M. in the Council Chambers of the Ci ty Hall. Menbers present: Counci1men Trautmann, Trutna, Liska, Stoffel, Shannon, Karnick, Collins, Legler, and Mayor Petersen. MenDers absent: None. The Mayor called for additions or corrections to the minutes of the meeting of April 30, 1979 and hearing none declared the minutes approved as presented. The Southwest Ponding Basin and Storm Sewer Project was the first i tan on the Agenda. Moved by Councilman Collins, seconded by Councilman SW roNDING BASIN &: Trautmann to order in the Southwest Storm Sewer Project as STORM SEWER P:ROJErI' recarmended by Barr Engineering under Option "D", with a minimum aIDEREI) IN of 2IY/o assessed to the benefited area, the exact percentage to be determined at a later date. Ayes, 7; Nayes, Shannon. Moved by Councilman Karnick, seconded by Councilman Legler to have Barr Engineering conduct a Storm Sewer study, East of T.H. #61, which will be included into other drainage studies presently being conducted or recently finished to create a City of Hastings storm water management plan. Moved by Councilman Legler, seconded by Councilman Shannon that the Staff be instructed to study and present recomnendations regarding revisions in the Assessment Policy for Municipal Improvements. Moved by Councilman Karnick, seconded by Councilman Collins to authorize the Staff to undertake a study to determine the various benefits to properties within the affected flood area and report back to the Council. Ayes, 8; Nayes, none. Moved by Councilman Collins, seconded by Councilman Legler to direct the City Attorney to proceed and enter into litigation against TKDA for damages resulting from inadequate and deficient design of the Southwest Storm Sewer drainage system. Moved by CounciJman Shannon, seconded by CounciJman Stoffel that the City Engineer define the Watershed area for use in determining the area to be recoomended for annexation .in Nininger Township. Once the area is determined the Staff is to prepare a proposed resolution regarding initiating annex- ation proceedings. Ayes, 8; Nayes, none. That portion of 5th Street, originally platted in said Addition No. 13, cannencing at the centerline of Ash Street, proceeding westerly a distance of 430 feet and there terminating. The street had been vacated in 1945. Complete resolution on file in City Hall. Ayes, 8; Nayes, none. Moved by Counci 1man Shannon, seconded by Counci1man Stoffel to approve the preliminary plat and rezoning request from Willard Bauer. Motion and seocnd withdrawn. ~ Moved by Councilman Shannon, seconded by Councilman Stoffel to approve the preliminary platting of seven single family lots on the south side of West 23rd Street, and to accept cash in lieu of land for the park dedication requirements. Moved by Councilman Stoffel, seconded by Councilman Shannon to pass the first reading of the ordinance to rezone the preliminary plat on the south side of 23rd Street, fran R-3 to R-l and to call for a public hearing on the rezoning for June 18, 1979 at 7: 30 P.M. Ayes, 8; Nayes, none. Neil Siewert asked the City Council if they would consider lifting the Moratorium on the Hyland Hills area so that he could build on sare of the lots. Moved by Counci1man Liska, seconded by Counci1man Stoffel that the City Engineer review the total lIDratoriun area, in consultation with Barr Engineering, and inform the Council of his findings and recoom- enda tions .
