HomeMy WebLinkAbout#3 Ag District AmendmentPlanning Commission Memo To: Planning Commission Members From: Kari Barker, Associate Planner, AICP Date: September 12, 2011 Item: Public Hearing - Amend Hastings City Code Chapters 155.21 A-Agriculture – (E) – Interim Use Permit Planning Commission Action Requested: The Planning Commission is asked to hold a Public Hearing to amend Hastings City Code Chapters 155.21 A Agriculture (E) Interim Use Permit. Background Information: The Code Amendment is in response to a proposal by Extreme Sandbox to operate a facility where adults with no prior equipment experience can operate heavy equipment. They have discussed leasing property from Holst Excavating at the southeast corner of Glendale Road and County Road 54 – Ravenna Trail. They seek an eighteen month permit to conduct this business on the property. They seek to operate with limited property improvements during the initial 18 months. Property improvements would include a 12x50 mobile office which would have a restroom and offices and a gravel parking lot. Although the Ag district allows for the use, the current ordinance would require the construction of a permanent building meeting architectural standards and a paved parking lot. The proposed ordinance change would create an “interim use permit” to allow operation of business facilities for up to 18 months in the Ag district outside the urban service area. After 18 months the use must cease or meet permanent code requirements. Financial Impact: An application fee of $500 would be established for the Interim Use Permit. Advisory Commission Discussion: N/A Council Committee Discussion: The Planning Committee of City Council met on August 22, 2011 to discuss the issue. The Committee generally supported an ordinance amendment to allow for temporary uses in the Ag District. Attachments: Ordinance Amendment ORDINANCE NO.______________, THIRD SERIES AN ORDINANCE OF THE CITY OF HASTINGS, MINNESOTA AMENDING HASTINGS CITY CODE CHAPTER 155.21– A AGRICULTURE (E) INTERIM USE PERMIT: BE IT ORDAINED by the City Council of the City of Hastings as follows: Chapter 155.21 of the Hastings City Code – A Agriculture – Definitions is hereby amended as follows (Additions to the ordinance are underlined and section numbers may be renumbered): 155.21 A AGRICULTURE (E) Interim Use Permit (a)Businesses may apply for an Interim Use Permit to operate up to 18 months on a temporary basis in areas outside the Metropolitan Urban Service Area (MUSA), subject to the following: 1. Interim Use Permits shall be issued for a six month probationary period from the date of City Council approval. The City Council may consider full issuance of an Interim Use Permit at the end of the probationary period. The term of the Interim Use Permit shall be 1 year after probation. 2. Following the oneyearInterim Use Permit, the Interim Use Permit is no longer valid and the business must meet permanent business standards. 3.The site must be returned to its pre-development condition if the business does not convert to a permanent business. 4. The business must present an acceptable plan for on-site portable restrooms and trash removal. 5. All temporary and permanent signage will require a separate sign permit. 6. As a condition of approval, the City will need to review and approve any temporary or mobile structure. 7. The construction of or movement of any buildings onto the property would require Site Plan Approval. 8. Interim Use Permits shall be subject to the requirements of Chapter 30.02 (E) (2) – Special Use Permits.
