The City Council of the City of Hastings, Minnesota met in a regular meeting on August
4, 1997, at 7:00 p.m. in the City Hall Council Chambers, 1014th Street East,Hastings,
Minnesota.
Members Present: Councilmember Riveness, Johnson, Simacek, Hicks,
Moratzka, Yandrasits and Mayor Werner.
Members Absent: None.
Staff Members Present: Dave Osberg, City Administrator;

Approval of Minutes
Mayor Werner asked whether there were any corrections or additions to the minutes of
the regular meeting of July 21, 1997, and the closed door meetings for February 3, 1997, March
3, 1997 and May 19, 1997, and hearing none declared them approved as presented.

Moved by Councilmember Riveness, seconded by Councilmember Yandrasits to add as
Number 15 to the Consent Agenda, Request For Payment Application#3 from Graus

Public Hearing-2nd/Final Reading Ordinance Eliminating Cable Television Commission
Mayor Werner opened the public hearing at 7:02 p.m. to receive comments on the 2nd
reading of the proposed ordinance eliminating the Cable Television Commission, and asked if
there were any comments from the audience. Hearing None,Mayor Werner closed the public
hearing at 7:03 p.m.

Public Hearing-2nd/Final Reading Ordinance Amending City Charter Regarding
Schedule for Filing for Mu icipal Election

Ordinance No. 412, an ordinance amending the City Charter regarding schedules for filing for
municipal election dates.

Public Hearing- Old Hasti gs Historic District
Mayor Werner opene I the public hearing at 7:06 p.m. to receive comments on the Old
Hastings Historic District anc I asked if there were any comments from the audience. Dan Greil, of
705 Vermillion Street, stated he would like key historical buildings, including the Guardian Angels
Chapel and homes in close proximity to the Chapel, within the Old Hastings Historic District.
Richard Graham, 608 Eddy Street, encouraged the Historical Preservation Commission to include
all of the original City of Hastings within the Hastings Historical District.
Mayor Werner asked if there were any additional comments from the audience and hearing
none, closed the public h g at 7:30 p.m. The public hearing was reopened at 7:31 p.m. to
receive comments on the Old Hastings Historic District. Pam Thorson, President of the Hastings
Historical Society, stated the H.H.S. encourages tabling this item to discuss designation of a
broader district for the Hastings Historic District. Dick Thorson, 315 Pine Street, a member of
the Hastings Area Historical ociety and the Hastings Preservation Commission, stated a
conservation overlay district vas not found compatible in HPC discussions. Tom Nesbitt, 221 W.
8th Street, stated he would li ze to see buildings with slight alterations,but the principal ediface
remaining intact, included in he Historical District, especially the Guardian Angels Church. Dick
Graham questioned whether County Asssessors delay of an assessed evaluation would apply
only to those buildings incluc ed in the Historic District. John Grossman, HRA Director,
responded the defemnent is I oased on an age limit criteria. Mayor Werner asked if there were any
additional comments from th audience and hearing none, closed the public hearing at 7:40 p.m.
Designating Old Hastings Historic District
Moved by Councilmember Hicks to forward this item to the Preservation Commission to
review incorporating broader districts to include those properties noted on page 12 of the
"Hastings Historic District" dy and the Guardian Angels Church, within the Historic District. l
Moved by Councilme nber Yandrasits, seconded by Councilmember Johnson, to direct the
Historical Preservation Comr iission to investigate creating a larger conservation district overlay
beyond the preservation distr et boundaries noted in the Historict District Study, to include the
properties referred to by Mr. Hicks.

