Schnell, Chief of Police Date: August 14, 2012 Item: Authorization to enter into water patrol reimbursement agreement if needed. Council Action Requested: Authorize the Chief of Police and City Administrator to enter into an agreement with Highway 61 bridge contractors or their designee to provide water patrol security during the planned and upcoming Highway 61 bridge span float in and placement. Any agreement would be subject to review and approval of the Hastings City Attorney and provides a mechanism for funding the staffing of water patrol services during key construction activities. Any agreement would be contingnet upon the requirement that all costs for such services be borne by the contractor or their designee. Background Information: The Hastings Police Department along with law enforcement partners (Dakota and Washington County Sheriff's Offices, MN Department of Natural Resources, MN State Patrol, Pierce County, Wisconsin Wisconsin Sheriff's Office, and the United States Coast Guard) have inititated security and safety planning for the upcoming movement and placement of the Highway 61 bridge span. The safety and security plan is being collaboratively developed in consideration of all hazards. Traffic and spectator management plans are being developed in concert with the MN Department of Transportation, who will provide reimbursement funding for these operations. River-based security planning is underway and has been deemed the contractor's financial responsibility. While we work to finalize the waterway safety and security plan, it is anticipated that the use of local law enforcement agencies, namely, the Dakota and Washington County Sheriff's Offices and MN Department of Natural Resources, may be needed to staff this function. Due to the potiential timing of the move an agreement could not be brought before the Council prior to the need for such an arrangement. Further, it is not feasibile for each of the agencies and their their respective governing bodies to approve individual agreements with the contractor or their designee. As such, in the interest of community safety it may be necessary for the City of Hastings to establish a reimbursement agreement with the contractor that provides a mechanism for the City's law enforcement partners who provide these critical water patrol services to get reimbursement. If such a reimbursement agreement is needed, the City would provide a pass through of funding for water patrol services on an invoice basis. The City would not enter into any agreement to provide these services without assurances of full reimbursement. Any agreement would be reviewed and approved as to form by the Hastings City Attorney.
