HomeMy WebLinkAbout20120618 - VII-2 & VIII-B-1 To: Mayor Hicks & City Council From: John Hinzman, Community Development Director Date: June 18, 2012 Item: Public Hearing – Vacation of Easement #2012-24 – Riverwood 8th Addition City Council Action Requested: Hold a public hearing to consider vacating various drainage and utility easements within Riverwood 8th Addition. The subject property will be replatted as Riverwood 11th Addition. The action would remove pre-existing easements; new easements corresponding with Riverwood 11th Addition would be established upon approval of the Final Plat. The City Council ordered the public hearing at the June 4, 2012 City Council Meeting. Notice was sent out to all property owners within 350 feet of the property. Background Information: Riverwood 8th Addition was platted in 2003. The subject area was originally subdivided for townhome development. The applicant desires to replat the area for single family homes. Existing drainage and utility easements do not correspond with the new lot line arrangement of the proposed proposed plat. Financial Impact: The request should not have an effect on the City Budget; application fees have been collected to defer city costs for review. Site Map City Council Memorandum HASTINGS CITY COUNCIL RESOLUTION NO._________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS VACATING CERTAIN DRAINAGE AND UTILITY EASEMENTS WITHIN RIVERWOOD 8TH ADDITION Council member ___________________________ introduced the following Resolution and moved its adoption: WHEREAS, Greg J Homes, property owner, has petitioned for approval to vacate certain drainage and utility easement located within Riverwood 8th Addition, generally located near the intersection of 36th Street and Village Trail, legally described on Exhibit A; and WHEREAS, on June 18, 2012, a public hearing on the proposed vacation was held before the City Council of the City of Hastings, which was preceded by proper notice, as required by state law, city charter, and city ordinance; and WHEREAS, The City of Hastings in all respects proceeded with the vacation hearing as proceeded by the Charter, ordinances, and applicable Minnesota statues. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: That That the request to vacate said easement as legally described above is hereby approved subject to the following condition: 1. The vacation of easement shall not become effective until recorded with Dakota County. Council member ______________________ moved a second to this resolution and upon being put to a vote it was unanimously adopted by all Council Members present.
