The City Council of the City of Hastings, Minnesota met in a regular meeting on Monda
November 7, 1994 at 7:00 p.m. in the City Hall Council Chambers, 101 4th Street East, Hastings,
Minnesota.
Members Present: Councilmember Johnson, Simacek, Trautmann, Flicks and Warner

Acting Mayor Tr ut ann asked for corrections or additions to the APPROVAL of
minutes of the regular meeting of October 17, 1994 and hearing none MENUTES
declared the min utes approved as presented.

ctiu�g Mayor Trautxn opened the Public Hearing at 7:03 p.m. P.H. - AMEE NI
to consider an ordinance amending City Code Chapter 3, by adding Section O RDINANCE
3.51 prohibiting nudity in establishments in the City which hold an PROHEBIT
intoxicating liquor license, a 3.2% malt liquor license, a wine license, a PUBLIC
club license or a bottle club license. Acting Mayor Trautm nn asked if NUDITY-
anyone wished to speak on the issue and Bob Schonn er of 1323 W. 17th St. LIQUOR
addressed Council regarding the regulation of nudity through a liquor license PREMISES
but not being able to enforce the regulation of nudity zn non - alcoholic
establishments. Acting Mayor Trautm asked if anyone else wished to sp eak
on the issue; no one wished to do so, The Acting Mayor closed the Public
hearing at 7:08 p.m.

Warner to adopt a new policy on inspection of privately installed street and INSPECTIO
utility improvements and public right - of -ways hich includes a requirement of AV V&
that the devel opers post a cash escrow in an amount of 125% of the estimated NMN S
construction inspection costs for reimbursing the City for consu lting inspection PAC R O.W.

Moved by Councilmember Johnson, seconded by Councilmember
Trautm to approve from Dave Parkhill of Country Suites hotel a request
for a site plan on approximately 3. 4 acres situated. at 350 3 3rd Street
subject to the following conditions:
1. Approval of the Country Suites Motel Site Plan shall be subject
to repltting of the subject property in order to create the
proposed development site. The Knights of Columbus (owners of
Lot 2, Sixteen Hundred Addition) would be left with an @1.5 acre
development site fronting on 316 if fieir property is subdivided.
The City may at its option issue a building permit to only
allow construction of the motel foundation for Phase 1 until such
time as the required plat is recorded. The motel developer would
proceed with construction of the building foundation at it's own
risk, asswning that the required plat would be subsequently
approved by the City.
2. That cross access /egress e asements be recorded to allow private
access between the Motel site and the fights of Columbus Hall
development site (@1.5 acre parcel fronting on T. H. 316 that will
result from the subdivision of land required for the interconnecting
the properties along the north boundaries of the properties and shall
be recorded against the respective properties prior to building
permit issuance.

3 . That the north drive aisle of the Motel Parking lot be connected
to a 28 foot wide drive aisle (with no parking directly on the
driveway) to be constructed on the knights of Columbus property
fronting on Highway 316. The drive aisle through the Knights of
Columbus property will b e situated along the north boundary of that
}property and will provide access to Hwy.316. The drive aisle will
be constructed when the Knight's property fronting nting n Highway 31
is developed as a condition on site plan approval.
4 . That upon construction of the north drive aisle of the Motel parking
lot that a 28 foot wide paved drive aisle be installed by the Motel
developer to connect the north end of the Motel paring lot with the
Knights of Columbus parking lot.
5 . That the Motel site plan b e modified such that vehicular access from
3rd Street to the north parking lot drive aisle is circuitous.
6 . That the grading /utilities /storm water plan be modified if necessary t
comply with City requirements as determined by the Public Works Director.
7. The proposed structure and accessary items including, but not limited to,
the parking lot and landscaping shall be completed pursuant to the
approved site plan. Upon request for occupancy all uncompleted items
contained within the site plan shall be addressed pursuant to the escrow
requirements within the site plan review provisions of the City's Zoning
Ordinance.
8 . That the extent of public hnprovements to be constructed with each phase
of the motel project must be approved by the Community Development Director
to ensure that site drainage, parking and circulation are complying with
City requirements. Further, all pavement to be constructed shall be edged
with curb and gutter as required by City Code.

H icks to adopt the 2nd Reading of an Ordinance adopting Chapter 17 of the
City Code, concerning structure maintenance for "rental" residential properties.

Moved by Councilm.ernber Hicks, seconded by Councilmember
Trautm to adopt the Temporary Restricted Duty Policy for Hastings City
employees as presented, and directing City Staff to prepare an amendment to
this policy regarding an off - ,duty injury. 6 ayes; lays, lone. A copy of this
policy . is on file with the City Administrator.
Moved by Councilmember Warner, seconded by Councilmember
Simacek. approving the revised alcohol related application forms, and directing
the City Clerk to reswne issuing applications as requested. 6 Ayes; Nays,
None.
Moved by Councilmember Hicks, seconded by Councilmember Warner
to adopt the Ordinance amending City Code Section 2.1 2, Subd. 2, by
allowing the Natural Resources and Recreation Commission to serve more than
three consecutive terms in certain. circumsta This motion calls for a public
hearing on Tuesday, December 6, 1994 at 7:00 p.m. City Staff is directed
to begin advertising for openings on City Commission 5 Ayes; Days,
