City Council Memorandum To: Mayor Hicks & City Councilmembers From: Melanie Mesko Lee, Assistant City Administrator Date: April 11, 2012 Item: Ordinance Amendment Relating to City Fees
and Licensing Requirements Council Action Requested: Conduct the public hearing and approve the second reading/ordinance amendment relating to City staff fees. Background Information:
At the April 2 Council meeting, Council approved the first reading and ordered a public hearing to consider a number of fee adjustments as well as certain license changes. Over the last
several months, the management team has worked to establish a consistent formula by which staff fees would be charged. It is our recommendation to amend our existing ordinance, which
was adopted to address staff costs not explicitly listed in our fee ordinance, with new language which would establish a formula of two times a staff member’s rate of pay. We also recommend
that the staff rates currently listed in the fee ordinance be removed and upon approval, going going forward all staff fees would be charged using this formula. Applicable equipment
fees may also be charged as listed in the fee ordinance and as warranted based on the specific service provided. Financial Impact: While the specifics are unknown at this time, this
change would provide a consistent method for which staff fees are charged. Advisory Commission Discussion: N/A Council Committee Discussion: N/A Attachments: Proposed ordinance amendment
CITY OF HASTINGS, MINNESOTA ORDINANCE NO. ____, THIRD SERIES AN ORDINANCE OF THE CITY OF HASTINGS, MINNESOTA AMENDING TITLE III-ADMINISTRATION, CHAPTER 34 FEES, SECTION 34.04, OF THE
HASTINGS CITY CODE PERTAINING TO SPECIAL OR NON-ROUTINE SERVICES BY CITY DEPARTMENTS: FEES BE IT ORDAINED by the City Council of the City of Hastings as follows: Chapter 34 -Fees, Section
34.04 of the Hastings City Code is hereby amended as follows (new language is underlined, strikethrough language is deleted): §34.04 SPECIAL OR NON-ROUTINE SERVICES BY CITY DEPARTMENTS:
FEES (a) Any City department that furnishes special or non-routine services to any person or organization, other than services which it is required by law to perform without fee, may
charge the person or organization requesting such services a fee as set by council ordinance for that type of service. If no fee has been adopted for a special or non-routine service,
the fee to be charged for staff time shall be two (2) times the hourly rate paid to staff person performing such service(s) being a reasonable approximation of the total costs incurred
by the City to provide the staff services. (Ord..2001-03, 3rd Series passed 2-07-11) This ordinance shall be effective seven (7) days after publication. Council member _____________________
