The City Council of the City of Hastings, Minnesota met in a Special
meeting on Tuesday, January 2, 1979 at 7:30 P.M. in the Council Chambers of
the City Hall.

Menbers present: Councilmen Shannon, Trautmann, Erickson, Trutna,
Novak, Karnick, Collins, and Mayor Petersen.
Merrbers absent:
Councilperson Fischer.
The Mayor opened the Public Hearing on the adoption of the 1978
Assessrrents at 7:30 P.M. The Administrator read into the record the notices
of mailing and the affidavit of the Notice of Public Hearing, thereby declaring
the Hearing had been called according to Minnesota law. Everyone in the
audience was given the opportunity to be heard as each project listed was
presented.

Shannon to assess the North Frontage Road Street Improverrents against
the abutting frontage on an adjusted front foot basis with the
follcming lIDdifications: Ayes, 7; Nayes, none.
Because of very unusual topography and ackncmledging
Stoffel's assumption of costs for deIIDlishing a building located
on the right-of-way, 100% of the cost for the granular fill
needed to construct the roadway shall be assessed to the First
National Bank property and the Stoffel property shall be excluded
fran any costs associated with the rock excavation. Ayes, 7;
Nayes, none.

Novak to adopt Project #6 with the follcming explanation; the
Old Bridge Lane and 25th Street Improvement was assessed on the
basis of the adjusted froIifoot method. The City Council
determined that one half the frontage of Lot 7, Block 1 should
be assigned to Lot 6, Block 1 since the access for Lot 6, Block 1
is across Lot 7, Block 1. Ayes, 6; Nayes, Trutna.

required by law, the Council has met and heard and passed upon
all objections to the proposed assessments for the inproverrent

1'VN, THEREFORE BE IT RESOLVED by the City Council of the City of
Hastings, Minnesota:
o
1. Such proposed assessments, a copy of which is attached
hereto and made a part hereof is hereby accepted and shall
consti tute the special assessments against the lands therein,
and each tract of land therein included is . hereby found to
be benefited by the proposed inprovement in the amount of
of the assesSln:mt levied against it.
2. Such assessmmt shall be payable in equal installrrents
extending over a period of 10 years, the first of the
installrrents to be payable on or bef<!)re the first Monday of
January, 1980. Any deferred installrrents shall bear interest
. "J-erest at thenate of eight percent ($0) per annum. To the first
instal1ments shall be added interest on the entire assessment,
fran the date of this assessment resolution until DecenDer 31.
1980. To each subsequent installrrent when due shall be added
interest for one year on all unpaid installrrents.
3. The o.vner of any property so assessed may, for 30 days after
notification fran the City Treasurer, pay to the City Treasurer,
the whole of the assessment without interest, and he may at any
ti.roo, prior to certification of the assessment to the County
Audi tor, as herein provided, pay the whole of the assessment
against any parcel with interest accrued to the date of payrrent
to the City Treasurer, and he may at any tirre thereafter pay the
County Treasurer the entire amount of the assessment remaining
unpaid.

4. The City Clerk shall forthwith transmit a certified duplicate
of this assessment to the County Auditor to be extended on the
proper tax lists of the County and such assessment shall be
collected and paid over in the same manner as other nnmicipa1 taxes.
