HomeMy WebLinkAbout03-05-79 38 I' I: r-- I I 38 Hastings, Minnesota March 5, 1979 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, March 5, 1979 at 7:30 P.M. in the Council O1ambers of the Ci ty Hall. Members present: Councilmen Trautmann, Trutna, Stoffel, Shannon, Karnick, Collins, Legler, and Mayor Petersen Members absent: None. The Mayor called for additions or corrections to the rrdnutes of the meeting of February 20, 1979 and hearing none declared the rrdnutes approved as read. The Mayor opened the Public Hearing on the proposed use of $5,000 Federal Revenue Sharing Funds at 7: 30 P.M. The legal notices of the hearing were read into the record, the hearing had been properly called. There were many favorable caIIrents fran the audience on the Bicycle Safety Program. Mrs. Carol Holmes urged the continuance of the program. Daryl Plath presented an additional petition of 225 names requesting that the Safety Program be approved for another year. Marie Well CCIlIOOnded the 2 Patrol Officers that have been in the program the last two years and suggested they be hired for another year. Mrs. E. Schnirring urged the Council to keep the Program. Clifford Nordstran said he thought sane of the money should go for Senior Citizens but did not mention any specific plan or need. Mr. Reuter asked for an explanation of the program which was given by Julie Goss, the Patrol Officer present. Sherry Atkins, a school teacher, said that all the teachers and educators are 100% in support of the Bicycle Safety program. Everyone was given theppportunity to be heard. The Mayor closed the hearing at 7:45 P.M. PUBLIC HEARING $5,000 FEDERAL REV. SHARING Ft.JNDS-PROP03ED USE BICYCLE SAFElY PRO}. Moved by Councilman Trautmann, seconded by Councilman Legler to allocate $5,000 Federal Revenue Sharing Funds to the Bicycle Safety Program but to check into the possibility of CETA funding for sane assistance. PaIDING BASJN and IIDved its adoption: RESOLUfIOO ORDERING PURCHASE OF PUMP AND RElATED EQUIPMENT FOR SOOTHWEST PCM>ING BASIN n WHEREAS, substantial areas of the City, contributory to the Southwest Ponding Basin, were inundated by rains in the surrmer of 1978, and said lands accordingly presently have little capaci ty for the saturation of additional runoff waters; and WHEREAS, the City of Hastings and surrounding environs have received exceptionally heavy sncmfall during the winter of 1978-1979 thereby posing apotential, serious water runoff problem; and WHEREAS, based upon the best information available to the City Council of the City of Hastings there exists a substantial likelihood of water runoff which will contribute to the South- west Ponding Basin and which could cause the overflcm of same if water is not rerroved fran same by punps or other devices; and WHEREAS, the situation with regard to the Southwest Ponding Basin has been confinred by means of the report of Barr Engin- eering Co. received in February, 1979 by the City of Hastings; and WHEREAS, the need for emergency pumping equipnent to maintain the level of the Southwest Ponding Basin is required to protect 0 the life, safety, and property of citizens of the City of . " Hastings in a general vicinity of said Southwest Ponding Basin as early as April of 1979; and WHEREAS, the Council has been advised that there is at least a sixty-day delay in delivery of adequate punping equipnent fran the canpanies that normally provide such equipnent fran the date or ordering of same; and WHEREAS, should the City follcm the provisions of Minnesota Statutes Section 471. 345 with regard to the advertisement and awarding of contracts for suns over $10,000, the City would be unable to receive the necessary pumping equipnent until mid or late June, 1979; and WHEREAS, it is estimated that the cost of the equipnent required' to protect the property and citizens of the City of Hastings will cost in the range of $25,000; and WHEREAS, it is imperative that the City provide emergency protection to its citizens fran the potential of flooding ~of the Southwest ponding Basin during the IIDnths of April, May, and June of 1979; NON, 'lBEREFORE, BE IT RESOLVED: [j 1. That the City of Hastings does hereby declare an arergency to exist with regard to the potential for flooding of the South- west Ponding Basin during the Spring of 1979, thereby requiring the irIIoodiate acquisition of punping equipnent to protect the safety and property of its citizens. 2. That the City imnediately solicit contracts for the providing of the necessary pumping equipnent for the Southwest Ponding Basin upon quotation or in the open market pursuant to Minnesota Statute Section 473:-345 Subdivision 5 as soon as possible, and to the extent practical, shall obtain at least two quotations for said equipnent fran potential bidders. 40 3. That the City Ackni.nistrator be, and hereby is, authorized to enter into such contracts as are necessary for the acquisi tion of said equip- ment at the earliest possible date upon the advice, counsel, and aid of the City Engineer. 