so. Moved by Councilman Werner, seconded by Councilman Karnick to authorize the City Staff necessary court proceedings and get do the repair work or to demolish Nayes, None. City 6; Moved by Councilman Pike, seconded by Councilman Klimek to set a public hearing for September 19, 1984 at 7:00 p.m. in the Council Chambers of the City Hall for the purpose of discussing disposition of 1985 Federal Revenue Sharing Funds. Ayes, 6; Nayes, None. Moved by Councilman Werner, seconded by Councilman Klimek to authorize the City Staff to get proposals for the repair and replacement of the windoes in the City Hall Council vi Chambers. The money would come from the debt service fund of the Federal Revenue Sharing Funds. Ayes, 6; Nayes, None. r--\ uJ Moved by Councilman Pike, seconded by Councilman Plan that the ice rental fees for the 1984-85 season be held at $70.00 per hour plus tax where applicable. The rental fee for hours beginning at 10:30 p.m. or later would be $60.00 per hour to $55.00 per hour. Ayes, 6; Nayes, none. Moved by Councilman Pike, seconded by Councilman Klimek to accept the 1983 Audit as prepared by the State Auditor's Office. Ayes, 6; nayes, None. ----- C\J (.Q (.Q o CD <t --- - September 4, 1984 175 Moved by Councilman Werner, seconded by Councilman Pike to amend the 49'rs Contract increasing the wage of Jim McGree from $10.10 per hour to that of the light equipment operator of $10.90 per hour, with the title of Parkkeeper/ Assistant Arena Manager. This would be retroactive to August 1, 1984. Staff is also authorized to negotiate with the Union on such matters as language for weekend work and overtime work. Ayes, 6; Nayes, None. AMEND 49'RS CONTRACT - JIM MCGREE Moved by Councilman Karnick, seconded by Councilman Werner that the City Council go through the punch list that was prepared from the walk-through of Ward 2 with the City Engineer, Councilman Kulzer and Councilman Nesbitt. The punch list is referenced in a letter dated August 16, 1984 to Mr. Steve Klein of Barr Engineering Company from the Hastings City Engineer. Ayes, 6; Nayes, None. The Mayor declared a three (3) minute recess. PUNCH LIST ENGINEER PUNCH LIST N.W. PONDING BASIN 1. Special M.H. NO. 1 - a safety concern - is the opening of the bars on the grate a problem for City liability (child proof). Moved by Councilman Werner, seconded by Councilman Kulzer to authorize the City to repair Item No. 1 with a galvanized walking grate and the City would pay for cost of such repair. 2. Erosion between M.H. No. 1 and 3rd Street needs to be corrected and reseeded. 3. Washing under enka mat needs correction and reseeding. Moved by Councilman Werner, seconded by Councilman Kulzer to correct items No. 2 and 3 at City Cost. Ayes, 6; Nayes, None. 4. Driveway at 504 West 3rd Street - approach to high and the car drags. Item has been corrected. 5. Place fill behind bituminous curb on northside of 3rd Street. Item has been corrected. 6. Jute netting - does it deteriorate or do we remove it to maintain slopes. This item will take care of itself. 7. Does the large catch basin need to be located at 320 West 4th Street or could smaller grate work. Moved by Councilman Werner, seconded by Councilman Kulzer to have the City change the grate at City cost and install an industrial grate, the land would need to be leveled out, this would not be a City cost. Ayes, 6; Nayes, None. 8. Sidewalk blocks for 320 West 4th Street both backyard and off of West 4th Street have not been placed yet. This item is finished. 9. Repair washing around catch basin with back yard of 315 West 4th Street. Also reconstruction swale so that water flows to catch basins. This item has been completed. 10. Address construction of Spring and 4th Street intersection. It appears that the west curb and gutter line of Spring Street is at a higher elevation than the center line or East curb and gutter line, causing the water to cover the whole street during a storm. Moved by Councilman Werner, seconded by Councilman Kulzer to order a grate and determine who pays for it at a later date. Ayes, 6; Nayes, none. 176 September 4, 1984 11. Possible reseeding necessary bare spots within Wilson Park. Moved by Councilman Kulzer, seconded by Councilman Werner to have City staff do the necessary work at this location. Ayes ,6; Nayes, None. 12. 200 West 6th Street - Driveway needs class five (5) so garage can be used. Moved by Councilman Klimek, seconded by Councilman Werner, to have the City pay for a 24 foot by 2 foot concrete driveway. Ayes~; Nayes, '~I None. 13. Sidewalk crack at 303 West 6th Street. L~ This item has been corrected. 14. Crushed curb at 300 West 6th Street due to heavy equipment. This item has been corrected. l5. Curb broken from gutter section at 321 West 6th Street. This item has been corrected. 16. Bituminous curb placed at alley between 5th and 6th Street on Ashland Street is at to sharp of an angle. Moved by Councilman Karnick, seconded by Councilman Werner to create a better bituminous radius of Ashland alley (west side) and to place a warning stake as to the location of the curb. Ayes, 6; Nayes, None. 17. Place bituminous apron on driveway to white garage between 5th and 6th Street on Ashland. Moved by Councilman Klimek, seconded by Councilman Werner to r-ll .....1.. construct a two foot wide 16 foot long asphalt apron. Ayes, 6; Nayes, None. .... 