Permit for a heavy equipment recreational facility -#2011-39 Randy Stenger – SE corner of Ravenna Trail and Glendale Road City Council Action Requested: The City Council is asked to
review the existing Interim Use Permit and consider approval to allow it to continue for one full year past the 6-month probationary period. Background Information: The applicants have
been operating a business called Extreme Sandbox since April 7th, 2012. The business allows the general public the opportunity to operate heavy equipment with the guidance of professionals
in a controlled environment. No complaints or issues have arisen since the business began. The proposed operations include a precision obstacle course for people to operate heavy construction
equipment like loaders and backhoes. The site has very sandy soils conducive to repeated manipulation. The site is surrounded by a large earthen berm that is 10-12-feet high. Site improvements
include a class-5 gravel parking lot for 10-15 cars and an equipment storage area. There is also a 12’ by 60’ climate controlled portable sales office with restroom. Interim Use Permit
The proposed use is allowed in the A (agriculture) district, but city regulations would require permanent improvements like a paved parking lot. The applicant would like his business
to get established prior to making long-term improvements because this type of business has not been attempted in this region. An interim use permit is granted initially for a six-month
probationary period. After which, the City Council may grant approval for one-year. At the end of the 18-months, the business is no longer allowed to operate as a temporary business.
They must either comply with all development regulations or cease operations entirely with the site being completely reverted to pre interim use condition. City of Hastings ! 101 Fourth

HASTINGS CITY COUNCIL RESOLUTION NO._________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS GRANTING AN INTERIM USE PERMIT FOR A HEAVY EQUIPMENT RECREATIONAL FACILITY AT THE
SOUTHEAST CORNER OF RAVENNA TRAIL AND GLENDALE ROAD, 1801 GLENDALE ROAD, HASTINGS, MN Council member ___________________________ introduced the following Resolution and moved its adoption:
WHEREAS, Randy Stenger has petitioned for an Interim Use Permit to operate a heavy equipment recreational facility at 1801 Glendale Road, legally described as: All South of Ravenna Rd
of the West 1/2 of the Northeast 1/4 Ex Pt Southwest of Glendale Rd Ex South 1,072 Ft Lying West of the East 275.35 Ft & Ex South 200 Ft of the East 275.34 Ft, of Section 35 Township
115 Range 17 in Hastings, and situate in Dakota County, Minnesota; and WHEREAS, the proposed use is allowed by right in the A (Agriculture) zoning district; and WHEREAS, on October 24,
2011, review was conducted before the Planning Commission of the City of Hastings as a public hearing which was preceded by proper notice as required by law, as required by state law,
city charter, and city ordinance; and WHEREAS, The Planning Commission recommended approval subject to the conditions of this resolution; and WHEREAS, The City Council had reviewed the
request and recommendation of the Planning Commission. WHEREAS, The City Council approved the permit for a 6-month probationary period to end on October 7th, 2012. NOW THEREFORE BE IT
RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: That the City Council hereby approves the Interim Use Permit for its final year with the following condions: 1) Conformance
with the City Council Staff Report and plans dated November 7th 2011. 2) Approval is subject to a one-year duration beginning on October 7th, 2012 3) After the expiration of approval,
the site must either comply with all development regulations or cease operations entirely and the site must be completely reverted to pre interim use condition. Council member ______________________
moved a second to this resolution and upon being put to a vote it was unanimously adopted by all Council Members present.
