The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, A,ugust 2, 1982 at 7:30 P.M. in the City Hall
Council Chambers.
Members Present: Councilmen Legler, Kulzer, Trautmann, Pike,
Karnick, Trutna, Bond and Mayor Stoffel.

Members Absent: Councilman Klimek.
The Mayor called for additions or corrections to the minutes
of meeting of July 19, 1982 and hearing none declared the minutes approved
as presented.

The Public Hearing was opened by the Mayor at 7:31
P.M. to consider a partial street vacation at 1215 Ashland
Street. The notices of the hearing were read into the record
by the City Administrator/Clerk. The Mayor asked if anyone
wished to speak on the issue. Everyone wishing to speak on
the issue was given the opportunity to do so. The Mayor
closed the Public Hearing at 7:32 P.M.
PUBLIC HEARING -
STREET VACATION -
1215 ASHLAND STREET
Moved by Councilman Trautmann, seconded by Council- RESOLUTION NO. 37-82
man Legler to pass Resolution No. 37-82 recommending the approval
of the vacation of approximately 6 feet west of 13th Street
adjacent to Lot 5 Blo~k 86 Original Town to eliminate the house's
encroachment onto the 13th Street right-of-way. This is cond-
itioned upon the owners of the property obtaining the survey
to verify the exact amount of land needed to be vacated. Ayes,
7; Nayes, None.

The Public Hearing was opened by the Mayor at 7:33
P.M. to consider the proposed use of Federal Revenue Sharing
Funds to be received by the City during the calendar year
1983. The legal notices of the hearing were read into the
record by the City Administrator/Clerk. The Mayor asked if
anyone wished to speak on the issue. A letter was enclosed
in the Councilmen's packet from the Hastings Clown Club re-
questing funds. Everyone wishing to speak was given the
opportunity to do so. The Mayor closed the Public Hearing
at 7:34 P.M.
Moved by Councilman Trautmann, seconded by Council-
man Kulzer to accept the report submitted by the Hastings
Citizen Advisory Committee for Cable Television. Ayes, 7;
Nayes, None.

Moved by Councilman Trautmann, seconded by Council-
man Kulzer to authorize the City Administrator, in conjunction
with the City Attorney, Anita Benda, and Herbst and Thue, LTD,
to prepare an ordinance to be considered for adoption by the
City Council that will grant a Cable Communication System
Franchise to Hastings Cable TV Company, Incorporated. Ayes,
Legler, Kulzer, Trautmann, Karnick, Trutna; Nayes, Pike and
Bond. Motion passes.
Moved by Councilman Trautmann, seconded by Council-
man Kulzer to dismiss the Hastings Citizen Advisory Committee
for Cable Television with thanks for having completed tasks
as designated. Ayes, 7; Nayes, None.
Moved by Councilman Trautmann, seconded by Council-
man Legler to over-rule the Planners' interpretation regard-
ing the building permit and rezoning of this property and
allow the Snyders to receive a building permit to remodel
the home. Ayes, 6; Nayes, Pike.

Moved by Councilman Karnick, seconded by Councilman
Pike to approve a variance for the VFW Club expansion - 2nd
anc:i Tyler Streets, - from the rear parking lot setback require- ,-
ment of 5 feet to allow a zero setback. Approval was also
granted for a variance from the required 25 parking stalls to
allow 10 parking stalls on the grounds that special conditions
exist. These parking and setback variances were approved per
the Planning Commission recommendations. Ayes, 7; Nayes, none.

Moved by Councilman Pike, seconded by Councilman
Kulzer to defer the preliminary plat and PRD for Riverwood -
South of County Road 1147 and West of the Vermillion River -
Star Realty, until the Metropolitan Council has satisfactorily
reviewed the proposed amendment to the Hastings' Comprehensive
Plan. Ayes, 6; Nayes, Karnick.
Moved by Councilman Legler, seconded by Councilman
Trutna to pass Resolution No. 38-82 concluding that a negative
declaration notice should be published for the Riverwood
Development, and directing the staff to proceed with the
distribution of the notice. This means that the City feels
that no environmental impact statement is necessary. Ayes,
7; Nayes, None. Resolution on file.
Moved by Councilman Trautmann, seconded by Council-
man Legler to correct the error in the owners of the property
of Schumacher's first addition. The owners of the property
at the time of platting were identified as Leo A Schumacher
and Clara Gene Schumacher, whereas the owner should have
been identified as their solely owned corporation, Imperial
Estates Incorporated. The City Administrator/Clerk is dir-
ected to execute a. certificate of correction on behalf of
the City. Ayes, 7; Nayes, None.

Moved by Councilman Bond, seconded by Councilman
Trutna to change the September 6, 1982 regular City Council
meeting to September 7, 1982 due to the fact that September
6th is a legal holiday. Ayes, 7; Nayes, None.

Mr. Erv Schnirring and Mr. Dave Tanner of the
Library Board were in attendance at the meeting and gave
a report on budget for the library. Representing the
library Board they would like to recommend that the City
Staff investigate a central purchasing system for the City.
They also dicussed possible site locations for a new library
construction. Possible sites that have been conai:d~redare_-
at 12th and Pleasant, .the~J:;a.undry Building at the Vetera.:Q,IL
Home, the Fourth Street 'Court House, and a portioJ} oi,:La.nd
on 4th Street near the Government Center.
