The Planning Commission is asked to review an application for aType II Home Occupation
Permit. Vicki Majeski has submitted an application to run Picsby Vics at her residence

located at1614 4Street East.
Background Information:
Comprehensive Plan Classification
The 2020 Comprehensive Plan designates the property as U-I, Urban Residential with 1-3 units/acre.
Zoning Classification
The subject property is zoned R-2, Medium Density Residential. Type II Home Occupations are a
permitted use upon review of Council.
Adjacent Zoning and Land Use
Adjacent properties are zoned R-2and A-Agriculture.
Existing Condition
The existing home was built in 1890. A three car garage wasbuilt in 2001, which will be
usedfor the businessas a showroom.The living room inside the home is currently being
convertedinto studio and showroom space.There are approximately ten acres of property
that will also be used for taking pictures.
HOME OCCUPATION REVIEW
Ordinance Requirements
Home occupations are regulated as either Type I or Type II. Type I –non-licensed home
occupations are allowed without a license. Type II licensed home occupations require a
license and must be passed by Planning Commission.
The applicant requires a Type II –licensed home occupation permit asthe garage will be
used for the Home Occupationand there will be outside employees.
Outside Employees
The applicant has indicated there will be three outside employees.
Access and Parking
The length of the driveway and lot size allows room for several cars to park off-street. Per

the conditionsof the Home Occupation Permit, cars will not be allowed to park on 4street.
Equipment
The equipment used willinclude various camerasand props.Frames will also be sold as part
of the business.
Signage
The applicant states the garage will be painted to advertise the businessand, in addition,
there will bea sign on the side of a vehiclethat isused for the business.Per the Ordinance,
signage may consist of not more than 1 single faced unlighted wall sign per home with a
maximum area of 2 square feet.
Noise
The applicant states that there will be no production of glare, noise, odor, or vibration.
Hours of Operation
The applicant is intending to operate from 8:00 am to 9:00 pm.Per the Ordinance, “(h) No
home occupation causing additional parking or traffic than would be normally expected in a
residential neighborhood shall be conducted between the hours of 8:00 p.m. and 7:00 a.m.”
The Planning Commission is requested to discuss if the hours of operation beyond 8:00 pm
areacceptable due to the minimal traffic generated.
Comments from Neighbors
Notice has been sent to neighboring residents. Staff received aphone callfroma
neighboringresident requesting additional information.
RECOMMENDED ACTION
Approval of a Type II Home Occupation License forVicki Majeskito operate Pics by

Vics at 1614 4St East, subject to the following conditions:
1)That the business be operated in compliance with the information provided by the
applicant. The applicant shall provide the Planning Department notice of changes that
expand the business (i.e. additional outside employees) to determine if the business is
operating within the confines of the code.
2)That the business will be operated in compliance with the Home Occupation
regulations as established by the Hastings City Council.
3)That the Type II license will be in a probationary status for one year. Following the
probationary status, the Council will review the license and determine whether it
should be issued for the remaining two years.

4)Parking is prohibited on 4Street.
5)The Fire Marshall shall inspect the living room and garage once the space is fully
functional for any safety and fire issues.
