I " OJ o ([) m <t r r ,;' ~/ Hastings, Minnesota November 30, 1981 91 The City Council of the City of Hastings, Minnesota met special meeting on Monday, November 30, 1981 at 5:00 o'clock p.m. Council Chambers of the City Hall. in a in the Members present: Councilmen Legler, Kulzer, Trautmann, Pike, Karnick, Trutna, Klimek, Bond and Mayor Stoffel. Members absent: None. Pursuant to due call and notice thereof, dated November 20,1981 by Mayor Stoffel, said special meeting of the City Council was held for the purpose of conducting a public hearing with regard to the off-sale liquor license held by Lawrence A. Jensen in accordance with Minnesota Statutes Chapter 15 and 340 and Hastings City Code Chapter 3, and the Hastings City Council procedure adopted pursuant thereto and thereunder. Due and proper notice had been given with regard to said meeting to the licensee, Lawrence A. Jensen and to the former holder of the off-sale liquor license for premises located at 2101 Vermillion Street, Hastings, which notice of hearing and Affidavits of Service by Mail concerning same are attached hereto and made a part of the minutes of this meeting. Assistant City Attorney presented information to the Council as to the purpose of said meeting and the procedure required to be followed with regard to the public hearing in accordance with the Council's previously adopted procedure as set forth in memorandum to the City Council of November 24, 1980. A tape recording of the entire proceedings was made thereat. The public hearing was opened by the Mayor at 5:10 p.m. to consider the revocation of the off-sale liquor license of Lawrence A. Jensen for premises located at 2101 Vermillion Street, Hastings, Minnesota. The former licensee of the premises at 2101 Vermillion Street, Hastings, and his spouse, Mr. and Mrs. Arne M. Tunheim appeared personally and through legal counsel, Harry P. Schoen, and both Mr. and Mrs. Tunheim presented testimony under oath, and Attorney Schoen presented arguments in behalf of the revocation of the license of licensee Jensen. Licensee Jensen appeared personally and through legal counsel, Attorney Gregory Johnston, said Jensen giving testimony under oath and said attorney presented arguments in behalf of licensee Jensen retaining said license. Anyone wishing to speak was given the opportunity to do so. The Mayor closed the hearing at 6:14 p.m. Moved by Councilman Legler, seconded by Councilman Karnick, to find as a matter of fact that licensee Lawrence A. Jensen presently has no sufficient interest in the premises at 2101 Vermillion Street, Hastings, Minnesota, so as to support the holding of an off-sale liquor license for said premises. Ayes, 7; Nayes, Trautmann. Moved by Councilman Legler, seconded by Councilman Karnick to revoke off-sale liquor license issued November 16, 1981 to Lawrence A. Jensen for premises located at 2101 Vermillion Street, Hastings. Ayes, Legler, Karnick, and Trutna; Nayes, Kulzer, Trautmann, Pike, Klimek, and Bond. Jensen, 9540 Yorkshire Lane, Eden Prairie, Minnesota 55344: YOU WILL PLEASE TAKE NOTICE that by order of the Mayor pursuant to Sec. 401 of the Hastings City Charter, a special meeting of the Hastings City Council will beheld at the Council Chambers, City Hall, 100 Sibley Street, Hastings, Minnesota, 55033, on Monday, November 30,1981, at 5:00 o'clock p.m., or as soon thereafter as the matter can be heard, for the purpose of then and there hearing , . evidence concerning possible action by the City of Hastings against the license held by Lawrence A. Jensen dated November 16, 1981, with respect to an alleged vio- lation of Minnesota Statutes Chapter 340 and the Hastings City Code, Chapter 3, by virtue of the alleged failure of said licensee to have any interest in or right to use the premises for which said license was issued, being 2101 Vermillion Street, Hastings, Dakota County, Minnesota. Said hearing shall be conducted in accordance with Minnesota Statutes Chapters 15 and 340 and Hastings City Code Chapter 3. YOU ARE HEREBY FURTHER ADVISED that based upon said hearing the Hastings City Council, may, by law, take action against the said liquor license that is pres- ently held by said Lawrence A. Jensen including revocation thereof or suspension thereof not to exceed 60 days. YOU ARE HEREBY FURTHER NOTIFIED that at said hearing the licensee will have the following rights: to appear in person or through legal counsel of his own choosing; to cross-examine witnesses who testify and to produce witnesses in his own behalf; to have a full consideration and fair determination according to the evidence presented at said hearing; to obtain a record-transcript of the hear- ing that will be made at said hearing. The charge alleged against the present licensee, Lawrence A. Jensen, upon which the proposed revocation or suspension of license is based is as follows: that said licensee, Lawrence A.
