The City Council of the City of Hastings, Minnesota met
in a regular meeting on Monday, August 1, 1983 at 7:30 p.m. in the
Council Chambers of the City Hall.
Members Present: Councilmen Karnick, Nesbitt, Klimek, Pike,
,.-. Plan, Trautmann, Werner, and Mayor Stoffel.
Members Absent: Cuncilman Kulzer.
The Mayor called for additions or corrections to the minutes
of the regular meeting of Monday, July 18, 1983 and hearing none declared
the minutes approved as presented.
The Public Hearing was opened by the Mayor at 7:31 PUBLIC HEARING -
p.m. to review the zoning ordinance amendment adding the County ZONING ORDINANCE
Jail as a permitted use in the PI Zoning District. Everyone wish- AMENDMENT - ADDING

The vote on the main motion requiring the 200 foot set-
back from property lines was then taken. Ayes 0; Nayes, 7.
Moved by Councilman Trautmann that the tower shall be
considered an ancillary use for the County providing that the
County shall retain ownership and the setbacks shall be deter-
mined by both County and City Staff. Motion dies for lack of
second.
Moved by Councilman Werner, seconded by Councilman
Karnick to amend the Ordinance Section 10.21, Subdivision 2;
and Section E - that towers are a permitted use, provided that
the setback is equal to or greater than the height of the tower
and that ownership is retained by the governing body. Ayes, 7;

Moved by Councilman Werner, seconded by Councilman
Nesbitt to set a Public Hearing for the August 15, 1983 regular
City Council meeting at 7:30 p.m. regarding the ordinance amend-
ment Section 10.21, Subdivision 2. Ayes, 7. Nayes, None.

Moved by Councilman Trautmann to deny the request for REQUEST FOR RE-
rezoning of the Lock and Dam Road North of 2nd Street based upon ZONING OF LOCK

Pike to pass the 1st Reading of the rezoning of the Lock
and Dam Road North of 2nd Street to an R-3 Zoning District
and to set the public hearing for the September 6, 1983
regular City Council meeting. Ayes,S; Naye, Trautmann;
Abstained, Nesbitt. Motion fails as a 2/3rd's vote is re-
quired for all rezonings (6 affirmative votes).
VERMILLION FALLS PHASE Moved by Councilman Pike, seconded by Councilman n
2 LAWCON AND LCMR GRANT Werner authorizing the City Staff to submit a grant application
APPLICATION for a project costing $100,100 for the development of a
parking lot, picnic shelter, and lighting for the pathway

SET PUBLIC HEARING - Moved by Councilman Pike, seconded by Councilman
VACATION OF 26TH ST. Werner to set a public hearing for the September 6, 1983
BETWEEN 316 and HWY 6l regular City Council meeting to consider vacating the Street
right-of-way between Trunk Highway 6l and 316 adjacent to
the former Webber Ford site. Ayes, 7; Nayes, None.
AUTHORIZATION OF CITY Moved by Councilman Klimek, seconded by Councilman
STAFF TO APPROVE Plan to authorize the City Staff to approve certain changes
CHANGES FOR PRD SITE to site plans for four-plexes in the Schumacher 2nd Addition I

DONATION - AMERICAN Moved by Councilman Klimek, seconded by Councilman 0 I
PLANNING ASSOCIATION Plan for the City of Hastings to donate $100 to the Minnesota
Chapter of the American Planning Association. This money will I
be coming out of the City Planner's 1983 annual budget. Ayes,
7; Nayes, None.
SELECTION OF AN Moved by Councilman Pike, seconded by Councilman Plan
AUDITOR FOR 1983 to have the Administrative Committee of the Council make a
determination on the selection of an auditor for the 1983 audit.

2ND READING - ADOP- Moved by Councilman Klimek, seconded by Councilman
TION OF MINNESOTA Pike to pass the 2nd Reading of the ordinance amendment -
UNIFORM FIRE CODE adoption of Minnesota Uniform Fire Code. Motion and second were
withdrawn.
Moved by Councilman Trautmann, seconded by Councilman
Pike to pass the 2nd Reading of the ordinance amendment - adoption
of Minnesota Uniform Fire Code, with the deletion of Section 7,
in the City Code, restricting the locations which a barbecue may
be used. Ayes, 7; Nayes, None.
DEDICATION - SOFTBALL/ Moved by Councilman Pike, seconded by Councilman Klimek
BASEBALL COMPLEX to set the dedication date for the Softball/Baseball Complex for

POLICE SQUAD CARS Moved by Councilman Plan, seconded by Councilman Klimek
to authorize the purchase of two unmarked squad cars for the Police J
Department from O'Brien Chevrolet. The price on these two vehicles
is $12,800 with a 30 day 50/50 mechanical warranty. Ayes, 7;
Nayes, None.
!.'ARTIAL PAYMENT - Moved by Councilman Trautmann, seconded by Councilman
\USTIN P. KELLER - Klimek to approve the partial payment for Austin P. Keller in the
1983 CONSTRUCTION amount of $49,988.33. Ayes, 7; Nayes, None.

A petition from Gordon and Rose Meier and Pee Wee PETITION - WEST
and Fran Reinardy was received for the surfacing of West 25th 25TH STREET
Street. The City Engineer explained that the petition had
insufficient number of signatures. He also indicated that he
would prepare for the individuals a legal petition for circula-
tion to be received before October 1, 1983 in order that im-
provements be made in 1984.
Moved by Councilman Nesbitt to eliminate the use of BUG ZAPPERS
bug zappers past the hour of 10:30 p.m. unless the individual
- property owner is using the device. Motion dies for lack of
second.
Moved by Councilman Trautmann, seconded by Councilman
Pike to direct City Staff to draw up a draft ordinance on possible
regulation of bug zappers. Ayes, 7; Nayes, None.
