HomeMy WebLinkAbout10-03-83 49 Hastings, Minnesota October 3, 1983 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, October 3, 1983 at 7:30 p.m. in the Council Chambers of the City Hall. Members Present: Councilmen Karnick, Nesbitt, Klimek, Pike, ,--. Plan, Kulzer, Trautmann, Werner, and Mayor Stoffel. Members Absent: None. The Mayor called for additions or corrections to the minutes of the meeting of September 19, 1983 and hearing none declared the minutes approved as presented. The Mayor declared the public hearing for the Towers PUBLIC HEARING - TOWERS C\J regulations open at 7:31 p.m. The City Administrator provided proof of affidavit of publication. No one wished to speak on (D the issue. The Mayor closed the public hearing at 7:33 p.m. CO 0 Moved by Councilman Trautmann, seconded by Council- 3RD READING - ORDINANCE CD man Kulzer to pass the 3rd and final reading of the ordinance 11144 - TOWERS amendment #144 for towers. The ordinance would exempt personal <t television and radio antennas on top of residential structures. Ayes, 8; Nayes, None. The Mayor declared the public hearing for the zoning PUBLIC HEARING - ordinance amendment adding gasoline dispensing as a permitted GASOLINE DISPENSING use in a C-5 Zone open at 7:34 p.m. The City Administrator IN C-5 ZONE provided proof of affidavit of publication. The Mayor closed the public hearing at 7:36 p.m. Moved by Councilman Pike, seconded by Councilman 3RD READING - ORDINANCE Plan to pass the 3rd and final reading of the ordinance amend- #145 - GASOLINE DISPEN- ment 11145 adding gasoline dispensing without auto repair as SING IN C-5 ZONE a permitted use in the C-5 Zoning District. Ayes, 8; Nayes, None. The Mayor declared the public hearing for the rezon- PUBLIC HEARING - ing on County Road 42 and Pleasant Drive open at 7:38 p.m. REZONING ON COUNTY ROAD The City Administrator provided proof of affidavit of pub- 42 AND PLEASANT DRIVE 1ication. Everyone wishing to speak on the issue was given the opportunity to do so. Mr. Jack Christianson, Mr. Pat Farrell, Mrs. Voelker, Mr. Gabiou, and Mrs. Avent all spoke on the issue. Moved by Councilman Trautmann, seconded by Councilman Werner to pass the 1st Reading of the rezoning of County Road 42 and Pleasant Drive to an R-3 Zoning District. The agreement reached between the developers and the property owners would become part of the reading. This would also be subject to sub- mission of a Planned Residential Development Plan and Development Contract. ,--. Moved by Councilman Nesbitt, seconded by Councilman Pike to amend the main motion to include the requirement of a row of single family dwellings on the West side of the pro~erty. Ayes, 7. Nayes, Karnick. , The vote on the main motion was then taken. Ayes, 8; Nayes, None. The Hearing was continued until a P.R.D. contract was established for the entire 42 acres. 50 October 3, 1983 PUBLIC HEARING - The Mayor declared the public hearing open at 8:16 p.m. REZONING ALONG LOCK The City Administrator provided proof of affidavit of publication. AND DAM ROAD Everyone desiring to speak on the issue was given the opportunity to do so. Mr. Erickson, Mr. Wattson, and Mr. Nelson addressed the matter. The Mayor closed the public hearing at 8:35 p.m. Moved by Councilman Trautmann, seconded by Councilman Kulzer to accept the Planning Commissions recommendation, and deny n the proposed rezoning from R-2 to R-3 of and on the Lock and Dam Road, North of 2nd Stree~ by Mr. Gayle Erickson, on the basis that it would constitute the unwarranted spot zoning. Ayes, 5; Nayes, '--~' Pike, Plan, and Werner. Motion to deny passes. PUBLIC HEARING - The City Administrator explained that the firm requesting IRB ELECTRO FAB the public hearing no longer required it to be held, due to negoti- atations not being reached. PUBLIC HEARING - The Mayor opened the public hearing at 8:59 p.m. The City FEDERAL REVENUE SHARING Administrator provided proof of aff1davit of publication. Everyone AND 1984 CITY BUDGET wishing to speak on the issue was given the opportunity to do so, and no one desired to speak. The Mayor closed the public hearing at 9:01 p.m. RESOLUTION NO. 61-83 Councilman Werner introduced the following resolution ADOPT 1984 BUDGET and moved its adoption: RESOLUTION SETTING THE SUM TO BE LEVIED UPON TAXABLE PROPERTY WITHIN THE LIMITS OF THE CITY OF HASTINGS, MINNESOTA WHEREAS, the City Council has calculated the expenses of n the City of Hastings, Dakota and Washington Counties, Minnesota for the calendar year 1984 to be set at $3,159,424 and; WHEREAS, the City Council has adopted the following budget: The Federal Revenue Sharing Budget is as follows: l. Adopted by the City Council of the City of Hastings, Minnesota this 3rd day of October, 1983. Councilman Klimek seconded the motion to adopt said Resolution and the same was passed by the following vote: Ayes, 8; Nayes, None. A complete itemized copy of the 1984 budget is on file in the office of the City Administrator/Clerk. Moved by Councilman Trautmann, seconded by Counci1- 2ND READING - ORDINANCE man Karnick to pass the 2nd Reading of the ordinance amendment AMENDMENT - TWO FAMILY .....- for two family dwellings in the R-2 District. The amendment DWELLINGS IN THE would be based upon the recommendation of the Joint Committee R-2 DISTRICT and the Planning Commission as stated in the September 1, 1983 memo from the City Planner, with 1,600 square feet as the standard in item 116. Also that where an existing structure is to be razed and replaced with a new construction two family dwelling that the conversion standards for setbacks and lot widths apply to the new structure. Moved by Councilman Nesbitt, seconded by Councilman Kulzer to amend the main motion to delete the provision in the ordinance amendment that where an existing structure is to be razed and replaced with a new construction two family dwelling that the conversion standards for setbacks and lot width apply to the strqcture. Motion to pass 2nd Reading passes. 54 October 3, 1983 ~PPEAL OF ADMINI- Moved by Councilman Werner, seconded by Councilman ISTRATIVE DECISION Nesbitt to overrule the City Planner's interpretation of the intent of the ordinance pertaining to professional offices in the R-3 District. This motion would allow an insurance office to be located at 1226 Eddy Street. Ayes, 8; Nayes, None. RESOLUTION NO. 64-83 Moved by Councilman Trautmann, seconded by Councilman n APPROVAL OF WATERSHED Werner to adopt Resolution No. 64-83 approving of the Mississippi BOUNDARIES and Vermillion River Watershed Boundaries as defined" in, the 1980 Hastings Comprehensive Drainage Plan, for management purposes.
