August 6, 1979
The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday, August 6, 1979 at 7: 30 P.M. in the Council Chambers of the
City Hall.
Meni>ers present: Councilmen Trautmann, Trutna, Liska, Stoffel,
Shannon, Karnick, Collins, lEgler, and Mayor
Petersen.
Menbers absent:
None.
The Mayor called for corrections or additions to the minutes of the
meetings of July 16th and 17th, 1979 and hearing none declared the minutes
approved as presented.
The Mayor opened the public hearing to consider arrend-
ing Section 10. 19 Subd. 2B having to do with permitted uses in
the Industrial Park. Said ordinance amendment would permit
facilities for the raising of animals for research purposes in
the Industrial Park. The Hearing was opened at 7:30 P.M.. The
legal notices of the Hearing were read into the record. The
Hearing had been properly called.

INDUSTRIAL PARK
The C:i/ty Administrator explained that all of the people who had
registered to s~ak at the meeting would be allowed to do so, an indiVlidual
would be requested to limit their cooments to 5 minutes, with a 10 minute
time limit for anyone representing a group or organization. Everyone in the
audience would be given the opportunity to present their views.
Mr. Larry Rasmussen fran Pain Control, Inc. began the Hearing by
stating that the proposed facility was not a Laboratory but a facility for
raising minimal diseased cats which would be sold to Government Institutions,
Private, and public institutions such as Universities and Laboratories. The
facility is under strict regulation of state and federal government.
The Mayor stated that the Industrial Park Advisory Board is in
support of this proposal. He also read letters of support fran the Chanber
of Coomerce and the Kiwanis Club.
The Hearing was then opened to the people who wished to speak.
EIWin Schnirring: I am in support of this proposal, I think it would be a
Breach of Faith if the City did not allow this facility, as the purpose of
the Industrial Park was to encourage industry in Hastings. Mr. Erickson is
doing a fine job in praroting the Industrial Park.
lEnore Gergen: We have to have the raising of animals for research. This
is important in the training of Veterinarians as well as lX>ctors, to have
animals for testing.
Diana Wi ttkopf : I have been involved in lab research and much of the
research is required by government. Special animals are required for this
purpose.
Sandra Weinberg: I am opposed to this project. There are alternatives avail-
able for research other than using animals. I am against those who breed
animals for profit.
Ted Voss: I have reservations about this facility. I am not against
animal research but concerned about needless research, that alternative sources
should be considered.

James Gubluff: The actual benefits derived fran animal research is not known.
I am strongly against this proposal.

Lisa Kodellic: No one knows where the animals go and what they are really
used for. I am strongly against this facility.
Joy Donovan: I abhor vivisection on animals, they cannot speak for them-
selves but they should not be treated in this manner. '!bere are alternatives
available for research that.."should be used.
Leona Schutt: I do not think that people fran out of town should interfere
in this issue and I would rather have research done on animals than humans.
Ray Solac: The issue of animals for research is a concern of people
other than the City of Hastings. The concern of this many POOple is very real.
Howard Goldman: Many research projects are unneccesary. You should study
this issue very carefully before making a decision. I am not against animal
research but against needless projects for the sake of research and not for
the results to be gained.
Dr. John McCardle: There is no needcror l1X)re animals for research, this is
becaning a thing of the past. Facili ties for growth of tissue cultures should
be built rather than breeding of cats. There are other al ternati ves .
Ruth Fetler: '!bere must be better industries who would locate in Hastings
than a facility for breeding cats. I am opposed to this project.
Gayle Erickson: I have lost a daughter and a grandaughter, but they would
not have even been given a chance for life were it not for animal research.
The Mayor gave everyone an opportunity to speak that wished to do so,
after which he closed the Hearing at 8:55 P.M.

