February 21, 1984
The City Council of the City of Hastings, Minnesota met
in a regular meeting on Tuesday, February 21, 1984 at 7:30 p.m. in
the Council Chambers of the City Hall.

Members Present: Councilmen Karnick, Nesbitt, Pike, Plan,
Kulzer; Trautmann, Werner, and Mayor Stoffel.
Members Absent: Councilman Klimek.
The Mayor called for additions or corrections to the minutes
of the meeting of February 6, 1984 and hearing none declared the minutes
approved as presented.

Moved by Councilman Trautmann, seconded by Council-
man Pike to adopt Resolution No. 17-84 accepting and awarding
the bid for three (3) marked squad cars for the Police Depart-
ment to Hastings Ford Mercury and Company, the apparent low
bidder, for the amount of $29,226.87. Ayes, 7; Nayes, None.

Moved by Councilman Karnick, seconded by Councilman
Werner to pass the 3rd and final reading of ordinance amend-
ment #153 that the conversion of existing homes to three or
more units be permitted in the R-2 Zoning District, provided
that they meet all building code requirements and that two
off street parking stalls be provided per unit. This applies
to conversion of existing units, not new construction. Ayes,
7; Nayes, None.
Moved by Councilman Pike, seconded by Councilman
Plan to approve the minor subdivision with variances for
duplexes at 12th and Oak Streets - Don Olson. This would
include the watermain construction, Oak Street - 11th to
13th Street, with utility work to begin in 1984. The
estimated cost to install said watermain is $19,650.
Moved by Councilman Werner, seconded by Councilman
Trautmann to amend the main motion having Mr. Olson participate
at no less than 20% cost share for the assessed improvement.

Moved by Councilman Nesbitt, seconded by Councilman
Karnick to table the motion for the minor subdivision for
variance and duplexes for 12th and Oak Streets. City Staff
was directed to prepare an analysis of similar situations within
the City and submit a report to the City Council. Ayes, 6;
Naye, Werner.
Moved by Councilman Trautmann, seconded by Council-
man Werner to approve the Site Plan Review Procedure. This
would include all documents being submitted 10 days prior to
Planning Commission meeting. A copy of the Site Plan Review
Procedure is on file with the City Administrator/Clerk. Ayes,
7; Nayes, None.
Moved by Councilman Pike, seconded by Councilman
Plan adopting Resolution 18-84 authorizing a request to
the necessary authorities to amend the City's Comprehensive
Sewer Policy Plan. Ayes 7; Nayes, None. Copy of Resolution
on file.
The Mayor called a three minute recess for the
Council.

Nesbitt to remove from the table the matter of the minor
subdivision for variances and duplexes at 12th and Oak Streets,

The Council at this time voted on the main motion
from the previous action granting the minor subdivision for
variances and duplexes. Mr. Olson's property being assessed
no less than 20% of the cost and utility work beginning in
1984. Ayes, Werner, Nayes, 6.
Moved by Councilman Pike, seconded by Councilman
Kulzer to approve the minor subdivision for variances and
duplexes at 12th and Oak Streets. And the City Staff would
prepare a report on recommendations for the watermain assess-
ments for the City Council.
Councilman Pike and Councilman Kulzer agreed to amend L~._JI.:
their motion to approve the variances for duplexes only. Ayes, .
4; Naye, Karnick, Trautmann, and Werner. This motion was
defeated due to its requiring a 6/8 affirmative vote to pass.
The City Council requested that the City staff prepare
an analysis of similar situations that are not served or inad-
equately served with water and submit a report to the City
Council.
Moved by Councilman Trautmann, seconded by Councilman
Pike to pass the 2nd reading of the Ordinance Amending portions
of the City Code dealing with prohibited places of snowmobile
operation. The Council also set a public hearing for this
ordinance amendment for the March 5, 1984 regular City Council
meeting. Ayes, 7; Nayes, None.
Moved by Councilman Kulzer, seconded by Councilman
Trautmann to set a public hearing for the March 19, 1984
regular City Council meeting for the application for a CDBG.
Ayes, 7; Nayes, None.
Moved by Councilman Pike, seconded by Councilman
Nesbitt to appoint the following members for the Energy
Commission: Ayes, 7; Nayes, None.

Sewer Contract with Barr Engineering to be adjusted by $12,500
and that the Council authorize payment of fees and expenses
incurred thus far in the amount of $56,032.98. Ayes, 7; Nayes,
None.

liquor license for the City of Hastings that the AmericINN pay
all expenses incurred. Ayes, 7; Nayes, None.
The City Attorney was directed to draft proposed
wording on a referendum to increase the liquor licenses issued
by the City of Hastings by one (1).

Kulzer to have an apparaisal done on the Regan Bus Line Prop-
erty located at llth and Pine Streets. The Council would be
requesting an appraisal for the bus garage and an appraisal for

Moved by Councilman Pike, seconded by Councilman
Plan to approve the renewal of the American Legion Club and
the V.F.W. Club annual gambling licenses for 1984. Ayes, 6;
Naye, Nesbitt.
Moved by Councilman Kulzer, seconded by Councilman
Trautmann to adopt Resolution No. 19-84 accepting and awarding
the bid for the demolition of the building and extermination
of the rodents at the Freiermuth Liquor Store building, 416
Vermillion Street, to the apparent low bidder, David Spendler
Construction. Copy of Resolution on file. Ayes, 7; Nayes,
None.

Kulzer to adopt Resolution No. 20-84 setting a public hearing
for the March 5, 1984 regular City Council meeting - 1984
Municipal Street/Utility Improvements. Ayes, 7; Nayes,
None.
Moved by Councilman Pike, seconded by Councilman
Trautmann that the Acting City Engineer send a letter to
Dave Tanner regarding the location of the proposed north
Frontage Road extension as it relates to its property along
Westview Drive. The letter states that the City Council
has expressed an interest in locating the proposed roadway
just north of the Tanner property, in the general area of
an existing drainage swale, easterly along the south slope
of the Northwest Ponding Basin to State Street and thereby
connected to the T.H. 55. Ayes,S; Nayes, Nesbitt and
Kulzer.
There was Council discussion and it was determined
that there will be a meeting at 8:30 p.m. on February 27, 1984
after the Planning Commission meeting to discuss the Pine-
River-Prairie Corridor Study.
