The City Council of the City of Hastings, Minnesota met in regular meeting on
Monday, February 6, 1995 at :00 p.m. in the City Hall Council Chambers, 101 4th Street East,
Hastings, Minnesota.

Mayor Werner asked if there were any corrections or additions to APPROVAL of
the minutes of the regular meeting of January 17 1995; hearing none MINUTES
declared them approved as presented.

Moved by Councilmember Johnson, seconded by Councilmember WAC & SAC
Hicks to approve the following policy for the def nnent of City WAC and DEFERMENT
SAC charges:
DEFERMENT OF CITY WAC & SAC CHARGES
The Hastings City Council will consider deferring City dater
Availability and Sanitary Sewer Availability charges (WAC & SAC) on
a case by case basis for projects involving rehabilitating or demolishing
and reconstructing existing structures resulting in a substantial increase
In the WAC & SAC charges against the property being redeveloped.
Undeveloped properties are not eligible for City WAC & SAC deferment.
The City will not defer building permit fees or MOWS SAC changes.
City WAC & SAC charges will be deferred by assessing the
charges against the redeveloped property, to be spread over a period
not to exceed 10 years. The interest rate charged shall be the same as
that charged for public improvement assessments certified to Dakota
County in the same year as the deferred WAC & SAC charges. This
assessment shall include Dakota Count' administrative fee for certifying
assessments. The property owner must agree to waive all rights 'to appeal
the WAC & SAC assessment.
If a developer requests deferment of City WAC & SAC charges,
the building permit will not be released until the City Council has
approved the deferment. The Certificate of Occupancy for the
redevelopment project shall not be issued until the City has received
a signed copy of an agreement from the property owner waiving all
rights to appeal the assessment. If the property owner will not
waive appeal Frights, the Certificate of Occupancy shall not be released
until the WAC & SAC charges have been paid in full.

Moved by Councilmember Moratzl a, seconded by Count il- FUNDS FOR
member Simacek directing to conduct discussions with the Metropolitan AIRPORT
Council and/or Metropolitan Airports Commission regarding the process PLANNING
for securing funds to hire a consultant to assist the City with the review
and monitoring of the Dual Tracy Airport Plal ning Process. Ayes;
Nays, None.
Moved by Councilmember Johnson, seconded by Councilmember IST READING-
Hicks to approve the 1 st reading of an Ordinance amending City Code POLIO'
Chapter 2.1 3, Subd,'s 2,3,7,8 & 9 to incorporate recent legislative COMMISSION
changes and Police Civil Service Commission laws. This motion. also ORD.
calls for a public hearing on Tuesday, February 21, 1 995 at 7:00 p.m.
