HomeMy WebLinkAbout09-06-83 39 Hastings, Minnesota September 6, 1983 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, September 6, 1983 at 7:30 p.m. in the Council Chambers of the City Hall. -- Members Present: Councilmen Karnick, Nesbitt, Klimek, Pike, Plan, Kulzer, Trautmann, Werner, and Mayor Stoffel. Members Absent: None. The Mayor called for additions or corrections to the minutes of the meeting of the regular meeting of August 15, 1983 and the special meeting of August 29, 1983 and hearing none declared the minutes approved as presented. C\J The Mayor declared the public hearing for the PUBLIC HEARING - (.D vacation of the school street open at 7:32 p.m. The City VACATION OF CD Planner provided proof of the affidavit of publication. SCHOOL STREET 0 Everyone wishing to speak on the issue was given the (D opportunity to do so. The Mayor closed the public hearing <t at 7:44 p.m. Moved by Councilman Werner, seconded by Councilman RESOLUTION NO. 56-83 Kulzer to adopt Resolution No. 56-83 approving the vacation of School Street subject to the retention of an easement for existing utilities. Ayes, 8; Nayes, None. Copy of Resol- ution on file. -- The Mayor declared the public hearing for the PUBLIC HEARING - vacation of 26th Street between Highway 316 and 61 open at VACATION OF 26TH ST. 7:45 p.m. The City Planner provided proof of affidavit of BETWEEN HWY 316 & 61 publication. Everyone desiring to speak on the issue was given the opportunity to do so. The Mayor closed the public hearing at 7:47 p.m. Moved by Councilman Kulzer, seconded by Councilman RESOLUTION NO. 57-83 Pike to adopt Resolution No. 57-83 approving the vacation of 26th Street between Highway 316 and 61. Moved by Councilman Kulzer, seconded by Councilman Klimek to set the public hearing for the ordinance amendment regarding towers criteria for the October 3, 1983 regular City Council meeting at 7:30 p.m. Ayes, 8; Nayes, None. Moved by Councilman Trautmann, seconded by Counci1- 2ND READING - man Nesbitt to pass the 2nd reading of the ordinance amend- ORDINANCE AMENDMENT - ment allowing communication towers as a permitted use in COMMUNICATION TOWER -- the PI Zone. Ayes, 8; Nayes, None. IN PI ZONE Moved by Councilman Pike, seconded by Councilman FINAL PLAT - BIRCHWOOD Werner to approve the final plat of Birchwood .Town. Homes - 5TH AND ASH STREETS 5th and Ash Streets - A1 Sieben. Ayes, 8; Nayes, None. Moved by Councilman Werner, seconded by Councilman PRELIMINARY PLAT - Klimek to approve a variance from the required 5 acres to VARIANCE - PRD PERMIT. 4.574 acres. Ayes, 8; Nayes, None. WHISPERING MEADOW - Moved by Councilman Plan, seconded by Councilman MIKE WILLIAMS Klimek to approve the PRD permit subject to the items noted in the City Planner's memo dated August 19, 1983. ORDINANCE AMENDMENT Moved by Councilman Trautmann, seconded by Councilman REQUEST - DENNIS Pike to pass the 1st Reading of the Ordinance Amendment adding [ MCNAMARA - GASOLINE gasoline dispensing without auto repair, as a permitted use in DISPENSING - C-5 the C-5 Zoning District. Ayes, 8; Nayes, None. Moved by Councilman Trautmann, seconded by Councilman Werner to set a public hearing for the ordinance amendment adding gasoline dispensing as a permitted use in the C-S Zoning District for the October 3, 1983 regular City Council meeting at 7:30 p.m. Ayes, 8; Nayes, None. SET PUBLIC HEARING - Moved by Councilman Pike, seconded by Councilman REZONING ALONG LOCK Klimek to set a public hearing for the October 3, 1983 regular AND DAM ROAD - City Council meeting for the reconsideration of rezoning from GAYLE ERICKSON R-2 to R-3 along the Lock and Dam Road for a 12 unit Condominium - Gayle Erickson. Ayes, 5; Nayes, Nesbitt, Kulzer, and Trautmann. Motion passes. ORDINANCE AMENDMENT - TWO FAMILY DWELLINGS IN THE R-2 DISTRICT Moved by Councilman Trautmann, seconded by Councilman Werner, to pass the 1st Reading of the Ordinance Amendment on Two Family Dwellings in the R-2 District. The public hearing is set for the September 19, 1983 regular City Council meeting at 7:30 p.m. Ayes, 7; Naye, Pike. SET PUBLIC HEARING - Moved by Councilman Trautmann, seconded by Councilman [ INDUSTRIAL REVENUE Kulzer to set a public hearing for the October 3, 1983 regular BONDS - ELECTRO FAB City Council meeting for the consideration of approximately $2,200,000 bond issue for the acquisition of assets of Electro Fab Incorporated acquiring real estate and building and acquiring new equipment. Ayes, 8; Nayes, None. DISCUSSION OF NORTH Mr. Burns, City Planner, reported on the changes for FRONTAGE ROAD the North frontage Road. VERMILLION RIVER The Council requested that Paul Burns, City Planner, WATERSHED MEETINGS be the representative for the City to attend the Vermillion River Watershed meetings. STREET BANNERS - Moved by Councilman Pike, seconded by Councilman ANSON BROTHERS Werner to approve the request from Anson Brothers Grain Elevator allowing banners to be placed across 2nd and Tyler Street on September 7th and 8th, 1983. This would be subject to the City Engineer and the City Planner's approval. Ayes, 8" Nayes, None. , ARENA PARKING LOT Moved by Councilman Karnick, seconded by Councilman Klimek to authorize the purchase