The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday, May 7, 1979 at 7: 30 P. M. in the Counci 1 Charrbers of the
Ci ty Hall.
Members present: Councilmen Trutna, Liska, Stoffel, Shannon, Karnick,
Collins, Legler, and Mayor Petersen.
MenDers absent:
Councilman Trautmann.
The Mayor called for additions or corrections to the minutes of the
meetings of April 16, April 25, and May 2, 1979 and hearing none declared the
minutes approved as presented.
The Mayor signed the Proclamation declaring May 14 -
May 18, 1979 as Handicapped Awareness Week in Hastings.
Moved by Councilman Trutna, seconded by Councilman
Stoffel to approve a lot size variance for each of two adjoining
lots in an R-3 Zoning district in order to construct a duplex on
each lot, subject to Mr. Murphy submitting a drainage plan prior
to building penni t approval, at the corner of West 13th Street
and Eddy Street. Ayes, 7; Nayes, none.
Staff menDers fran the Metropolitan Waste Control
Carmission gave a plan report of "Surrrnary, Conclusions and
Recarmendations" portion of the Hastings Service area facilities.
Moved by Councilman Shannon, seconded by Councilman
Stoffel to hold over the final approval of the Gasparre Addition
plat until plans for additional developed open space have been
received and reviewed by the Council and Planning Commission.

Moved by Councilman Stoffel, seconded by Councilman
Trutna to pass the third and final reading of the ordinance
regarding the storage of elm wood and red oak wood regulations.

Moved by Councilman Liska, seconded by Councilman
Stoffel to hold over to the May 21st meeting, the adoption of
the Softball Tournament Policy. Ayes, none. Nayes, 7.
Moved by Councilman Trutna, seconded by Councilman
Legler to adopt the Softball Tournament Pd>licy submitted by the
Parks & Recreation Department, with the stipulation that the
deadline for tournament reservations for 1979 be left to the
discretion of the Parks Director. Ayes, 7; Nayes, none.
Moved by Councilman Liska, seconded by Councilman
Shannon to table the request for a Grading Penni t from Tom
Reuter, 321 W. 1st Street, until more detailed information, as
specified in the staff report dated May 4, 1979, is submitted.

Applications were received from the Chamber of Cam1erce TEMPORARY LIQUOR
and Art Siebenaler, dba: Ivanhoe's, for a temporary intoxicating LICENSES DENIED
Malt Liquor License. Moved by Councilman Collins, seconded by
Councilman Legler to deny these requests. The Council does not
elect to pass an amendment to the liquor ordinance which would
allow temporary non-intoxicating malt liquor licenses. Ayes, 7;
Nayes, none.
Moved by Councilman Trutna, seconded by Councilman
Stoffel to approve the contract for building inspection between
the City of Hastings and Chester Zimniewicz, interim Building
Inspector, with the suggested changes as recorrrnended by Donald
Fluegel, the City Attorney. Contract on file in City Adminis-
trator's office. Ayes, 7; Nayes, none.

Moved by Counci1man Shannon, seconded by Counci1man
Stoffel to authorize Paul Burns, Planning Director, to present
the City of Hastings I concern regarding the i tan "Discretionary
Actions" at the Metropolitan Council Public Hearing on May 17,
1979 on the continuation of the Designation of Mississippi River
Corridor as a critical area. The City feels that many discre-
tionary actions are primarily the normal and ordinary process of
local zoning administration and do not constitute actions of
State or regional concern. The City would like to see a clear
definition of which discretionary actions would require Metropo-
li tan Council and Environmental Quality Board review before
action is taken to continue the designation of the Mississippi
River Corridor as a Critical Area. Ayes, 7; Nayes, none.

Liska to authorize the City Administrator to advertise for the
posi tion of Building InSpector as soon as it is feasible to do
so. Ayes, 7; Nayes, none.
Moved by Councilman Shannon, seconded by Councilman
Collins that in light of recent Council action regarding the
building inspection department, Roger Tonsager is to be advised
not to return to work until his position has been resolved.

Moved by Councilman Trutna, seconded by Councilman
Karnick to approve a two hour parking limit for one-half block,
on the South side of W. 4th Street fran Hwy #61, East. Ayes, 7;