MENT TO ORDINANCE
IND. PARK
Moved by Councilman Legler to pass the second reading
of the amendment to Section 10.19, StIDd. 2B,. Industrial Park, to
permit construction of a facility for the raising of animals for
research purposes in the Industrial Park. 'Q9Wlci~ Stoffel
seconded the motion. Ayes, 7; Nayes, Collins.
Mayor Petersen called a recess for five minutes.
PUBLIC HEARING FEDERAL '!be Mayor opened the public hearing called to receive
REVENUE SHARING FUNDS oral or written carments on possible uses of Revenue Sharing
Funds at 9:05 P.M. '!be legal notices of the hearing were read
into the record. '!be Mayor asked if anyone wished to speak on
this issue. Tan Reuter suggested sane of the money could be
used for the extension of sewer and water on W. lst & 2nd Streets.
Andy Klimek speaking for the Hockey Boosters, asked if the Ice
Arena could not be caIpleted, locker I'OCfIE and bleachers were
badly needed. Bob Guntzsberger also requested this project be
considered and added that the Hockey Boosters were ready and able
to provide volunteer help to accaIplish this. Doug Laumeyer
requested that the money be used for flood control in the South-
west Ponding Project. Everyone wishing to speak was given the
opportunity to do so. The Mayor closed the hearing at 9:11 P.M.
Moved by Councilman Stoffel, seconded by CounciJman
Shannon to pass the first reading of the amendment to the Zoning
Ordinance to rezone lDts 4 through 13, Block 4, Vermillion Add.
to an R-2 zoning district and lDts 6 through 12, Block 3, and
lDts 14 through 17, Block 4, Vermillion Add. to an R-3 zoning
classification. Also, that a public hearing be ca.lled on this
action for August 20, 1979 at 7:30 P.M. in the Council Chanbers
of the City Hall. The final reading.not tQ ta,ke place until the
Planning Comnission has acted on the prelimirniry plat and site
plan. Ayes, 8; Nayes, none.

Karnick to approve the hare occupation penni t request for
Dorothy loesch, 1101 Hillside Street, to operate a Beauty Shop
in her horre with the understanding that no signs be put up on the
premises. Ayes, 8; Nayes, none.

The Council authorized the City Planner to forward to
the appropriate officials the comments on Denmark Township
Cri tical Area Plan and Ordinance. A copy of the carments is on
file in the Planning Department.
Moved by Councilman Trautrmnn, seconded by Councilman
Trutna to direct the City Attorney to request an Attorney
General's opinion on the scope and limitation of the Public
Welfare Lieensing Act as it relates to day care operations in
single family zoning districts. Ayes, 8; Nayes, none.
Moved by Councilman Legler, seconded by Councilman
Liska to grant a Bingo License to the Eagles Club, 1222 Vermill-
ion Street, Hastings, in accordance with the City of Hastings
Ordinance and Minnesota Statutes Chapter 349, for the licensing
year ending 1980. Ayes, 8; Nayes, none.
Moved by Councilman Shannon, seconded by Councilman
Trautmann to adopt the resolution authorizing the City Attorney
to start legal proceedings for condEmnation of the apartment
building located at 1519 King Midas Lane. Ayes, 8; Nayes, none.
Moved by Councilman Trutna, seconded by Councilman
Collins to table any action regarding the building cmned by Tan
Reuter, 321 W. 1st Street, to allcm Mr. Reuter to contact the
Ci ty Building Inspector for instructions as to what must be done
to avoid condemnation of the building. Ayes, 7; Abstain, Liska.
Moved by Councilman Trautmann, seconded by Councilman
Shannon that all SAC refunds be processed according to Alternate
#1 as follcms. Ayes, 8; Nayes, none.
Issue no returns until conflicts are agreed upon by
all parties concerned.
Have all parties concerned sign the "Receipt and
Agreement to Indemnify" fonn.
Make all checks payable to all parties concerned for
endorsement after fonn has been signed.
A letter sent, along with the "Receipt and Agreement
to IndEmnify" fonn, to all persons who have requested
a return or who are eligible for a return, by City
receipts, but have not applied. It would then be the
obligation of these people to get the appropriate
signatures and return the fonn to the City. Payment
of return would then be released in the name of all
involved.

Stoffel to change the Council Meeting of September 3, 1979 to
Septamer 4, 1979 because of the Labor Day Holiday. Ayes, 8;

Mike Sirnacek gave a presentation on the progress and
plans for Lions Park.

Stoffel to table the request for vacation of the alley by
Master, Inc. to the meeting of August 20, 1979 to allcm the
Staff to ensure provision has been rmde for an access road or
driveway fran 2nd Street Northerly along the Westerly edge of
the existing railroad tracks to the lDcal Oil facility. Ayes, 8;