of 915 tons of Class 5 aggregate to be placed on the proposed arena parking lot. The City Staff would do the excavation work and the Council is requesting a [ report on the fire lane. Ayes, 8; Nayes, None. BOAT RAMP PROPOSAL Moved by Councilman Trautmann, seconded by Councilman Klimek to deny the expending of extra monies for the placement of additional sheet piling. Ayes,7; Naye, Kulzer. REAL ESTATE ABATEMENT Moved by Councilman Werner, seconded by Councilman Trautmann to approve the following real estate abatements: James Ollig 19-83600-020-01, the assessed value should be reduced to $18,567.00 David E. Her first term would expire 12-31-85. Ayes, 8; Nayes, None. -- Moved by Councilman Trautmann, seconded by Counci1- APPROVAL - man Werner to approve the following list of proposals for the NRRC BUDGET 1983 NRRC Budget. 1. $3,000 - completion of irrigation system at Veterans Park Softball/Baseball Complex as part of an $18,000 project. 2. $ 500 - Hastings Youth Athletic Association for construction of a storage shed at Veterans Park. 3. $10,000 - Hastings Hockey Boosters for constructing a warming House behind the Civic Arena. 4. $6,000 - Bleachers for the Veterans Park Baseball/Complex. Moved by Councilman Trautmann, seconded by Counci1- APPOINTMENT OF man Nesbitt to approve the appointment of the City Administrat- HRA ADVISOR or as an advisor for the HRA on a yearly basis or until a main street project manager is hired. The Council will be contacting people and this item APPOINTMENT OF CITIZEN will be brought back for a Committee selection at the September ADVISORY COMMITTEE 19, 1983 City Council meeting. FOR CABLE TV The Commission Members with expired terms will all RECOMMEND CHARTER be contacted for interest in Charter Commission Membership. COMMISSION MEMBERS The Council will also be contacting people from their Wards for interest on this Commission. Moved by Councilman Kulzer, seconded by Councilman BUG ZAPPER ORDINANCE Nesbitt to pass the 1st Reading of an ordinance regulating the use of Insect Electrocuting Systems. It would be unlawful for any person to operate between the hours of 10:30 p.m. and 8:00 a.m. of the following day an insect electrocuting system /"""""""" or device which emits a sound that is audible on property other than that of the operator. Every person who violates this section shall be guilty of a petty misdemeanor punishable by a fine up to $100. Ayes, 2" Nayes, Karnick, Klimek, Pike, , Plan, Trautmann, and Werner. Ayes, 8; Nayes, None. 42 September 6, 1983 LINDEMAN HOUSE - Moved by Councilman Werner, seconded by Councilman EAST 4TH STREET Pike to have the abatement order on the Mryt1e Lindeman estate 1512 East 4th Street removed and accept the intent of the Kiwanis Club to undertake. restoration and eventually donate it to one of the Historical Societies. CITY BUILDING Moved by Councilman Werner, seconded by Councilman '---'- I ROOF REPAIRS Klimek to table the repair of the City Buildings roofs until after the budget process has taken place. DOWNTOWN It was discussed by the City Council and the City PARKING LOT Staff that alternatives on funding available to improve the lighting system in the downtown parking lot would be reviewed and presented to the Council at the upcoming budget meeting. Councilman Werner left the meeting at 10:45 p.m. REQUEST FOR Moved by Councilman Trautmann, seconded by Councilman FILL - AL SIEBEN Karnick to approve the request from A1 Sieben Construction for fill at Birchwood Townhouse Project - 5th and Ash Streets. The City Engineer would monitor this fill to be received from the excess during the construction of the ponding basin. The City Engineer is to work out the details of a fair price per yard for leasing the fill which will be placed in the Street lighting City Fund. Agreement shall include: l. City to contact A1 Sieben by June 1, 198~ if City needs material returned. 2. A1 Sieben has until September 1, 1984 to return material. Ayes, 7; Nayes, None. [] UPDATE ON NININGER Mr. Richard Dobrick presented a brief report on the ROAD PROJECT Nininger Project. LETTER FROM The Chamber of Commerce submitted a letter to the CHAMBER OF COMMERCE Mayor and Members of the City Council and asked for this to become an official part of the record. The letter reads as follows: Dear Mayor Stoffel and CounciL Membe:rs : The Hastings Area Chamber of Commerce would like to express its support for the City's recent and current annexation efforts. City Officials are demonstrating commendable vision and foresite in their initiation of orderly annexation. Although it is often a rather difficult undertaking, it is wise to take these steps now, in the interest of growth in the future. If you feel we can be of assistance in these efforts, please call on us. For the Hastings Area Chamber of Commerce, Franz R. Altpeter, President. SET PUBLIC HEARING FOR Moved by Councilman Trautmann, seconded by Councilman REZONING - COUNTY ROAD Karrtick to set a public hearing for the rezoning from A and PI 42 AND PLEASANT DRIVE to R-3 of parcels of land located between County Road 42 and Pleasant Drive for the October 3, 1983 regular City Council meeting at 7:30 p.m. Ayes, 4; Nayes, Pike, Nesbitt, and Kulzer.
