The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday, SeptaIber 17, 1979 at 7:30 P.M. in the Council ChanDers of
the City Hall.
Members present: Councilmen Trautmann, Trutna, Liska, Stoffel,
Shannon, Karnick, Collins, Legler, and Mayor
Petersen.

The Mayor called for additions or corrections to the minutes of the
meeting of September 4, 1979. The IIDtion raising the price of land in the
Industrial Park is to be corrected to read: the price of land be raised to
$15,000 per acre, to include Industrial Park #1 and #2, effective Septenber 5,
1979. The minutes were approved as amended.
The Mayor called for additions or corrections to the minutes of the
special rooeting of Sept. 12, 1979 and hearing none declared the minutes approved
as presented.
The Mayor opened the public hearing on the adoption of
the assessroonts for lOth Street and Progress Drive at 7:45 P.M.
The legal notices of the hearing were read into the record. No
one voiced any objections to the assessroonts. The Mayor closed
the hearing at 7:45 P.M.

WHEREAS, pursuant to proper notice duly given as required
by law, the Council has met and heard upon all objections to the
proposed assessments for the improveroont of the following:

NON, THEREFORE BE IT RESOLVED by the City Council of the City
of Hastings, Minnesota:
1. Such proposed assessments, a copy of which is attached
hereto and made a part hereof is hereby accepted and shall
consti tute the special assessroonts against the lands therein
and each tract of land therein included is hereby found to
be benefited by the proposed improvement in the aIIDunt of
the assessment levied against it.
2. Such assessment shall be payable in equal installments
extending over a period of 10 years, the first of the
installments to be payable on or befOre the first Monday of
January, 1980. Any deferred installments sm.ll bear interest
at the rate of eight percent (8%) per annum. To the first
installments shall be added interest on .the entire assessment,
fran the date of this assessroont resolution until DecerIDer 31,
1980. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.

3. The owner of any property so assessed may, for 30 days
after notification fran the City Treasurer, pay to the City
Treasurer, the whole of the assessment without interest, and
he may at any time, prior to certification of the assessment
to the County Auditor, as herein provided, pay the whole of
the assessment against any parcel with interest accrued to the
date of payn:ent to the City Treasurer, and he may at any time
thereafter pay the County Treasurer the entire anDunt of the
assessment remaining unpaid.
4. The City Clerk shall forthwith transmit a certified dupli-
cate of this assessment to the County Auditor to be extended
on the proper tax lists of the County and such assessn:ent shall D.
be collected and paid over in the same manner as other municipal
taxes .
Adopted by the City Council of the City of Hastings, Minnesota
this 17th day of Septeni:>er, 1979 .

The Mayor opened the public hearing to consider the PUBLIC HEARING REWNE
rezoning of lots on 24th Street which had, apparently by error, IDl'S VERMIlLION ADD.
been included in a rezoning action on 23rd and Cannon Street,
(Ordinance #69 2nd Series) at 7:45 P.M. The legal notices of
the hearing were read into the record. No one appeared in
opposi tion to the rezoning. The Mayor closed the hearing at
7:50 P.M.

BE IT RESOLVED by the City Council of the City of Hastings#
Minnesota, as follows:
1. It is hereby found, determined and declared that this
City should issue $1,700,000 General Obligation Improvanent Bonds of
1979, Series B to defray the expense of the construction of stonn sewer
facilities in the City.
2. This Council shall meet at the time and place specified
in the fonn of notice hereinafter contained for the purPOse of opening
and considering sealed bids for, and awarding the sale of $1, 700,000
General Obligation Improvement Bonds of 1979, Series B of said City.
3. The City Clerk is hereby authorized and directed to cause
notice of the time, place and purpose of said meeting to be published
in the official newspaper of the City and in Commercial West not less
than ten days in advance of date of sale, as provided by law, which
notice shall be in substantially the fonn set forth in Exhibit A
attached hereto.

4. The tenns and conditions of said bonds and the sale thereof
are fully set forth in the "Official Tenns of Bond Sale" attached hereto
as Exhibit B and incorporated herein by reference.

