The City Council of the City of Hastings, Minnesota met in a regular
rooeting on Monday, December 1, 1980 at 7: 30 p.m. in the Council Chambers of
the City Hall.
Members present: Trautmann, Trutna, Kulzer, Stoffel, Karnick, Collins,
Legler, and Mayor Petersen.
Members absent:
Shannon.
The Mayor called for additions or corrections to the minutes of the
rooeting of Novanber 17, 1980 and hearing none declared the minutes approved as
read.
The Mayor opened the public hearing to hear and pass
on all objections, written or oral, if any, to the proposed
assessments on the 1980 Improvements, at 7:32 p.m. The legal
notices of the hearing and the certified list of mailing were
introduced into the record by the Administrator. The hearing
had been properly called. Len Olson, City Engineer, explained
each project as to total cost and assessment per lot. There
were no objections voiced. The Mayor closed the hearing at
7:40 p.m.

resolution and moved its adoption:

AOOPT ASSESSMENTS FOR
1980 IMPROVEMENTS
WHEREAS, plrSuant to proper notice duly given as
required by law, the Council has met and heard and passed upon
all objections to the proposed assesenents for the improvement
of the following:
Blueberry Lane, 14 th Street & Rosenary Court, wi thin
Dakota Hills 5th Addition
Grading, Bituminous Surfacing, Curb & Gutter.
Tierney Court, Tierney Drive to 420' South
Grading, Bituminous Surface, Curb & Gutter, Sanitary
Sewer, Watermain.
18th Court - Pleasant Drive to 400' West
Street Grading, Sanitary Sewer, Watermain, Storm Sewer.
Bri ttany Road - 17th Street to Pleasant Drive
Grading, Bituminous Surface, Curb and Gutter.
Whispering Lane - Pleasant Drive to 370' West
Grading, Bituminous Surface, Curb and Gutter
NOV, THEREFORE BE IT RESOLVED by the City Council of the City
of Hastings, Minnesota:
1. Such proposed assessments, a copy of which is attached
hereto and made a part hereof is hereby accepted and shall
consti tute the special assessments against the lands therein,
and each tract of land therein included is hereby found to
be benefited by the proposed improvement in the amount of
the assessment levied against it.
2. Such assessment shall be payable in equal installments
extending over a period of 10 years, the first of the
installroonts to be payable on or before the first Monday of
January, 1982. Any deferred installments shall bear interest
at the rate of eight percent (8%) per annum. To the first
installments shall be added interest on the entire assessment,
fran the date of this assesenent resolution until December 31,
1982. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.

3. The owner of any property so assessed may, for 30 days after
notification fran the City Treasurer, pay to the City Treasurer,
the whole of the assessment without interest, and he may at any
time, prior to certification of the assessment to the County
Audi tor, as herein provided, pay the whole of the assessment
against any parcel with interest accrued to the date of payment
to the City Treasurer, and he may at any time thereafter pay the
County Treasurer the entire anx:>unt of the assessment rEmaining
unpaid.

4 The City Clerk shall forthwith transmit a certified duplicate
of this assessment to the Councy Auditor to be extended on the
proper tax lists of the County and such assessment shall be
collected and paid over in the same manner as other municipal taxes.

the Zoning Ordinance to rezone the South side of West 12th St.
West of Pleasant Drive, from an R-l to an R-3 Classification for

Legler to pass the third and final reading of the amendment to
the Zoning Ordinance to rezone the Spiral Ball Park property
to a G-2 zoning classification for an automotive dealership.

Stoffel to hold over the sign size variance request of Westview
Village Apartments until the Planning Coomission can make a
recoomendation on an ordinance amendment permitting larger signs
for such uses. Ayes, 7; Nayes, Trautmann.
Moved by Councilman Legler, seconded by Councilman
Trutna to approve the minor subdivision on Pine Street for'
Tam Smith, with the stipulation that the remainder of Lot 3 be
included in the survey, and that the City receive written
approval of the lot line changes by all affected property

Moved by Councilman Legler, seconded by Councilman
Shannon to approve the Preliminary Plat and Developnent Contract
for River's Edge Development, conditioned upon the i tans listed