4. That the City Administrator shall, as soon as the information is available, present the information concerning said contract and the order- ing of said equipnent to the Council for ratification and approval. Moved by Counci1man Trautmann, seconded by Councilman Trutna to change records of 10/2/78 certifying a tree removal fee against Parcel #19-32100-170-05. The correct number is #19-03800-010-04. The original assessment was certified to the Dulwood Peters property, 1305 Park Lane, because he was'c one of the Peters family who own property at 1526 Eddy St. The Eddy St. Property had the tree removed and the assessment should have been assessed to said 1526 Eddy St. Correction request sent to County Auditor. '!he City Administrator explained to the people present what has happened so far on the project. Millett O'Connell said he thinks the City has enough park area and the project should be rejected, that the City should take a fresh look at priorities. John McKane said the Task Force has worked on this project for six years and has followed every democratic measure from here to Washington, D.C. also the March 1978 Referendum found the voters in favor of the Park and we should now move on with the project. Counci1man Legler stated he has received many calls suggesting better uses of the money such as the Ice Arena, restoration of old Mill Park, and Senior Citizen needs. The Attorney said that the money voted upon in the referendum could not be used for any other purpose than the park project. Peter Mi tzuk asked why Lake Isabel could not be restored as a Park. Counci1man Trautmann answered that most of the IIDney for the project is coming fran the Corps of Engineers and if not used for this Lake Rebecca Park it would not be available for any other use, also that the IIDney voted on the referendum for the Park must be used only for that. ":,-,' I....., .WHEREAS, the City Council of the City of Hastings has hereto- -. fore, by Resolution No. 13-76 dated March 15, 1976, declared its intention concerning local participation in recreation features of a project for fishery and wildlife enhancement and recreation development on the Mississippi River (Lake Rebecca) Dakota County, Minnesota; and WHEREAS, the City Council has by Resolution No. 135877 dated November 7, 1977 further declared its intention for local par- ticipation in recreation and fish and wildlife enhancement features at Lake Rebecca subject to approval of financing by referendum and participation by others; and WHEREAS, the voters of the City of Hastings by special election of March 21, 1978, approved the borrowing of IIDney by the City of Hastings by the issuance of general ooligation bonds or by in- curring long-term debt in an aIIDunt not to exceed $88,000.00 (in addition to previously authorized. $50,000.(0) "in order to participate in the improvement and installation of recreational 0 facilities and other open space and park improvements at Lake Rebecca park area in the City of Hastings; and WHEREAS, the United States Army Corps of Engineers has prepared and submitted to the City of Hastings a plan for the development of Lake Rebecca and various supplements thereto, which plan has been reviewed by and accepted by the Hastings City Council; and WHEREAS, the City of Hastings has heretofore entered into a contract between itself and the United States of America acting through the Corps of Engineers of the United States Army, which contract is dated Septamer 26, 1978, and which contract requires the City, arIDng other things, to acquire fee and/or pennanent use easements on approximately 23 acres of privately ONIled real estate adjoining said Lake Rebecca and located wi thin the City of Hastings, County of Dakota, State of Minnesota for the purpose of implementing the plan for development for the Lake Rebecca Project as hereinbefore referred to; and WHEREAS, the United States Army Corps of Engineers has agreed by the aforementioned Contract to undertake certain construction activities pursuant to the aforementioned plan for development for the purposes of reclaiming natural resources, recreational uses, and fish and wildlife enhancement, at the expense of the United 0 States of America, provided that the City of Hastings will pro- vide all of the real property interest necessary to acCCllJ>lish'. same as set forth above; and WHEREAS, .~ public hearings have been held in the City of Hastings regarding the said plan for development and the contract for same; and WHEREAS, the acquisition of said land for natural resource reclam- ation, recreation, and fish and wildlife enhancement is a public purpose, and the Council deans the ~aid acquisition necessary and essential for said public purposes; NOW, 'IHEREFORE, be it resolved by the City Council of the City of Hastings as follows: ( (, r-- l 42 1. That the subject property, being the property to be acquired by the City of Hastings is described on Exhibit A which is attached hereto and made a part hereof by reference as if set forth fully herein. 2. '!hat the City of Hastings shall forthwith undertake eminent danain pro- ceedings to acquire the necessary fee title and permanent use easements in the subject property pursuant to its contract with the United States of America, Uni ted States Army Corps of Engineers. 3. '!hat it is essential and necessary that said property be acquired by the City of Hastings for public purposes consisting of natural resource reclamation, recreational uses, and fish and wildlife enhancement.