All bonds maturing on or after February 1, 1995 are subject to prior payment O.
in inverse order of serial nunbers and by lot within a maturity on February 1,
1994 and any interest payment date thereafter at a price of par and accrued
interest. Sealed bids for not less that $1,678,000 and accrued interest on
the principal sum of $1,700,000 will be accepted. No rate of interest nor
the net effective aV,erage rate of the issue may exceed 7% per annum. An
acceptable approving legal opinion will be furnished by Briggs and Morgan,
Professional Association, of St. Paul and Minneapolis, Minnesota. '!he
proceeds will be used to construct storm sewer facilities in the City.
Bidders should be aware that the Official Terms of Bond Sale to be published

These (the "Cbligations") will be offered for sale on sealed bids on Monday,
October 22, 1979. Bids will be opened and acted upon at 5:00 p.m. Central
Time, at the Hastings City Hall. The Obligations will be offered upon the
following terms:

All Cbligations maturing on or after February 1, 1995 at the option of the Issuer
will be subject to redemption prior to maturity in inverse order of serial nurrbers
and by lot wi thin a carmon maturity on February 1, 1994 and any interest payment
date thereafter, at a price of par and accrued interest.
TYPE OF BID
A sealed bid for not less than $1,678,000 and accrued interest on the total principal
amount of the Cbligations must be filed with the undersigned prior to the time of
sale. Also prior to the sale a certified or cashier's check must be filed with either
the undersigned or the Issuer's Financial Advisor, SPRINGSTED Incorporated; no bid
will be considered for which said check has been filed. The check of the Purchaser
will be retained by the Issuer as liquidated damages in the event the Purchaser fails
to canply with the accepted bid. No bid may be withdrawn until the conclusion of
the meeting of the Issuer at which bids are to be acted upon.
RATES
Bidders may not specify rates exceeding 7% per annlm. All Cbligations of the same
maturi ty must bear a single rate fran the date of issue to maturity. No rate may
exceed the rate specified for any subsequent maturity by IIDre than ! of 1% per
annum. Additional coupons may not be used. The net effective average rate of the
issue may not exceed 7% per annum.

AWARD
Award will be made on the basis of the lONest dollar interest cost determined by
the addition of any discount to or the deduction of any prani lm from the total
interest on all Cbligations fran their date to their stated maturity, as c~uted
onthe basis of the schedule of bond years in the Official Statement published for
the Cbligations. The Issuer reserves the right to reject any and all bids, to
waive informalities and to adjourn the sale.
PAYING AGENT
The Purchaser may name the Paying Agent wi thin 48 hours after the sale. The
Issuer will pay custanary and reasonable fees of the Agent named by the Purchaser
or the Issuer in the event the Purchaser does not name an Agent. An alternate
Paying Agent may also be named by the Purchaser provided that there is not additional
cost to the Issuer by reason thereof.
CUSIP NUMBERS
It is anticipated that if the Cbligations qualify for assignment of CUSIP numbers
such CUSIP nurrbers will be printed on the Cbligations, but neither the failure to
print such nurrbers on any Cbligation nor any error with respect thereto shall
consti tute cause for failure or refusal by the Purchaser to accept deli very of the
Cbligations. The CUSIP Service Bureau charge for the assignment of CUSIP identi-
fication numbers shall be paid for by the Purchaser.

SETI'I.EMENT
The Obligations will be delivered without cost to the Purchaser at a place IIRltually
satisfactory to the Issuer and the Purchaser wi thin 40 days follONing the date of
their award. Delivery will be subject to receipt by the Purchaser of an approving
legal opinion of Briggs and Morgan, Professional Association of Saint Paul, and
Minneapolis, Minnesota, which opinion will be printed upon the Cbligations, and of
custanary closing papers, including a no-litigation certificate. On the date of
settlement payment for the Obligations by the Purchaser must be made in federal
or equivalent funds and received by the Issuer or its designee by 1:00 P.M. on the
day of settlement.

At settleroont, the Purchaser will be furnished with Lcertificate signed by
appropriate officers of the Issuer on behalf of the Issuer to the effect that
theOfficial Stateoont prepared for the Issuer did not and does not contain
any untrue statement of a material fact or ani t to state a material fact
necessary in order to make the statements therein, in light of the circUIIEtances
under which they were made, not misleading.
Addi tional copies of the Official Stateoont will be furnished without cost to the
Purchaser upon request, further copies will be provided at cost. Twenty copies
of the Official Stateoont, if available, will be furnished to any interest party
