The City Council of the City of Hastings, Minnesota net in a regular meeting on
Tuesday, Septembear 5, 1995 at 7:00 p.m. in the City Hall Council Chambers, 101. 4th Street East,
Hastings, Minnesota.
Members Present: Council ember Ri eness, Warner, Johnson, Simacek, Hicks,
1oratka and Mayor Verner
Members Absent: None
Staff Members ers Present: ]have Osberg, City Administrator;
Barb Thompson, City Clerk;
and Shawn Moynihan, City Attorney
Mayor Weyer asked if there were any corrections or additions to the
minutes of the regular meeting of August 21, 1 995. City Attorney Shawn
Moynihan asked that Resolution. No. 73-95 be added to the minutes regarding
the vacation of utility easements of Bauer View 2nd Addition. Mayor Werner
asked if there were any ftu corrections or additions to the minutes of the
regular meeting of August 21 and also the special budget meeting of
August 28, 1995; hearing none the minutes were declared approved as amended.
Moved by Councilmember Sima ek, seconded by Councilmember
ivene s to approve the consent agenda as presented.
1. Pay all hills as audited
2. Pay Estimate #3 to Richard Knutson, Inc. - $563,880.22
3. Order Public Hearing -Drainage & Utilit=y Easement Vacation - 300 W. 3rd St.
4. Res. loo. 78-95 Renew Charitable Gambling Premise Permit for Minnesota
Multiple Sclerosis at Kaxpen's Kabaret - 314 Vermillion Street
5. Excess Property Purchase Agreement

Moved by Councilmember Hicks, seconded by Councilmember M ratzka RES. No. 79-95
to adopt Resolution No. 79-95 identifying the work plan for the Hastings City COUNCIL STAFF
Council and City Staff. 7 .Ayes; Nays, None. Copy of resolution on file. WORKPLAN
Moved by Councilmember Johnson, seconded by Councilmember Varner RCS. NO. 80-95
to adopt Resolution No. 8095 modifying the City's Personnel Policy relating to PERSONNEL
compensatory time and vacation balances, which includes Items 1 - 9. POLICY
Moved by Mayor Werner, seconded by Councilmember Simaeck to
amend the previous motion by changing the effective date in Item 41, to
July 1, 1995, relating to the Personnel Policy, Section 44, which shall be
amended to allow for one additional vacation step, after 20 years of service,
resulting in 25 days, or 200 Hours of vacation. 6 Ayes; bays, Johnson.
The vote was then taken on the original motion adopting
Resolution loo. 76-95 which includes the previous amendment along with
changing the effective date of item. #2, to September 6, 1 995, which relates
to the vacation carry over provision of the Personnel Policy. 6 Ayes; bays,
Jeness.
Moved by Councilmember Johnson, seconded by Councilmember CITY ADMIN.
Warner to accept the performance evaluation and authorize the step increase STEP INCREASE
effective March 20, 1995 for the City Achninistrator Dave Osberg. 7 Ayes;
Nays, lone.

Moved by Councilmember Hicks, seconded by Councilmember Simacek HASTINGS SIGN
to approve the following items relating to the installation of welcoming signs: PROJECT
1. Approve the concept of installing three welcoming signs in the City o
Hastings.
2. Allow the installation of one 1 sign on City property next to the
Civic Arena at the junction of Highways #316 and #6 1. (The exact
location and ownership of the property continues to be researched,
and if determined that the site is not City owned, this provision is
unn ecessary.)
3 . Authorize City employees to install the sign, as the City's "in - end "'
c ontribution towards support of the project.
4 . Authorize City resources for mowing and maintenance of the site
and the sign.

Moved by Councilmember ricks, seconded by Councilmember Riveness M.S. RIVER
to refer the concerns regarding the Mississippi River Public Boat Ramp to the PUBLIC BOAT
lRRC and ask that they report their findings back to the City Council. 7 Ayes; RAW
Days, None.
A cone med boater expressed he r concerns regarding the above item. AUDIENCE

Moved by Councilmernber Riveness, seconded by Councihnember ADJOURN TO
Johnson to adjourn to a closed doer session at :00 p.m. regarding the Fearing CLOSED DOOR
vs. The City of Hastings Lawsuit. 7 Ayes; lays, None. SESSION
