Hastings, Minnesota August 4, 1980 279 '!he City Council of the City of Hastings, Minnesota convened in a regular Ireeting on Monday, August 4, 1980 at 7: 15 P.M. in the Council Chanbers of the City Hall. Due to the substantial number of people present for the Public Hearing on the Adoption of Assessments for the Southwest Ponding Basin Project, Counci1man Stoffel IIDVed, seconded by CounciJ.man Kulzer to reconvene at the Hastings National Guard Armory, Hwy. #316, Hastings, MN. Ayes, 8; Nayes, none. Marbers present: CounciJmen Trautmann, Trutna, Kulzer, Stoffel, Shannon, Karnick, Collins, Legler, and Mayor Petersen. .. Merri>ers absent: None. The Mayor opened the public hearing on the adoption of the assessments for the Southwest Ponding Basin at 7:30 P.M. The City Administrator read the legal notices of the public hearing and the Certificate of Mailing, into the record, which were published July 17th and July 24th, 1980. The minutes of the proceedings at the Hearing were taken for the City by a Court Reporter, Theresa Heesch. A canplete transcript of the PUblic Hearing is on file in the office of the City Clerk. '!he Mayor declared the public hearing closed at 8:50 P.M. Moved by CounciJ.man Collins, seconded by CounciJ.man Kulzer to adopt resolution #51-80. Entire resolution on page 281 of minutes. Ayes, 6; Nayes, Stoffel, Shannon. Moved by CounciJ.man Shannon, seconded by CounciJ.man Trautmann to approve the letter prepared by the City Planner, wi th the additions suggested in his presentation, to be sent to the Metropolitan Council as the City of Hastings' comment on the proposed guidelines for review of proposed amendments to local canprehensi ve plans. Ayes, 8; Nayes, none. Moved by Councilman Trutna, seconded by Councilman Karnick to pass the second reading of the amendment to Ordinance #104-79 regarding the wrecking or demolition of buildings in the City of Hastings. "'d ....\\ 282 NON, 'lHER.EF'(EE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota: 1. '!hat twenty percent (20%) of the cost of such improvanents shall be assessed against the benefitted property. '!he remainder of the cost shall be paid for fran other City sources. 2. Such proposed assessments, a copy of which is attached hereto and made a part hereof is hereby accepted and shall constitute the special assessments against the lands therein, and each tract of land therein included is hereby found to be benefited by the pro- posed improvement in the amount of the assessment against it. 3. Such assessment shall pe payable in equal installments extending over a period of 10 years, the first of the instalJments to be payable on or before the first Monday of January, 1981. Any deferred installments shall bear interest at the rate of eight percent (8%) per annum. To the first instal1ments shall be added interest on the entire assessment, fran the date of this assessment resolution until Decenber 31, 1981. To each subsequent installment when due shall be added interest for one year on all unpaid install- ments. 4. '!he ONIler of any property so assessed may, for 30 days after notification fran the City Treasurer, pay to the City Treasurer, the whole of the assessment without interest, and he may at any time, prior to certification of the assessments to the County Audi tor, as herein provided, pay the whole of the assessment against any parcel with interest accrued to the date of payment to the City Treasurer, and he may at any time thereafter pay the County Treasurer the entire amount of the assessment remaining unpaid. 5. The City Clerk shall forthwith transnit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the County and such assessment shall be collected and paid over in the same manner as other municipal taxes.
