– Renew Home Occupation for 5-Year Period – 707 1st St E. Council Action Requested: The City Council is asked to approve the attached resolution granting a 5-year extension of a Home
Occupation for Terry Heselton. Background Information: In 2006, Terry Heselton applied for and was granted a Type II Home Occupation License for the operation of an excavating business.
A Type II Home Occupation License is required as an accessory structure is used for the business. The business has operated there since 1976. Staff has not received any complaints relating
to the business. A letter was sent to property owners within 350 feet of the Home Occupation notifying them of the 5-year extension of the license. No comments have been received. Financial

HASTINGS CITY COUNCIL RESOLUTION NO. _______________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS RENEWING THE TYPE II HOME OCCUPATION PERMIT FOR TERRY HESELTON AT 707 1ST
STREET EAST Council member ______________________ introduced the following Resolution and moved its adoption: WHEREAS, Terry Heselton has petitioned to renew a Type II Home Occupation
Permit to operate an excavation/snow plowing business at 707 1st Street East, legally described as Lots 1 thru 3, Block 104, ORIGINAL TOWN OF HASTINGS, Dakota County, Minnesota; and
WHEREAS, on September 5, 2006, the City Council of the City of Hastings adopted Resolution No. 09-09-06 approving a provisional Type II Home Occupation permit; and WHEREAS, on November
4, 2007, the City Council of the City of Hastings adopted Resolution No. 09-01-07 approving a full Type II Home Occupation permit; and WHEREAS, the full Type II Home Occupation permit
has expired; and WHEREAS, review was conducted before the City Council of the City of Hastings, as required by state law, city charter and city ordinance. NOW THEREFORE BE IT RESOLVED
BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: That the City Council hereby approves the Type II Home Occupation Permit request of Terry Heselton as presented to the City Council
subject to the following conditions: 1) That the business be operated in compliance with the information provided by the applicant. The applicant shall provide the Planning Department
notice of changes that expand the business (i.e. additional outside employees, use of garage/shed in operation of business, etc.) to determine if the business is operating within the
confines of the code. 2) That the business will be operated in compliance with the Home Occupation regulations as established by the Hastings City Council. 3) That this permit shall
expire on September 5, 2017. At such time, the applicant will need to apply for a renewal. Council member __________________ moved a second to this resolution and upon being put to a
