in a regular C ity Cou ncil meeting on M onday, August 17, 19
at 7:00 p.m. in the C ouncil Chambers at C ity Hall, 100 S
Street, Hastings, Minnesota.

Mayor Werner presented Joe Pavell a who has CERTIFICATE

Hastings in appreciation for his years of service.
The Mayor called for corrections or additions to APPROVAL of
the minutes of the regular meeting on A ugust 3 ,, 1992 MINUTE
and also the special budget meeting of August 11, 1992
and hearing none the minutes were approved as presented.

ouncilmember Riveness to adopt Staff' recommendation VACA'T'ION
to enter into an agreement with Laanoga Corp. under
which they would grant the City an easement over the
west 20 feet of Bailly Street right -of -way after Council
action vacating the street provided that UBC will gate
both ends of the vacated Bailly Street right -of -way
with gates that meet the approval of the Fire Department,
Moored by Councilmember Simacek, seconded by
uncilmember Riveness to amend the motion that no
loading or unloading shall be allowed on 4th Street
and also in the alley between 4th & 5th Streets. 6 Ayes

A vote was then called on the main motion as amended.

ouncilmember Mathiowetz directing Staff to prepare A ILIA
a policy for council to review regarding WAC charges onHARGE
remodeling construction projects by taking into POLICY
consideration the WAC charges paid on the original
construction project. This motion also allows for
a refund of , of the 13 WAC units charged
the property for the increELsed demand from the new
movie theater development, 6 Ayes; Nays, None.

regarding the storm drainage piroblem in the Highland DRAINAGE
Hills 2nd & Highland Hills 5th Additions, as
follows:
I* The City will excavate an infield for a
future church ballfield, as a source of
fill material from church property and
relocate to a low area in the northwest
corner of the church property to reduce
the amount of ponding water in that area
and to properly channel storm water
runoff to the drainage easement between
the Highland dills 2nd & 5th Additions,
The First Baptist Church will allow the
City to construct a small berm on the
north portion of their property, to
help direct the water into the drainage
easement between the ]highland Hills 2nd
Addition and the Highland Hills 5th Addition.
3. The City of Hastings will taper the grade on the
drainage easement on the property between
the Highland Hills 2nd Addition, Block 4,
Lot 5 and the Highland Hills 5th Addition,
Block 2, Lot 8,

Councilmember Rivenes s to approve a request from 1222 No
eutschmann & Milliren, DDS for a nine inch to one FRONTAGE
foot variance for a parking lot to be unproved at R e
1222 H. Frontage Rd. as recommended by the Planning
Commission
1, The applicant inadvertently located the
dental office building further to the west
which necessitates the need to have the
parking lot encroach nine inches to one
foot within the five foot sideyard setback.
2. The variance will allow for proper*
maneuvering area within the parking lot
which is a safety issue.
3. Approving the variance will not have
detrimental effect on adjacent properties.

variance of Marvin Raway for construction of a STREET

councilmember Simacek to approve the site plan for
Phase III of the Three ]divers Manufactured Home Park
Development a rec o manded by the Planning Commission
subject to the following conditions:
A, The proposed structures and accessory items
including, but not limited to, the storm
shelter shall be completed pursuant to the
approved site plan, Upon request for
occupancy in the building, all uncompleted
items contained within the site plan shall
be addressed pursuant to the escrow
requirements contained within the site plan
review provisions of the City Zoning
Ordinance Section 10,24),
B. Until such time that the T. H, 316 access
issue is resolved, all future phases shall
be restricted to the Nest 320 feet of the
North 1,,533 feet of the East half of the
Northeast quarter of Section 3, Township
114, Range 17, Dakota County, Minnesota
which is that area that was rezoned from
Agricultural A to Manufactured Home
Par} - on April 20 r 1992,

at its intersection with Highway 316. The City Co uncil
shall determine if the right turn lame will be
constructed as p art of the City of Hastings 1993 Public

10,368 squ foot building on the Top Hone Center
site in the Hastings Industrial Park as recommended
by the Industrial lark Board subject to the following
conditions:
1, Provision of required handicapped parking
as specified by the State Building Code
and the AAA.
2. The proposed structure and accessory items
including, but not limited t, harking lot
and landscaping shall be completed pursuant
to the approved site pl ace. Upon request
for occupancy of the building, all
uncompleted items contained within the
site plan shall be addressed pursuant
to the escrow requirements contained within
the site plan review provisions of the
City' zoning ordinance (S ection 10.24).
This motion also includes approval for use
of Industrial Park Funds to construct the required

osberg to prepare a Airport Project Position PROJECT POSITION
Paper indicating the City's opposition to the PAPER
Airport process.
City Administrator osberg will confer with POLICE STATION
the construction managers and the architect TRAINING ROOM
regarding the Police station Training room design
about alternative possibilities.
Council directed City Administrator to
replace half (1,250 square feet of the
proposed training room in the Police Station
plans as part of the base bid at an additional
estimated cost of $30.00 per square foot.

Councilmember Simacek to award the bids on two POLICE CARS
excess Police cars to the apparent high bidder,
Welcome Motors of Chicago, Illinois. All bids

by Councilmember Johnson authorizing staff to PARIS TENNIS
advertise for fencing to replace that at the FENCING
Roadside a Park Tennis Court, 6 Ayes; Nays, None.
Jim Sontag of UBC addressed Council. AUDIENCE
regarding the vacation issue of Bailly Street COMMENT
between 3rd & 4th Streets.
Mayor Werner stated that the Household COUNCIL
Hazardous Caste Material for Disposal Day will be COMMENT
held on September 1, 1992 at the Street
Department.

ouncilmember Trautmann to change the scheduled BUDGET
budget meeting of September 3, 1992 to September MEETING
