HomeMy WebLinkAbout20111107 - VIII-B-2 City Council Memorandum To: Mayor Hicks & City Councilmembers From: Justin Fortney, Associate Planner Date: November 7, 2011 Item: Interim Use Permit for a heavy equipment recreational facility -#2011-39 Randy Stenger – SE corner of Ravenna Trail and Glendale Road City Council Action Requested: The City Council is asked to review the proposed Interim Use Permit. Background Information: The applicant would like to operate a proposed business called Extreme Sandbox. The proposed business allows the general public the opportunity to operate heavy equipment with the guidance of professionals in a controlled environment. The proposed operations will include a precision obstacle course for people to operate heavy construction equipment like loaders and backhoes. There will be some digging of up to 8’ deep. The site has very sandy soils conducive to repeated manipulation. At the end of each day the site will be reclaimed. The applicant states that dust should not be a problem because of the sandy nature of the soils, but will water the site with a water truck if dusty conditions arise. The site is surrounded by a large earthen berm that is 10-12-feet high. Site improvements will include a class-5 gravel parking lot for 10-15 cars and an equipment storage area. There will also be a 12’ by 60’ climate controlled portable sales office with restroom. The restroom water supply and waste tanks will be serviced weekly. The trailer will be anchored to the ground and handicapped accessible. Interim Use Permit The proposed use is allowed in the A (agriculture) district, but city regulations would require permanent improvements like a paved parking lot. The applicant would like his business to get established prior to making long-term improvements because this type of business has not been attempted in this region. After which, the City Council may grant approval for one-year. At the end of the 18-months, the business is no longer allowed to operate as a temporary business. They must either comply with all development regulations or cease operations entirely with the site being completely reverted to pre interim use condition. The applicant intends on beginning the use in the spring of 2012 and will choose a beginning date of operation to start the 6-month probationary period. The operations will only be allowed during daylight hours 7:00 a.m. to 10:00 p.m. weekdays and 9:00 a.m. to 9:00 p.m. weekends per City construction regulations. An example of the proposed portable office is shown in the attached application. The actual office used must be approved by staff prior to its delivery. Notification Property owners within 350 feet were notified of the proposal. One citizen called and inquired about the date and times of the meetings. Advisory Commission Discussion: The Planning Commission voted to recommend approval to the City Council (6-0). Eric Legler, stated that his father lives across Glendale Road from the subject property. He added that there should be a gate at the entrance of the property to keep out people who do not belong there, regardless of the proposed business. Pictures of the property HASTINGS CITY COUNCIL RESOLUTION NO._________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS GRANTING AN INTERIM USE PERMIT FOR A HEAVY EQUIPMENT RECREATIONAL FACILITY AT THE SOUTHEAST CORNER OF RAVENNA TRAIL AND GLENDALE ROAD, 1801 GLENDALE ROAD, HASTINGS, MN Council member ___________________________ introduced the following Resolution and moved its adoption: WHEREAS, Randy Stenger has petitioned for an Interim Use Permit to operate a heavy equipment recreational facility at 1801 Glendale Road, legally described as: All South of Ravenna Rd of the West 1/2 of the Northeast 1/4 Ex Pt Southwest of Glendale Rd Ex South 1,072 Ft Lying West of the East 275.35 Ft & Ex South 200 Ft of the East 275.34 Ft, of Section 35 Township 115 Range 17 in Hastings, and situate in Dakota County, Minnesota; and WHEREAS, the proposed use is allowed by right in the A (Agriculture) zoning district; and WHEREAS, on October 24, 2011, review was conducted before the Planning Commission of the City of Hastings as a public hearing which was preceded by proper notice as required by law, as required by state law, city charter, and city ordinance; and WHEREAS, The Planning Commission recommended approval subject to the conditions of this resolution; and WHEREAS, The City Council has reviewed the request and recommendation of the Planning Commission. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: That the City Council hereby approves the Interim Use Permit as presented subject to the following conditions: 1) Conformance with the City Council Staff Report and plans dated November 7th 2011. 2) Approval is subject to an 18-month duration including a 6-month probationary period to start when operations begin. 3) After the expiration of approval, the site must either comply with all development regulations or cease operations entirely and the site must be completely reverted to pre interim use condition. 4) Hours of operation and noise must conform to the regulations in City Chapter 95: Health and Safety; Nuisances. 5) Trash service is required during times of operation. 6) City staff must inspect and approve of the sales office prior to it being moved to the site. 7) Sign permits are required. Council member ______________________ moved a second to this resolution and upon being put to a vote it was unanimously adopted by all Council Members present.
