The City Council of the City of Hastings, Minnesota met ~n
a regular meeting on Monday, November 21, 1983 at 7:30 p.m. in the
Council Chambers of the City Hall.
Members Present: Councilmen Nesbitt, Klimek, Pike, Plan,
Kulzer, Trautmann, Werner, and Mayor Stoffel.

The Mayor called for additions or corrections to the minutes
of the meeting of November 7, 1983 and hearing none declared the minutes
approved as presented.
The public hearing was opened by the Mayor at 7:34 PUBLIC HEARING -
p.m. to hear and pass on all objections, written or oral 1983 STREET IMPROVE-
comments, if any, to the proposed assessments on the 1983 MENT ASSESSMENTS
~ Street Improvements. The legal notices of the hearing and
the certified list of mailing were introduced into the record
m by the City Administrator/Clerk. The hearing had been properly
0 called. Allan Larson, Acting City Engineer, explained the
m project as to cost of assessments per lot. The Mayor asked
m if anyone wished to speak on the issue. No one wished to
<t speak on the issue. The Mayor closed the public hearing at
7:47 p.m.
Councilman Nesbitt introduced the following RESOLUTION NO. 82-83
resulution and moved its adoption. ADOPT 1983 STREET
IMPROVEMENT ASSESSMENTS
WHEREAS, pursuant to proper notice duly given as
required by law, the Council has met and heard and passed

NOW, THEREFORE BE IT ROSOLVED BY the City Council of the
City of Hastings, Minnesota:
1. Such proposed assessments, a copy of which is attached hereto
is hereby accepted and shall constitute the special assessments
against the lands therein, and each tract of land therein included
--- is hereby found to be benefitted by the proposed improvement in the
amount of the assessment levied against it.
2. Such assessment shall be made payable in equal installments extending
over a period of ten years. The first of the installments to be
payable on or before the first Monday of January, 1984. Any deferred
installments shall bear thirteen percent (13%) interest which is the
maximum allowable by State Statutes per annum. To the first install-
ments shall be added interest on the entire assessment, from the date
of this assessment resolution until December 31, 1984. To each sub-
sequent installment when due shall be added interest for one year on
C\.I all unpaid installments.
to 3. The owner of any property so assessed may, for thirty days after
c..o notification from the City Treasurer, pay to the City Treasurer,
0 the whole of the assessment without interest, and he may at anytime,
CD prior to certification of the assessment to the County Auditor, as
<( hereby provided, pay the whole of the assessment against any parcel
with interest accrued to the date of payment to the City Treasurer,
and he may at any time thereafter pay the County Treasurer, and he
may at any time thereafter pay the County Treasurer the entire amount
of the assessment remaining unpaid.
4. The City Clerk shall forthwith transmit a certified duplicate of this
assessment to the County Auditor to be extended on the proper tax list
- of the County and such assessments shall be collected and paid over in
the same manner as other municipal taxes.
Adopted by the City Council of the City of Hastings, Minnesota
this 17th day of November, 1983.
Councilman Werner seconded the motion to adopt said resolution

The Mayor opened the public hearing at 7:48 p.m. PUBLIC HEARING -
for the rezoning of County Road 42 and Pleasant Drive. REZONING OF COUNTY ROAD
Everyone wishing to speak on the issue was given the opportun- 42 AND PLEASANT DRIVE
ity to do so. Mr. Gabiou explained that an agreement had been
reached with regard to the development contract. The Mayor
closed the public hearing at 7:50 p.m.

Moved by Councilman Nesbitt, seconded by Councilman 2ND READING - REZONING
Kulzer to pass the 2nd Reading of the ordinance amendment for OF COUNTY ROAD 42 AND
the rezoning from A and PI to R-3, land at the southwest PLEASANT DRIVE
corner of the intersection of County Road 42 and Pleasant
Drive. This is subject to agreement and signature on the
development contract by all parties involved with the exception
that the Mayor shall sign for the City representing the City
Council. Also on page three of the development contract the
wording would read as follows: 'That other than the use
restrictions contained in this contract, the property may be
deve1oped:into only single family, duplex, three p1ex or four
plex lots, subject always, however, to applicable City density
requirements. , A copy of the development contract will be on

BOULEVARD AND MILLARD Werner to approve a grading permit - Spiral Boulevard and
AVENUE - JOHN DWYER Millard Avenue - John Dwyer. The $1,000 bond requirement will
be widved. The City is in receipt of a letter from Mr. Dwyer
stating all grading will be done in conformity to the grading

POTENTIAL REZONING Moved by Councilman Trautmann, seconded by Councilman
OF R-2 AREAS TO R-l Werner to accept the Planning Commission's Committee report
recommending that no R-2 areas be rezoned to R-1. Reference
the memo dated November 16, 1983 to the Mayor and Council
Members from the Planning Commission Committee. Ayes, 6;

IRS TAX ASSISTANCE Moved by Councilman Nesbitt, seconded by Councilman
l'ROGRAM Kulzer that the City of Hastings accept the IRS offering of
tax assistance primarily for the elderly and low income. This
assistance would be coordinated through the Outreach Program.

1983 and all of 1984. This position, as are all positions,

man Pike that the City of Hastings advertise and get bids AND PRIVATE SIDEWALKS
on a per square foot per inch basis of removing snow from
any sidewalk. The City would then have a listing of
individual contractors to call in the event that snow needs
to be removed from either City sidewalks or private sidewalks.
Snow removal would be enforced as per the existing ordinance.
The entire cost of the inspection; issuing of notices, and
the actual cost of snow removal would be billed to the
property owners. If the bill were not paid, a hearing would
be conducted and the bill certified for assessment.

INDUSTRIAL PARK LAND The City Administrator gave the Council a brief update
on the tentative sale of some land in the Industrial Park. This
is an informational item that will be going before the Industrial
Park Advisory Committee for a recommendation to the City Council.

:OUNCIL DISCUSSION There was discussion about the Northwest Ponding
Basin and Trunk Storm Sewer Project. It was noted by
Councilman Nesbitt that there will be a 2nd Ward meeting
held at the Senior High School, Industrial Arts Office on
December 13, 1983 for 2nd Ward Residents information.
Councilman Trautmann brought up the matter of the
barricade for West 4th Street. There was some discussion
with regard to the type of barricade to be installed. Staff
will come back to the City Council with a recommendation on n
this matter.
Councilman Nesbitt requested the Police Department to
review and submit a recommendation to Council for the inter-
section of 8th and Vermillion Streets with regard to the Sunday
morning church services generating extra traffic at this inter-
section. Councilman Nesbitt also requested the City Staff to
review the replacement of the guard posts at Lake Rebecca.
