HomeMy WebLinkAbout09/09/96 Hastings Planning Commission Minutes of September 9, 1996 Commissioner Onnen opened the meeting at 7:00 p.m. Commissioners Present: Bolesworth, Flom, Harrington, Schommer and Onnen. Commissioners Absent: Strauss. Staff Present: Community Development Director Wozniak and Planning Intern Matt Weiland MINUTES: Commissioner Onnen called for additions or corrections to the August 26, 1996, meeting minutes. Commissioner Bolesworth requested that the minutes be amended to indicate that Commissioner Strauss was present at the meeting. The minutes were approved as modified. P.H.- SETBACK VARIANCE - CELLULAR ANTENNA Community Development Director Wozniak presented background information related to a setback variance for a cellular antenna at the 23rd St. Water Tower site. The City Council initiated this variance request to allow the required yard setback for a cellular antenna to be waived in order to allow construction of the facility on the 23rd St. water tower site. Commissioner Onnen opened the public hearing at 7: 10 p.m. Approximately 25 residents were present at the hearing and 8 persons made comments during the hearing. All residents who commented on the hearing were not in favor of the City permitting the construction of the proposed cellular monopole facility. The following categories of concerns were expressed: . the cellular monopole would be unsightly. . the cellular monopole would represent a safety hazard to the neighborhood. . the cellular monopole would have a negative impact on surrounding property values. . the facility is not an "essential service". . is an EA W or EIS required for this type of facility? . does the City have a plan or policy to guide the location of such facilities? It was clear during the lengthy public hearing that all present were in objection to the City granting a variance to yard setback requirements to allow construction of the proposed cellular monopole. There being no further comments the public hearing was closed at 7:50 p.m. Commissioner Bolesworth moved and Commissioner Flom made a second to recommend denial of the tower setback variance to permit construction of a monopole cellular facility not to exceed 150 feet in height at the 23rd St Water Tower site based on the fact that it does not meet the following variance criteria established in Chapter 2 of the City Code: a. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved which are not applicable to other lands, structures, or buildings in the same district. b. The literal interpretation of the City Code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of Chapter 10. c. That the special conditions and circumstances do not result from the actions of the applicant. d. That granting the variance requested will not confer on the applicant any special privilege that is denied by Chapter 10 to other lands, structures, or buildings in the same district. No non- conforming use of neighboring lands, structures, or building in the same district and no permitted or non-conforming use of lands, structures, or buildings in other districts shall be considered grounds for issuance of a variance. Upon vote taken, Ayes, 5; Nays, O. ADJOURNMENT Commissioner Bolesworth moved and Commissioner Harrington made a second to adjoum the meeting at 8:50 p.m.
