The City Council of the City of Hastings, Minnesota met in a
regular meeting on Tuesday, July 6, 1982 at 7:30 P.M. in the Council
Chambers of the City Hall.

Members Present: Councilmen Legler, Pike, Karnick, Trutna,
Bond, and Mayor Stoffel.
Members Absent: Councilmen Kulzer and Trautmann.
The Mayor called for additions or corrections to the minutes
of the meeting of June 21, and the minutes of the Public Hearing of
June 23 and June 24, 1982 and hearing none declared the minutes
approved as presented.
Councilman Trautmann entered the Council Chambers at 7:33 P.M.

The Public Hearing was opened by the Mayor at 7:32 P.M.
to consider the rezoning of two parcels on the North side of
East 10th Street East of the Railroad Tracks. The Legal
Notices of the Hearing were read into the record by the City
Administrator. The Mayor asked if anyone wished to speak on
the issue. Mr. Franz Altpeter spoke in opposition of the
rezoning on behalf of Profile Extrusion Company. Everyone
wishing to speak was given the opportunity to do so. The
Mayor closed the Public Hearing at 7:45 P.M.

Moved by Councilman Legler, seconded by Councilman
Pike to pass the second reading to rezone the Snyder and
Ehmcke parcels of land on the North side of East 10th Street
East of the Railroad Tracks from 1-2 to R-2.
Moved by Councilman Trautmann, seconded by Council-
man Bond to amend the main motion rezoning the Snyder property
only to an R-2 zoning classification. Ayes, Legler, Karnick,
Trautmann, Bond; Nayes, Pike, Trutna, Klimek. Motion passes.
Moved by Councilman Legler, seconded by Councilman
Pike to pass, as amended, th first reading rezoning the
Snyder property to an R-2 zoning classification. Ayes, Legler,
Trautmann, Karnick, Bond; Nayes, Pike, Trutna, Klimek. Motion
on the first reading passes.
The Public Hearing was opened by the Mayor at 7:56
P.M. to consider the creation of a mobile home zoning district.
The legal notices of the Hearing were read into the record by
the City Administrator. The Mayor asked if anyone wished to
speak on the issue. Everyone wishing to speak was given the
opportunity to do so. The Mayor closed the Public Hearing
at 8:02 P.M.

Moved by Councilman Trutna, seconded by Councilman
Pike to pass the 3rd and final reading of the Ordinance #129
for the Creation of a mobile home park zoning district. Ayes,
Legler, Trautmann, Pike, Trutna, Klimek, Bond; Nayes, Karnick.
Motion Passes.
Moved by Councilman Legler, seconded by Councilman
Trautmann to adopt Resolution No. 11-82 ordering improvements,
final plans and specifications and advertisements for bids
for the 1982 improvements. Ayes, 7; Nayes, None.
The City Administrator/Clerk presented affidavits
showing publication of notice of call forbids on $100,000
General Obligation Improvement Bonds of 1982 of the City,
for which bids were to be awarded at this meeting. The
affidavits were examined, found to comply with the previsions
of Minnesota Statutes, Chapter #429 and #475, and were
approved and ordered placed on file.

Trutna to adopt Resolution No. 30-82 providing for the
issuance and sale of $100,000 General Obligation Improvement

Moved by Councilman Trutna, seconded by Councilman
Pike to approve the Home Occupation permit for a photography
studio at 1336 Honeysuckle Lane - James Minder. Ayes, 5;
Nayes, Klimek and Bond.
Moved by Councilman Bond, seconded by Councilman
Karnick to pass the second reading of the ordinance rezoning
'A! to 'R-3' for Riverwood Manufactured Housing Development
County Road 47 near Vermillion River - Star Realty. Ayes,
7; Nayes, None.

