HomeMy WebLinkAbout07-10-95Hastings, Minnesota July 10, 1995 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, July 10, 1995 at 7: 00 p.m. in the City Hall Council Chambers, 1.01 4th Street East, Hastings, Minnesota. Members Present: Councilmember R iveness, warner, Johnson, Simacck, Hicks, 1 Iorat ka and Mayor Werner Members Absent: A am Staff Members Present: Dave Osberg, City Administrator; Barb Thompson, City Clerk; Mike V o nia , Community Development Director; ctor; and Shawn Moynihan, City Attorney Mayor Werner asked if there were any corrections or additions to APPROVAL of the minutes of the regular meeting of June 19, 1995 and hearing none MINUTES declared the minutes approved as presented. Copy of resolution on file. Mayor Werner opened the Public Hearing at 7:05 p.m. to consider a request from James Lewanski for a rezone and lot line adjustment of property next to King Midas Lane. Mayor Werner asked if anyone wished to speak on the issue, no one wished to do so. RS, No, 1 -9 AWARD CONTRACT- 95 PROJECT P.I. -RZN- R -3 To R -2 2ND RA.ING- RZNE - 3 To R- Page 2 Moved by Councilmember Riveness, seconded by Council- member Johnson to approve site plan request from William Otting for a 4-unit building at 2955 & 2975 River wood Drive as recommended by the Planning Committee: July 10, 1995 SITE AN- 2952975 RIVERWOOD DRIVE 1. The applicant submits a revised landscaping plan detailing species type and size. The applicant has submitted a letter dated ,duly 6, 1995 that indicates that landscaping will be completed for all three buildings, i.e. 2955, 2965 and 2975 Riverood Drive. The applicant has verbally indicated to staff that a revised landscaping plan will be available for the City Council to review at its July 10, 1995 meeting. 2. The applicant shall use maintenance free siding (vinyl, alumin or steel lap) that is the sane color at both 2955 and 2975 River wood Dave, *The applicant has submitted a letter dated July 6, 1995 that indicates maintenance free siding will be used to reside the buildings. Furthennoare, the applicant has indicated on his site plan application for 2955 Riverwood Drive that he will reside and re -roof the four -plea at 2965 River wood Drive a. .a. the "Wee-World" building) with the same materials as 2955 and 2975 River wood Drive. Staff reconunnds that this be included as part of the approval. 3. That the building construction and related site improvements shall be completed per the approved site plan including, but not limited to, landscaping and building elevation plans. O ccupancy of the dwelling units shall not tale place until all site plan improvements have been completed. In the altemative, occurancy of the units 'is permitted if the developer provides the city a cash, escrow. The cash escrow shall be n amount equal to 125% of the cost of the site plan improvement remaining to be completed. 4. That the Certificate of Occupancy for 2955 or 2975 River wood Drive shall be withheld until presiding, roof replacement and landscaping are complete at 2965 Rivercrod Drive. 7 Ayes; Nays, None. Moved by Councilmember Hicks, seconded by Councilmember Simaeck to approve the request for a preliminary /final plat called. Cari Park 5th Addition. approximately 9.24 acres, as approved by the Planning Connmission subject to the following conditions; 1. That the final plat hardshells conform with the preliminary plat called Cari Part 5th Addition. 2. That the developer shall pay $49,300 for cash instead ofparkland before the City signing any final plat. 3. The developer shall pay $15,660 in interceptor sewer charges before the City signing any final plat. 4. Before issuing any building permits, the developer shall provide a certified survey that the entire site has been graded pursuant to the approved grading plan. 5. The applicant shall adhere to comments one through eight as listed in Toni Montgomery's June 21, 1995 memorandum conceming the Cari Park 5th Addition. Preliminary Plat. 6. The developer shall use maintenance free siding (vinyl, alum um or steel lap) for all units. 7. The developer shad plat and construct a narrower right of y and street width. The Planning n.ing Commission recommended that the right of way and street width as determined by the City Council or as directed to city staff by Council. 8. The developer shall plant one `boulevard" tree and one fi - ont yard tree per lot. The developer will record with Dakota County at the sarne time as the plat, covenants which specify landscape maintenance responsibilities for those lots which abut the ponding area. 10. The developer will record with Dakota County at the sane time as the plat, easements guaranteeing cross access between Lots 7 & 8, Block 2. Ayes; Nays, Riveness and Moratzka. Moved by Councilmeat ber T iveness, seconded by Council- SET BACK member Hicks to deny a request for a two foot rear and side yard setback VARIANCE variance at 1470 Brittany Road as recommended by the Planning DENIED- Commission subject to the following conditions: 1470 BRI'T'TANY 1. To deny a two foot rear yard setback variance for an accessory structuxe at 1470 Brittany load based on findings that the applicant did not satisfy the following variance criteria: A. That special conditions and circumstances exist that are peculiar to the land, structure, or building involved and that are not applicable to other lands, structures, or buildings in the same district. B. The literal interpretation of the City Code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of Chapter 10. C. That the special conditions and circumstances do not result from the actions of the applicant. D. That granting the variance requested - will not confer on the applicant any special privilege that is denied by Chapter 10 to other lands, structures, or buildings in the same district. No non-conforming use of neighboring lands, structures, or buildings in the same district, and no permitted or non - conforming use of lands, structures, or buildings in other districts shall be considered grounds for the issuance of a variance. 2. To deny a two foot side yard setback variance for an accessory structure at 1470 Brittany Road based on findings that the applicant did not satisfy the following variance criteria: A. That special conditions and circumstances exist that are peculiar to the land, structure, or building involved and that are not applicable to other lands, structures, or buildings in the same district. B. The literal interpretation of the City Code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the tenns of Chapter 10 - C. That the special conditions and circumstances do not result from the actions of the applicant. . That granting the variance requested will not comer on the applicant any special privilege that is denied by Chapter 10 to other lands, structures, or buildings in the same district. No use of neighboring lands, structures, or buildings in the wine district, and no permitted or non- conforming use of lands, structures, or buildings in other districts shall be considered grounds for the issuance of a variance, 6 Ayes; Nays, warner.
