HomeMy WebLinkAbout01-04-82 ~ I , oM m o m CD <( I' ,.-- Hastings, Minnesota January 4, 1982 103 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, January 4, 1982 at 7:30 P.M. in the Council Chambers of the City Hqll. Members present: Councilmen Legler, Kulzer, Trautmann, Pike, Karnick, Trutna, Klimek, Bond and Mayor Stoffel. Members absent: None. The Mayor called for additions or corrections to the minutes of the meeting of December 21 and December 30, 1981 and hearing none declared the minutes approved as presented. The Public Hearing was opened by the Mayor at 7:32 P.M. to hear and to pass on all objectiop$, writt~n or oral, if any, to the proposed assessments on the Pleasant Drive Bridge and Roadway Project. The legal notices of the hearing were introduced into the record by the Acting City Administrator. The hearing had been properly called. Len Olson, Public Works Director, explained the project as to total cost and assessments. The Mayor asked if anyone wished to speak on the issue. Mr. George Loban, Mr. Bob Weir and Mr. Willard Bauer voiced their opposition regard- ingsome portions of the project. Everyone wishing to speak was given the opportunity to do so. The Mayor closed the hearing at 7:53 P.M. PUBLIC HEARING - PLEASANT DRIVE BRIDGE AND ROADWAY PROJECT Councilman Trautmann introduced the following resolution and moved its adoption. RESOLUTION 1-82 ADOPT ASSESSMENTS FOR PLEASANT DRIVE WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessments for the improvement of the following: PLEASANT DRIVE - 23RD STREET TO C.S.A.H. NO. 47 BITUMINOUS SURFACING, CONCRETE CURB AND GUTTER AND BRIDGE CONSTRUCTION NOW THEREFORE, be it resolved by the City Council of the City of Hastings, Minnesota: 1. Such proposed assessments, a copy of which is attached hereto and made a part hereof is hereby accepted and shall constitute the special assessments against the land therein, and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be made payable in equal installments extending over a period of ten years. The first of the installments to be made payable on or before the first Monday of January 1983. Any deferred installments shall bear interest at the rate of eight percent (8%) per annum. To the first installment shall be added interest on the entire assessment, from the date of this assessment resolution until December 31, 1983. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, for thirty days after notification from the City Treasurer, pay to the City Treasurer, the whole of the assessment without interest, and he may at any time, prior to certification of the assessment to the County Auditor, as hereby provided, pay the whole of the assessment against any parcel with interest accured to the date of payment to the City Treasurer, and he may at any time thereafter pay the County Treasurer the entire amount of the assessment remaining unpaid. .. 4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax list of the Gounty and such assessments shall be collected and paid over in the same manner as othere municipal taxes. This Ordinance Amendment would consist of the Planning Commission's recommendation to add the use as a special use to the Agricultural Zoning District and that existing buildings would have to be improved to meet all pertinent building code requirements for their proposed uses. The Public Hearing was set for January 18, 1982 at the regular City Council meeting. Ayes, 8; Nayes, none. I " OJ o CD m <t I ,--. Moved by Councilman Bond, seconded by Councilman Pike to deny the request for the setback and access variances for the 4-plex construction at the southeast corner of 23rd & Cannon Streets as submitted by Frank M. Langenfeld & Sons. The reason for the denial was that Cannon Street is not an improved street and that the street probably will not be improved for some time. Therefore, access is inappropriate. Ayes, Trautmann, Pike, Karnick, Klimek, Bond; Nayes, Legler, Kulzer, Trutna. Motion to deny passes. Moved by Councilman Pike, seconded by Councilman Bond to adopt the statement recommended by the Planning Commission to be sent to the Metropolitan Council as the City of Hastings response to the Metro Council Proposal for Surface Water Management Planning. Ayes, 8; Nayes, none. Moved by Councilman Kulzer, seconded by Councilman Klimek to approve the Second Reading of the Snowmobile Ordinance for Roadside Park. Ayes, 8; Nayes, none. Moved by Councilman Klimek, seconded by Councilman Kluzer to pass the Second Reading on Rules and Regulations for Lake Rebecca Park and Natural Area. Ayes, 8; Nayes, none.
