HomeMy WebLinkAbout20111107 - CCMinutes 20111017 Hastings, Minnesota City Council Minutes October 17, 2011 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday October 17, 2011 at 7:00 PM in the Council Chambers at the Hastings City Hall, 101 East 4th Street, Hastings, Minnesota Members Present: Mayor Hicks, City Councilmembers Alongi, Hollenbeck, Nelson, Balsanek, and Slavik. Members Absent: Councilmember Schultz Staff Present: City Administrator Dave Osberg City Attorney Dan Fluegel Public Works Director Tom Montgomery Public Works Superintendent John Zgoda Parks & Recreation Director Barry Bernstein, City Engineer Nick Egger Approval of Minutes Mayor Hicks asked if there were any additions or corrections to the minutes of the regular City Council Meeting on October 3, 2011. Hearing none, the minutes were approved as presented. Presentation—National Disability Employment Awareness Month The Mayor and Council were recognized and thanked with a plaque from Lifeworks CEO Judy Lysne for 15 years (1996-2011) of partnering and supporting Lifeworks Consent Agenda Moved by Councilmember Slavik, seconded by Councilmember Balsanek to approve the Consent Agenda as presented. 6 Ayes; Nays, None. 1. Pay Bills as Audited 2. Resolution —Approve Massage License for Ann Margaret Fischer 3. Resolution —Approve Massage License for Amy Silker 4. Approve LeDuc Transfer – 2nd Quarter 2011 5. Declare Cable Room Equipment Excess Property and Authorize Sale or Disposal 6. Declare DWI Forfeiture Vehicles Surplus Property and Authorize Sale at Public Auction 7. First Reading/Order Public Hearing—Fee Ordinance New Water Meter Charges 8. Pay Estimate #5—2011-Infrastructure Improvements -Friedges Contracting LLC ($l,164,149.33) 9. Resolution — Accepting Donation of $235.07 from Modern Woodmen of America to the Parks & Recreation Department for Purchase of Trees Public Hearing— Assessments for 2010 Infrastructure Improvements Egger introduced the item giving general background of the project. A slide presentation was shown with before and after photos of City streets showing major improvements. A breakdown of project funding was discussed and an update of assessment abatements was given. Mayor Hicks opened the Public Hearing at 7:17 Hearing no comments, Mayor Hicks closed the Public Hearing at 7:17 p.m. City Council Minutes October 17, 2011 Resolution to Adopt Assessments of 2010 Infrastructure Improvements Moved by Councilmember Nelson, seconded by Councilmember Alongi to approve the Resolution related to Assessments for 2010 Infrastructure Improvements as presented. Public Hearing— Ordinance Amendment Relating to Parks & Recreation Advertising Program Bernstein introduced the item and gave an overview of the proposed Advertising Agreement to be use by the Parks and Recreation Department. To preclude bringing each agreement before City Council, Bernstein is requesting authorization to sign the Advertising Agreements. The appropriateness of future advertising was also discussed. Mayor Hicks opened the Public Hearing at 7:21 Hearing no comments, Mayor Hicks closed the Public Hearing at 7:21 p.m. Second Reading/Ordinance Amendment— Ordinance Amendment to Chapter 34.03 – Fee Schedule Related to Parks and Recreation Advertising Moved by Councilmember Alongi, seconded by Councilmember Slavik to approve the ordinance amendment related to Parks and Recreation Advertising Program and Fee Schedule as presented. 6 Ayes; Nays, None. Approve Hydropower Plant Stop Log Modification Proposal and 2011 Hydropower Budget Adjustment Montgomery introduced the item discussing the modifications needed to the hydropower plant’s existing stop logs and the resulting benefits. Mayor Hicks praised staff for working within budget by shifting funds from capital outlay to repairs and maintenance equipment. Moved by Councilmember Slavik, seconded by Councilmember Hollenbeck to approve as presented. 6 Ayes; Nays, None. Approve Chevrolet Diamonds and Dreams Program Bernstein introduced the item stating that a Hastings resident, Steve Foote, registered and won the grand prize of $20,000 field renovation (minus travel expenses) from Chevrolet Diamonds and Dreams Program. The PRC recommends accepting this award and requests approval to use these funds to upgrade Vet’s baseball infield. Councilmember Balsanek recommended Steve Foote should be given recognition from the City of Hastings for his gesture. All present agreed this presentation should be completed by Spring of 2012. Moved by Councilmember Alongi, seconded by Moved by Councilmember Nelson to approve as presented. 6 Ayes; Nays, None. Alcohol Compliance Check Failures Fluegel introduced the item to Council and discussed the presumptive penalties as identified in City Code Section 111.10, which include $1,000.00 fine and a 3-day license suspension for first offenses. This penalty would apply to each of the six establishments holding liquor licenses that failed the recent alcohol compliance checks. Staff is recommending the 3-day license suspension portion be stayed if the establishment that holds the liquor license agrees to enroll and complete the City of Hastings Best Practices Program, and the establishment has no further alcohol compliance check failures during the period of the stayed penalty anticipated to extend into January of 2012. The presumptive penalties of $1,000.00 per establishment would still be applicable. The employees who served alcohol during the compliance check failures have been charged by formal complaint with the Gross Misdemeanor Crime of Providing Alcohol to Minors. Moved by Councilmember Balsanek, seconded by Councilmember Slavik to approve as presented. 6 Ayes; Nays, None. City Council Minutes October 17, 2011 Comments from Audience Pat Caswell, 1181 14th Street, thanked the staff of the Engineering Department and Sam Hanson for the work they did during the public works improvement project in her neighborhood. Announcements: • The Dakota County Board of Directors will be conducting a meeting on October 19 • DCC Executive Director Diane Lind will attend the November 7 meeting to discuss the DCC • The HPC will conduct a meeting on October 18, 2001 at 7:00 PM • The HPD fall vehicle auction will take place on Saturday October 22, 2011 at Noon, with inspections allowed, starting at 10:00 am; at 412 4th Street East, Hastings ● The Community Halloween party will be on Friday October 28, 2011 in the Commons at the Hastings High School from 5:30-8 PM ● The Finance Committee will conduct a meeting on November 1, 2011 at 7:30 AM ● The next meeting of the City Council will be on Monday November 7, 2011 ● Mayor Hicks wished City Councilmember Danna Elling Schultz a Happy Birthday on October 21, 2011.