High School Parking Restrictions,Lyn Way and Bahls Drive
Public Works Director Tom Montgomery introduced the item and noted the City had
received comments from the following people: Terry Cavalier of 1107 Lyn Way stated she would
like the afternoon hours reduced;Dennis Ilia who expressed a desire to have the school parking
restrictions expanded on Lyn Way; and Bernie Kline, 1118 Lyn Way who is strongly opposed to
any parking restrictions on Lyn Way. Jack Magnuson, 1121 Lyn Way, stated he supported his
neighbors request and indicated that he would be contacting the school to see what options are
available for student parking. Terry Cavalier, 1107 Lyn Way, stated she supported the signage to
keep the street clear of student parking in the morning but sees the 2:30 to 3:30 parking
restrictions as a residential restriction.
Moved by Councilmember Riveness, seconded by Councilmember Hicks, to provide a
parking restriction for Lyn Way from Bahls Drive to 300 feet south Bahls Drive East of Lyn Way
for no parking school days, 7:30 a.m. - 9:00 a.m. and from 2:00 p.m. to 2:30 p.m.;no parking
along the East end of Bahls Drive; no parking 2:00 a.m. to 6:00 a.m. for the area of Lyn Way
from Bahls Drive to the Vermillion State Bank.
Roll Call vote was taken. Ayes: Councilmember Riveness and Councilmember Hicks.
Nays: Councilmember Yandrasits, Johnson, Simacek, Moratzka and Mayor Werner.
Moved by Councilmember Hicks, seconded by Councilmember Yandrasits to approve
Resolution No. 8-3-97, a Resolution establishing parking restrictions for the Lyn Way
neighborhood bordering the Hastings High School with the following area applications: No
parking school days, 7:30 a.m. to 9:00 a.m. and from 2:00 p.m. to 3:30 p.m. for Lyn Way from
Bahls Drive to 300 feet south Bahls Drive East of Lyn Way,No parking the East end of Bahls
Drive;No parking 2:00 a.m. to 6:00 a.m. Lyn Way from Bahls Drive to the Vermillion State
Bank.

Authorize Upgrading to Radio Transmitting Water Meters for all future installations
Moved by Councilmember Yandrasits, seconded by Councilmember Riveness,to adopt
the use of radio transmitting water meters for all new water meter installations.

Old Mill Addition: Preliminary/Final Plat and PRD Plan
Moved by Councilmember Simacek, seconded by Councilmember Moratzka to approve
the Old Mill Addition Preliminary/Final Plat and PRD Plan subject to the following conditions:
1. Dedication of public land to be platted as Outlot B for purposes of developing a
pedestrian trail and/or boardwalk along the Vermillion River. The configuration of
said Outlot shall be modified based upon recommendations of Public Works
Director Tom Montgomery and Park&Recreation Director McNamara and shall
be reflected on Hard-Shell copies of the plans submitted to the City for signatures.
2. That homes be constructed on Lots 5,6& 7 shall be setback a minimum of 150
feet from the ordinary high water line(OHWL)of the Vermillion River or 30 feet
from the top of the bluff as identified on the preliminary plat;whichever is more
restrictive.
3. That all proposed structures adhere to yard setback requirements established for
the R-2 zone district except where greater setbacks are required to meet Shoreland
Management Ordinance requirements.
4. Execution and recording against the subject property of an agreement between the
Developer and the City to address the following matters:
a. That the maintenance of the Old Mill Court Cul-de-sac island shall be the
responsibility of the owners of the lots from which front on the cul-de-sac.
b. That development on property within the Old Mill Addition shall be
restricted to single family detached homes.
5. That the Old Mill Addition shall be recognized as a planned residential
development to permit a waiver of R-2 zone district lot width requirement at front
yard setback for Lot 7.

Hastings Family Townhomes-Final Plat
Moved by Councilmember Johnson, seconded by Councilmember Yandrasits,to approve
the Hastings Family Townhomes-Final Plat subject to the following conditions:
1. Modification of the plat to include an additional 20 foot wide drainage and utility
easement which corresponds to a private storm sewer line which will run between
the City water tower site and Pleasant Drive and will serve as an overflow release
for the Water tower. n
2. Payment of$26,350.00 cash in lieu of land to meet park dedication requirements
prior to release of the final plat hard shells.
3. Payment of$8,525.00 to be paid prior to release of final plat hard shells by the
City to meet interceptor sewer platting access fee requirements.