Moved by Councilman Bond, seconded by Councilman
Pike to table the request to amend the PRD for twin homes
and four plexes at 23rd and Cannon Streets until such time
as a public hearing could be held. Ayes, Pike and Bond;
Nayes, Legler, Trautmann, Karnick, Trutna, Klimek. Motion
to table fails.
Moved by Councilman Legler, seconded by Councilman
Trutna to amend the PRD at 23rd and Cannon Streets to allow
additional four plexes instead of twin homes. This would be
subject to the development contract being executed to cover
such things as guaranteeing the revision to the preliminary
plat drawing, filing of the final plat and payment of the
park dedication fee, and the issuance of building permits
and certificates of occupancy. Ayes, 6; Naye, Bond.
Motion passes.
Moved by Councilman Trautmann, seconded by Council-
man Karnick to set a Public Hearing for a Partial Street
Vacation at 1215 Ashland Street - Mr. & Mrs. Virgil Irons
for the August 2, 1982 regular City CounciLmeeting. Ayes,
7; Nayes, None.

Moved by Councilman Legler, seconded by Councilman
Pike, to table the comprehensive plan amendment and refer to
the Comprehensive Sanitary Sewer Plan Consultant and Metropol-
itan Council for review. Ayes, 7; Nayes, None.
Moved by Councilman Karnlck, seconded by Councilman
Klimek to adopt Resolution No. 31-82 establishing a temporary
moratorium on the placement of mobile homes on lots in single
family zoning districts. Ayes, 7; Nayes, None. Resolution
on file.

Karnick to oppose the use of an antique auto storage facility
in an 'R-2' zoning district - 2nd and Bass Streets. Ayes,
Legler, Karnick, Trutna; Nayes, Trautmann, Pike, Klimek, and
Bond. Motion fails.

CAR STORAGE
Moved by Councilman Trautmann, seconded by Council-
man Legler to table the ordinance interpretation for an anitque
auto storage in an 'R-2' zone until the July 19, 1982 regular
City Council meeting. The East Hastings Association will be
notified for their input on the usage. Ayes, 7; Nayes, None.

Moved by Councilman Trautmann, seconded by Council-
man Klimek to increase the ambulance rates for the City of
Hastings from $65.00 to $115.00 and for the Hastings Rural
Fire District from $110.00 to $160.00 per call. Additional
rate increases were approved for ambulance service. These
rates will be effective August 1, 1982. A copy of the
ambulance rates is on file in the office of the City
Administrator/Clerk. Ayes, 7; Nayes, None.

Klimek to direct the City Administrator to solicit proposals

man Karnick to pass the third and final reading of the
ordinance amendment regulating the keeping and licensing of
dogs; amending Section 9.21 of the City Code. Ayes, 6;

Moved by Councilman Trutna, seconded by Councilman
Legler to purchase a punch card voting system for the City
of Hastings,from Miller-Davis Company for $7,632.75. A
ballot counter with automatic feed will be purchased from
Thormber Election Systems for $9,200.00. Ayes, 7; Nayes,
None.

Klimek to authorize the advertisement for bids for repair
and/or replacement of the civic arena roof as needed. Bids
to be opened on Jilily 30, 1982 at 11:00 A.M. and considered
for award at the August 2, 1982 regular City Council meeting.

man Legler to authorize the advertisement for bids for a new
ambulance. Bids to be opened on Tuesday, August 3, 1982 at

Klimek to approve the use of City Streets for the Terry Huberty
Memorial Race on August 7, 1982 at 9:00 A.M. Ayes, 7; Nayes,

man Bond to authorize the advertisement for City Employees
group, health, life, and long cerm disability insurance.
There will be no open enrollment clause. Bids will be opened
at 10:00 A.M. August 13, 1982 and toebe considered for award
at the August 16, 1982 regular City Council meeting. Ayes,

Pike to enter into a contract with Barr Engineering Company
to refine and update the feasibility report on the North-
west drainage feasibility study, contract on file at City

Moved by Councilman Legler, seconded by Councilman
Klimek to authorize the Husting and Engstrom a time extension
from July 15 to August 1, 1982. Ayes, 7; Nayes, None.
Moved by Councilman Trautmann, seconded by Council-
man Klimek to adopt Resolution No. 32-82 authorizing the final
payment to Austin P. Keller Construction Company, Inc. in the
amount of $93,971.82 on the Pleasant Drive North Street and
Drainage project. Ayes, 7; Nayes, None. Resolution on file.

Legler to adopt Resolution No. 33-82 indicating the City of
Hastings opposition to the Construction underway in Eagan
and Mendota Heights whereby no direct access is being
provided from Highway 55 to Interstate Highway 499 or 35 E
