The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday,
December 2, 1997, at 7:00 p.m. in the City Hall Council Chambers, 101 4th Street East, Hastings,
Minnesota.
Members Present: Councilmember Yandrasits, Riveness, Johnson, Simacek, Hicks,
Moratzka&Mayor Werner
Members Absent: None
Staff Members Present: Dave Osberg, City Administrator;

Approval of Minutes
Mayor Werner asked whether there were any corrections or additions to the minutes of the
regular meeting of November 17, 1997,and the special meeting of November 24, 1997,and hearing
none, approved the minutes as presented.
Consent Agenda
Moved by Councilmember Hicks, seconded by Councilmember Riveness, to approve the
consent agenda as presented.

Public Hearing-Snowmobile Ordinance Revisions
Mayor Werner opened the Public Hearing at 7:02 p.m. and Joe White, of 400 West 13th
Street,thanked the Council for their support in drafting the snowmobile ordinance revisions. Mayor
Werner asked if there were any additional comments on the snowmobile ordinance and hearing none
closed the public hearing at 7:04 p.m.
i Ordinance No. 420, Snowmobile Ordinance Revisions
Moved by Councilmember Simacek, seconded by Councilmember Hicks, to approve
Ordinance No. 420 an Ordinance amending City Code Chapter 7.30 by adding new streets to the
snowmobile corridors;deleting Pleasant Drive from the snowmobile corridor;creating a snowmobile
service district; and limiting the dates when snowmobiles can be operated within the City.
Councilmember Yandrasits expressed concern over enforceability of the proposed ordinance.
Councilmember Hicks complimented the Operations Committee on their work in drafting the
ordinance revisions. 6 Ayes;Nays, 1 Yandrasits.

Public Hearing-Proposed Liquor Ordinance Extending Effective Date of Requirement to List
the City as an additional insured party on Liquor Liability Insurance
Mayor Werner opened the Public Hearing on the proposed Liquor Ordinance at 7:06 p.m.
and inquired whether there were any public comment on the proposed ordinance. Hearing none,
Mayor Werner closed the public hearing at 7:07 p.m.
2nd/Final Reading for Proposed Liquor Ordinance Extending Effective Date of Requirement
to list the City as an additional insured party on Liquor Liability Insurance
Moved by Councilmember Simacek, seconded by Councilmember Moratzka, to deny the

2nd/Final Reading for an Ordinance requiring on-sale liquor license holders to list the City as an
additional insured party and changing the effective date of requiring the City to be listed as an
additional insured party for all liquor licensees; directed Staff to draft an Ordinance for a 1 st reading
on December 15, 1997 to repeal previous ordinances requiring the City be listed as an additional
insured; and directed Staff to provide immediate notification to all liquor license holders of these
actions. 7 Ayes;Nays,None.
Public Hearing Truth In Taxation: 1998 City Tax Levy & Budget
Mayor Werner opened the Truth In Taxation Public Hearing at 7:08 p.m. Lori Webster,
Finance Director reviewed significant changes in the 1997 to 1998 City Tax Levy and Budget.
Willis Olson, of 80 Valley Lane, requested clarification on the tax shift from commercial and
industrial to residential classifications. Jim O'Connor, of 110 River Street, requested information
on the overall budget for 1997 & 1998. Lori Webster, Finance Director, stated the overall budget
for 1997 was$13.6 million and for 1998 it was $19.6 million. Mayor Werner questioned whether
there were any additional comments for the Truth In Taxation public hearing and hearing none
closed the public hearing at 7:25 p.m.
1st Reading/Order Public Hearing for December 15, 1997-Amendment to City Code Chapter
17 (Structure Maintenance Code for Rental Residential Properties)
Moved by Councilmember Simacek,seconded by Councilmember Moratzka,to approve the
1 st Reading/Order Public Hearing for the December 15, 1997 City Council meeting of an Ordinance
for the City of Hastings Amending Chapter 17 of the Hastings City Code regarding structure and
maintenance code for rental residential properties. Councilmember Yandrasits and Mayor Werner
requested Staff research liability exposure due to licensing and specifically define what type of rental
units would be covered by the Rental Residential Property Ordinance. 7 Ayes;Nays,None.
1st Reading/Order Public Hearing for December 15, 1997-Amendment to City Code Chapter
2,Regarding the Board of Design Control
Moved by Councilmember Simacek, seconded by Councilmember Moratzka to approve the
1 st Reading/Order Public Hearing for the December 15, 1997 City Council meeting of an Ordinance
for the City of Hastings Amending Chapter 2, Section 2.05 of the Hastings City Code regarding
Board of Design Control. 7 Ayes;Nays,None.
1st Reading/Order Public Hearing for December 15, 1997-Amendment to City Code Chapter
4,Regarding Special Requirements for Moving Buildings
Moved by Councilmember Yandrasits, seconded by Councilmember Riveness, to approve
the 1st Reading/Order of Public Hearing for the December 15, 1997 City Council meeting of an
Ordinance amending Chapter 4.02 of the Hastings City Code regarding special requirements for
moving buildings.
Moved by Councilmember Yandrasits,seconded by Councilmember Riveness,to amend the
earlier motion to include a requirement that the exterior of the home and all required landscaping of -�
the project be completed within six months from when the house and accessory garage are moved
on to the premises. 7 Ayes;Nays,None.
City Council voted on the approval of the 1 st Reading/Order of Public Hearing for the
December 15, 1997 City Council meeting of an Ordinance amending Chapter 4.02 of the Hastings
City Code regarding special requirements for moving buildings and the amendment for the exterior
of the home and all required landscaping of the project be completed within six months from when
the house and the accessory garage are moved onto the premises. 7 Ayes;Nays,None.

Resolution No. 12-4-97,Setting Contribution Level for Alternative Health Insurance Program
Moved by Councilmember Johnson, seconded by Councilmember Yandrasits, to approve
Resolution No. 12-4-97, a Resolution Setting Contribution Levels for An Alternative Health
Insurance Program. 7 Ayes;Nays,None. Copy of resolution on file.
COPS Grant Authorization-Police Request
Moved by Councilmember Johnson, seconded by Councilmember Yandrasits, to authorize
acceptance of the $150,000 COPS Grant Award and authorize the Police Civil Service Commission
to hire two new Police Officers from the current eligibility list. 7 Ayes;Nays,None.
