HomeMy WebLinkAbout#2 - Minutes Hastings Planning Commission September 12, 2011 Regular Meeting Vice-Chair Stevens called the meeting to order at 7:00 p.m. Roll Call 1. Commissioners Present: Stevens, Vaughan, Bullington, Rohloff, Messina, and Estenson Commissioners Absent: Peine Staff Present: Community Development Director John Hinzman Approval of Minutes – July 25, 2011 2. Motion by Vaughan to approve the July 25, 2011 minutes as presented. Seconded by Estenson. Upon vote taken, Ayes 6, Nays 0. Motion carried. PUBLIC HEARINGS City of Hastings 3.–Ordinance Amendment #2011-36 – Amend Chapter 155.21 – Interim Use Permits in Ag District. Director Hinzman presented the staff report including a proposed change to the ordinance allowing the City Council to set the start date of the interim use permit. Vice-Chair Stevens opened the Public Hearing at 7:04. No members of the public spoke to the issue. The Public Hearing was closed at 7:04. Commissioner Vaughan asked for further clarification on the urban service area boundary. Director Hinzman stated the boundary represented the extent of city sewer and water service. Vice-Chair Stevens questioned why an interim use permit process was being created; could the proposal be handled under existing special use permit requirements? Director Hinzman stated special use permits do not generally have a time limit and are transferable upon property sale. Creating an interim use permit ensures the use is temporary. Commissioner Vaughan asked about the hours of operation and noise created. Randy Stenger, owner of Extreme Sandbox (a proposed heavy equipment entertainment business seeking to operate under the new ordinance requirements) stated his business would operate mostly part time and on weekends. The beepers associated with heavy equipment could be modified if noise is a problem. Commissioner Estenson asked about other types of uses that might operate under the proposed ordinance change. Director Hinzman stated the uses would be limited; possible greenhouses, etc. Vice-Chair Stevens asked if the interim use permit would be renewable after 18 months. Director Hinzman stated it would not be. Vice-Chair Stevens asked if a provision could be added to the amendment to allow the city to set City of Hastings Planning Commission Minutes – September 12, 2011 Page 2 of 3 the hours of operation for the use. Director Hinzman stated the ordinance could be amended. Motion by Vaughan to recommend approval of the ordinance amendment with the following changes: 1)Change the effective date from City Council approval to as determined by the City Council. 2)Add provision to require hours of operation be reviewed as part of the permit. Second by Estenson. Upon vote taken, Ayes 6, Nays 0. Motion carried. City of Hastings – 4.Ordinance Amendment #2011-25 – Amend Hastings City code Chapter 151 – Floodplain Ordinance. Director Hinzman presented the staff report. Vice-Chair Stevens opened the Public Hearing at 7:22. No members of the public spoke to the issue. The Public Hearing was closed at 7:22. Vice-Chair Stevens asked about changes to the flood maps; are more areas affected than previous maps. Director Hinzman stated that he did not believe more areas were affected, and that the areas of affect had diminished. Motion by Bullington to recommend approval of the ordinance amendment as presented. Second by Estenson. Upon vote taken, Ayes 6, Nays 0. Motion carried. OTHER ACTIONS Review Adult Use Ordinance 5. Director Hinzman presented a review of the ordinance and a recommendation that no changes be made at this time. Commissioners concurred with Director Hinzman and not action was taken. Other Business 6. Director Hinzman updated the Planning Commission on City Council actions and upcoming meeting items. Adjourn 7. Motion by Rohloff to adjourn the September 12, 2011, Planning Commission meeting. Second by Vaughan. Upon vote taken, Ayes 6, Nays 0. Motion carried.