18. Address construction of intersection of 6th and Forest Streets. Moved by Councilman Klimek, seconded by Councilman Karnick to deny this request. Ayes, 5; Naye, Kulzer. 19. 419 West 6th Street - Owner wishes existing low profile catch basin replaced with flat casting to prevent children from stepping into it. Moved by Councilman Werner, seconded by Councilman Klimek to change the grate. Ayes, 6; Nayes, None. 20. 419 West 6th Street - Owner stated contractor was to pave low spot in driveway to direct water to 4th Street. Moved by Councilman Werner, seconded by Councilman Plan to take no action. Ayes, 5; Naye, Kulzer. 21. Seeding in ditch between Forest and Maple has not started. Moved by COuncilman Werner, seconded by Councilman Pike to repair the seeding problem. Ayes, 6; Nayes, None. 22. 632 West 7th Street - driveway needs additional grave. This item has been completed. 23. Pine and 7th Street ditch grate presents some problems as stated in Item No.1. City Staff will install some type of cyclone fencing. 24. Ellis property - Review off street parking for damage of retaining wall and additional gravel, if necessary, for drainage. Moved by Councilman Werner, seconded by Councilman Pike to restore the boulevard to its pre-project slope with a crushed rock surface suitable for parking. Specht property - 401 West 5th Street - look into vegetation for ground cover with little or no maintenance of this slope. Moved by Councilman Werner, seconded by Councilman Kulzer to put a feed mixture containing a combination of crown vetch and hairy vetch producing a dense cover with little maintenance. Moved by Councilman Werner, seconded by Councilman Kulzer to table the matter of the Bathrick Property, located at 40l West 3rd Street, until the September 17, 1984 regular City Council meeting. There was considerable Council discuss- ion and the motion and second were withdrawn. The Barr Engineering Firm and the City's Engineering Staff are to meet with Mr. Bathrick to try and resolve the issue. Moved by Councilman Werner, seconded by Councilman Kulzer to authorize the repair of the Street at 40l West 3rd Street where the cut-out is. Ayes, 5; Abstained, Karnick. The City Council directed Barr Engineering to make a report to the City Staff and the Council with regard to water problems in the basement of homes in the N.W. Ponding Basin area. Moved by Councilman Karnick, seconded by Councilman Wernr to pay Barbarossa and Sons for Partial Payment No. 5 ~ $32,295.20 and for Partial Payment No.6 - $24,118.61. Ayes, 5; Naye, Kulzer. Moved by Councilman Karnick, seconded by Councilman Werner to extend the contract for Barr Engineering and pay them in the amount of $14,454.04. Ayes, 5; Naye, Kulzer. Moved by Councilman Karnick, seconded by Councilman Werner to set a public hearing for the Northwest Ponding Basin and Storm Sewer Project for October 10, 1984 at 7:30 p.m. at the Hastings National Guard Armory, located on Highway 316. Moved by Councilman Werner, seconded by Councilman Kulzer to adopt Resolution No. 70-84 directing the Corps of Engineers to conduct a feasibility study regarding the protec- tion of shoreline of the Mississippi River, along Jaycee Park. PONDING BASIN RESOLUTION NO. 70-84 CORPS OF ENGINEERS TO CONDUCT A FEASIBILI- TY STUDY - JAYCEE PARK MN/DOT REQUEST FOR CITY LETTER - T.H. 55 CONSTRUCTION ALONG ROADSIDE PARK Moved by Councilman Karnick, seconded by Councilman COMPOST PROGRAM Pike to authorize the City to provide a site for initiating a compost program. The Site will be the old landfill site on Glendale Road. This would be a voluntary program whereby property owners would be responsible to drop off the material at the landfill site at which time a City Staff individual would be at the site. The City will not contract the services of Hastings Sanitary Disposal. Ayes, 6; Nayes, None. The Mayor appointed a committee to evaluate the Hastings Athletic Program and ascertain as to how they could realize a better return on their athletic facilities within the City. The Mayor appointed the following Members to the Committee: Councilman Werner, Marilyn Sheets, Dale Rogge, John Hopkins, and Don Louden. The City Council Administrative Committee set a meeting for September 27, 1984 at 6:30 p.m. in the Council Chambers of the City Hall to discuss the personnel policy and to interview the three (3) accounting firms that expressed an interest in doing the City's 1984 Audit. HASTINGS ATHLETIC PROGRAM SET ADMINISTRATIVE COMMITTEE MEETING 178 September 4, 1984 SAFETY COMMITTEE The Safety Committee of the Council set a meeting for September 18, 1984 at 7:00 p.m. at the Hastings Fire Station. CALENDAR OF EVENTS Councilman Werner requested at the end of every month that the Council be sent a copy of a calendar with all of the upcoming meetings listed on it. Moved by Councilman Klimek, seconded by Councilman Pike to 1) Pay all bills as audited; 2) Partial Payment - Keller Construction - 1984 Construction Program - $87,255.12; 3) Partial Sidewalk Reimbursement - St. Boniface Church, 523 Ramsey Street, $340.00; and 4) Final Payment - Les Jones Roofing - $6,720.00.
