The City Council of the City of Hastings, Mm*nesota met in a regular meeting on
Monday, October 16, 1995 at 7:0o p.nr. in the City Hall Council Chambers, 101 4th Street East,
Hastings, Minnesota.
Members Present: Councilmember Hicks, Simacel , Johanson, warner and Moratzl a
Members Absent: Mayor Werner and Councilmember Riveness

Acting Mayor Diets opened the Public Hearing of the 1 st Reading I'. . -AMEN
to amend Chapter 10 (the Zoning Ordinance) for the City of Hastings. Acting CHAPTER 1
Mayor Hicks asked if anyone wished to spear on the issue, no one wished to ZONING OR D,
do so. Acting Mayor Diets closed the public hearing at 7:07 p.m.

Moved by Councilmember Johnson., seconded by Councilmember WATER
waxer to accept the recommendation of the Operations Committee regarding SANITARY
delinquent water and sanitary sewer service connections, as outlined below: SEWER SERVICE
1. To encourage and assist property owners in connecting to
City utilities, the City should Bind ali costs necessary to complete the
utility connections, including construction and permit costs, and
assess these costs back to the property owner over a period of tern years.
The following conditions would apply:
a. The utility connections must be made by the end of 1995.
b. The property owner crust present the City with two prates from licensed
contractors before receiving authorization for the lowest bidder to
perfornrx the work and bill the City.
c. The assessment will be spread over a period of 10 years at an
interest rate of 7.75%.
d. The property owners must waive their right to appeal the utility connection
assessment.

2. City Staff is authorized to begin legal proceedings to bring all remaining
property owners in compliance with City ordinance requiring connections
to City utilities with the exception of the Denn and viren properties, since
the City has received letters from both Mr. Denn and Dr. wen promising
to connect to the City sanitary sever utility upon settlement of their litigation
with the l f me ota Department of Transportation. 5 Ayes; Nays, None.

Simacek to delete from the proposed revisions to the .honing ordinance of R VISIT
Section 10.08 the Sign Ordinance Subdivision 1, C, 8, leaving the portable TO CHAPTER
sign requirements currently in existence in the Zoning Ordinance in place. 1

to approve the 1 st Reading of an ordinance amending Chapter 10, relating to R A] ING-
Land Use Regulations (Zoning) and direct Staff to schedule a 2nd and final reading CHAPTER 1
for November 6. 1 995, with the deletion relating to the portable signs as previously ZONING
approved. 5 Ayes; Nays, None.

to accept the recommendation of the Planning Commission approving the Minor SU . -WIES"T'
Subdivision as illustrated on the boundary survey prepared by Dwyer & Associates 31ST ST.
Incorporated. dated January 30, 1995 (Drawing 495 -008) as requested by David
E. Tanner, Trustee for Al & Lucille Sieben Trust, for property next to West 3 1 st
Street, with the minor subdivision creating two lots. 5 Ayes; Nays, None.
Moved by Councilmember Simace , seconded by Councilmember Morat l a MASSAGE
to accept the recommendation of the Administrative Committee directing City PARLOR
Staff to prepare the necessary amendments to City Code Section 5.70, Sauna Parlor; SAUNA
Massage Parlor to include the following elements: PARLOR
1. Modify the license fee for securing a license to conduct certified massage
therapy, to also include an investigation fee.
2. Include a definition of a "Certified Massage Therapist ".
3.) Allow massages to be conducted by a certified massage therapist, separate
from a definition of a massage parlor, and also from the various medical
personnel and others who are currently excluded from the massage definition.
4. Require proper amounts of malpractice insurance to be secured by
Certified Massage Therapists.
5 .) require proper certification from an appropriate Board or Association
recognized in Certified Massage Therapy Industry.
6.) Assure that Certified Massage Therapy will not be conducted out of the
licensees home, as part of any hone occupation application.

to direct City Staff to prepare alternative plans for the City owned "Barker House" HOUSE
located in East Hastings. 5 Ayes; Nays, None.

Council regarding this issue.
