M. in the Council O1ambers of the City Hall. Members present: Councilmen Trutna, Stoffel, Shannon, Karnick, Collins, Legler, and Mayor Petersen. Members absent: Councilmen Trautmann, Uska. ,--. i , The Mayor called for additions or corrections to the minutes of the meeting of December 3, 1979 and hearing none declared the minutes approved as presented. The Mayor opened the public hearing to consider the PUBLIC HEARING SALE OF proposed sale of the Spiral Ball Park, legally described as Part SPIRAL BAIL PARK of Lot 2, Block 3, Industrial Park #1, at 7:32 P.M. The legal notices of the hearing were read into the record. The only person desiring to speak on the issue was Gay Johnson, representing School District #200. Everyone was given the opportunity to be heard after which the Mayor closed the hearing at 7:35 P.M. Moved by Councilman Shannon, seconded by Councilman APPROVE HCME OCCUPATIOO Legler to approve the home occupation permit request for Mrs. PERMIT-MRS. P. DANIELS Pat Daniels, 1977 Oak Street, to operate a home day care facility. Ayes, 6; Nayes, none. Moved by Councilman Trutna, seconded by Councilman Stoffel to approve the home occupation permit request for Mrs. Margaret Erdman, 520 E. 7th Street, to operate a home day care facili ty . Warren Chapman to operate a Photography Studio in the base- ment of his home. Ayes, 6; Nayes, none. Moved by Councilman Trutna, seconded by Councilman Legler to approve the final plat of Whispering Oaks 4th Addition (previously known as Phase II of Whispering Oaks 3rd Addition) with the follo.ving conditions: 1) The total plat area and lot areas shall be provided on the City's copy of the final plat. 2) The paYment of the interceptor sewer fees shall be made prior to the filing of the final plat. Moved by Councilman Karnick, seconded by Councilman Trutna to allo.v occupancy of certain units in Block 1 in Whispering Oaks 4th Addition conditioned upon the developer's assurance that the hard surfaced material will be provided in a timely manner, that there will be maintenance and sno.v ranoval provided in the interim, that the occupants will be assisted by the developers if they becane stuck during muddy conditions, that the Building Inspector and Fire Marshal sign the Certificate of Occupancy. Moved by Councilman Trutna, seconded by Councilman Collins to pass the 2nd reading of the amendment to the Park Use Ordinance, Section I-Definition By changing the wording in line 4 fran "owned and operated" to "owned or operated". Section IV-Alcoholic Beverages To read: to prohibit the con- sumption of any alcoholic beverage, 3.2 beer, or wine between the hours of 6:00 P.M. and 8:00 A.M. (6:00 a.m. was changed to 8:00 a.m. on the recarmendation of the Chief of Police) Ayes, 5; Nayes, Legler. Moved by Councilman Trutna, seconded by Councilman Collins to change the effective date of employment for D:mald Latch as Fire Chief for the City, from 1/1/80 to 12/21/79. Ayes, 6; Nayes, none. Moved by Councilman Shannon, seconded by Councilman Trutna to approve the five year $600 ,000 contractOlfferifor fi'l'€ protection to the Rural Fire Association, as recarmended by the Committee of the Council assigned to negotiate a contract wi th the Rural Fire Association. Moved by Councilman Stoffel, seconded by Councilman Collins to approve the Data Processing Proposal for 1980 as prepared by Gary Kramer, CPA. Moved by Councilman Legler, seconded by Councilman Stoffel to approve the salary adjustment for James Maher from 7-1-79 thru 12-20-79, in the amount of $1,444.94, for additional service during the time the City was without a Fire Chief. Moved by Councilman Shannon, seconded by Councilman Karnick to adopt Resolution #277 dedicating Spiral Court (Part of Outlet A, Industrial Park #1) as a public street in the Industrial Park.
