Council Action Requested: Attached for Council approval is Amendment No. 3 to the Municipal Cooperative Construction Agreement for the Highway 61 Bridge replacement, which was originally
approved by the Council in December 2009. The amendment allows for the City to be reimbursed by MnDOT for providing security, traffic, crowd management, and standby emergency medical
services during the main span float in events, which are set to occur between August 24th and September 15th. Background Information: Please see the attached Amendment to the agreement
and resolution by the City to approve the amendment. Financial Impact: At this time the costs for the work are estimated to be up to $44,200, with an additional $10,000 as a contingency

CITY OF HASTINGS Dakota County, Minnesota Washington County, Minnesota Resolution No. RESOLUTION FOR APPROVAL OF AMENDMENT NO. 3 TO MNDOTMUNICIPAL COOPERATIVE CONSTRUCTION AGREEMENT
NO. 95243 HIGHWAY 61 BRIDGE REPLACEMENT PROJECT WHEREAS, in the summer of 2010, the Minnesota Department of Transportation (MnDOT) began project 1913-64 to replace the Trunk Highway
61 Bridge over the Mississippi River and to reconstruct the Highway between 5th Street and the bridge over the Canadian Pacific Railway, and WHEREAS, construction of the main span for
the Bridge has been ongoing at a staging area away from the main construction site, and WHEREAS, the main span must be transported on the Mississippi River to reach its final destination,
and WHEREAS, the act of transporting and installing the main span encumbers great interest from the general public, and said interest produces a greater likelihood of traffic congestion,
crowds, parking shortages, and WHEREAS, said interest also creates concern of infrastructure security, including the main span while it is being transported, and WHEREAS, MnDOT project
funds will provide reimbursement to the City of Hastings for the Hastings Police Department to provide security, traffic management, crowd management, and emergency medical service response
actions upon receipt of actual cost invoices, up to a maximum of $54,200. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS; that The City Council
hereby approves Amendment No. 3 to Agreement No. 95243 between the City of Hastings and the Minnesota Department of Transportation and authorizes the Mayor and City Clerk to sign three

Project Number (SP): 8205-130 [$44,200.00] Total Obligation [$59,640.66] This Amendment is between the State of Minnesota, acting through its Commissioner of Transportation ("State")
and City of Hastings acting through its City Council ("City"). Recitals 1. The State has a contract with the City identified as Mn/DOT Contract No. 95243 with amendment 95243-1 and 95243-2
("Original Contract") to provide payment by the City to the State for the City’s cost share of construction, and for payment by the State to the City for the State's share of the costs
of the City construction and other associated construction upon, along and adjacent to Trunk Highway No. 61 from 5th Street to the bridge over the Canadian Pacific Railway, including
Bridge No. 19004 over the Mississippi River, under State Project No. 1913-64 (T.H. 61); and 2. The State and the City recognize the need for crowd and traffic control services during
the Mississippi River Bridge float in; and 3. The State has asked the City to provide for such services and equipment, and the City has agreed; and 4. This Agreement is amended to pay
the City for providing City Forces for crowd and traffic control during the Mississippi River Bridge float in; and 5. The State and the City are willing to amend the Original Contract
as stated below. Contract Amendment In this Amendment deleted contract terms will be struck out and the added contract terms will be underlined. REVISION 1. Article I, Section F is amended
as follows: 1. The Hastings Police Department will provide assistance to Mn/DOT Project staff for: a) Controlling vehicular traffic on Lock and Dam Road and on 2nd Street b) Providing
parking assistance at Lake Rebecca, the City Boat Ramp and associated areas along Lock and Dam Road c) Enforcing a full closure of Lock and Dam road near the Hastings boat ramp d) Monitoring
local traffic north of the Mississippi River e) Crowd presence during the float in f) Security measures as seen appropriate by the City of Hastings Police
Mn/DOT Contract No: 95243-3 -2-Payable Amendment (Municipal Agreements) 2. The City of Hasting Police Department will provide a security plan for such services. 3. Coordinate as needed
with the State Highway Patrol for a planned/emergency closure of Hwy 61. 4. These services will be needed sometime between August 24 and September 15, 2012 (excluding labor Day weekend)
with 24 hour notice. 5. The City of Hastings would be reimbursed for labor expenses and equipment in providing these services. 3 Policeman with car 1 parking flagmen 2 fireman on standby
from 10:00 AM to 10:00 PM The cost for such services is estimated as follows: Bridge move from land to barges (48 hour duration, estimated) 3 police; 3 x $90/hr x 48 hours = $12960.00
1 flagmen; 1 x $30/hr x 48 hours = $1440.00 2 Firemen on standby; 2 x$50/hr x 48 hours = $4800.00 Bridge float down and lift (60 hour duration, estimated) 3 police; 3 x $90/hr x 60 hours
= $16,200.00 1 flagmen; 1 x $30/hr x 60 hours = $1800.00 2 Fireman on standby; 2 x $50/hr x 60 hours = $6000.00 Miscellaneous Police Tape, Traffic Control = $1000.00 Grand Total = $44,200.00
Contingency = $10,000.00 REVISION 2. Article I Payment by the City and the State is amended to read as follows In addition to the previous payments, the State shall pay to the City the
actual cost of the City forces and equipment for crowd and traffic control, not to exceed $54,200.00. The City shall submit invoices for the actual costs of the equipment and labor used
during the time period as notified by the State’s construction project engineer. The terms of the Original Contract are expressly reaffirmed and are incorporated by reference. Except
as amended herein, the terms and conditions of the Original Contract and all previous amendments remain in full force and effect. [The remainder of this page has been intentionally left
