HomeMy WebLinkAbout20110620- 20110606 CC Minutes Hastings, Minnesota City Council Minutes June 6, 2011 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, June 6, 2011 at 7:00 PM in the Council Chambers at the Hastings City Hall, 101 East 4th Street, Hastings, Minnesota Members Present: Mayor Hicks, City Councilmembers Balsanek, Hollenbeck, Nelson, Schultz and Slavik Councilmember Balsanek arrived at 7:05 p.m. Staff Present: City Administrator Dave Osberg City Attorney Dan Fluegel Assistant City Administrator Melanie Mesko Lee Police Chief Paul Schnell Community Development Director John Hinzman Public Works Director Tom Montgomery City Engineer Nick Egger Assistant City Engineer John Caven Fire & EMS Director Mike Schutt Approval of Minutes Mayor Hicks asked if there were any additions or corrections to the minutes of the regular City Council meeting on May 26, 2011. Hearing none, the minutes were approved as presented. Presentation—Dr. Erickson for 35 years of Medical Direction to the City of Hastings Ambulance Service Dr. Erickson was recognized and thanked for his years of service. Consent Agenda Moved by Councilmember Schultz, seconded by Councilmember Nelson to approve the Consent Agenda as amended. 7 Ayes; Nays, None. 1. Pay Bills as Audited 2. Resolution—Accepting $600 Donation from Diane Kolmer to be used for the Memorial Bench at a City Park 3. Approve 2011/2012 IUOE 49ers Union Contract 4. Resolution—Approve One-Day Temporary Liquor License for Hastings Music Festival on August 6, 2011 Public Hearing—Annual Storm Water Pollution Prevention Plan Update Assistant City Engineer John Caven introduced the item. Mayor Hicks opened the public hearing at 7:12. Hearing no comments, the public hearing was closed at 7:12 p.m. Caven was thanked for the information provided. Public Hearing—Home Occupation Permit #2011-17: 118 Farm Street (David Doffing) Hinzman introduced the item Mayor Hicks opened the public hearing at 7:14. Hearing no comments, the public hearing was closed at 7:14 p.m. Resolution—Home Occupation Permit #2011-17: 118 Farm Street (David Doffing) Moved by Councilmember Schultz, seconded by Councilmember Slavik to approve the resolution as presented. 7 Ayes; Nays, none. Public Hearing—Vacation of Easement #2011-15: South Half of 7th Street between Lea and Bass Hinzman introduced the item Mayor Hicks opened the public hearing at 7:16. Hearing no comments, the public hearing was closed at 7:16 p.m. Resolution—Vacation of Easement #2011-15: South Half of 7th Street between Lea and Bass Moved by Councilmember Schultz, seconded by Councilmember Slavik to approve the resolution as presented. 7 Ayes; Nays, none. Public Hearing—Rezone Property from I-1 Industrial Park to R-2 Residential Medium Density: 600 7th Street East Hinzman introduced the item Mayor Hicks opened the public hearing at 7:18. Hearing no comments, the public hearing was closed at 7:18 p.m. Second Reading/Ordinance Amendment—Rezone Property from I-1 Industrial Park to R-2 Residential Medium Density: 600 7th Street East Moved by Councilmember Schultz, seconded by Councilmember Alongi to approve the ordinance amendment as presented. 7 Ayes; Nays, none. Public Hearing—Ordinance Amendment: Possession of Firearms Ordinance Fluegel introduced the item Mayor Hicks opened the public hearing at 7:19. Hearing no comments, the public hearing was closed at 7:19 p.m. Second Reading/Ordinance Amendment—Possession of Firearms Ordinance Moved by Councilmember Alongi, seconded by Councilmember Nelson to approve the ordinance amendment as presented. 7 Ayes; Nays, none. City of Hastings June 6, 2011 City Council Minutes Page 3 of 4 Public Hearing—Noise Ordinance Amendment Schnell introduced the item Mayor Hicks opened the public hearing at 7:25. Hearing no comments, the public hearing was closed at 7:25 p.m. Second Reading/Ordinance Amendment—Noise Ordinance Amendment There was discussion about whether additional equipment would be needed or whether this would address loud mufflers or Jake braking. No additional equipment is needed, and the issue with Jake braking and loud mufflers are addressed in state statute and through MPCA regulations. There was discussion about the language in the animal section and whether it was written too broadly. Moved by Councilmember Alongi, seconded by Councilmember Nelson to delete the language “outside the building or premises.” There was continued discussion about the current and proposed language changes. Councilmember Alongi withdrew his amendment. Moved by Councilmember Balsanek, seconded by Councilmember Schultz to approve the amendment as presented. Moved by Councilmember Alongi, seconded by Councilmember Nelson to amend the proposed amendment to remove “building or” from the section. 7 Ayes; Nays, none. Vote was taken on the motion as amended; 7-0. Ordinance amendment as amended was approved. Public Hearing—Fees & License Amendments Mesko Lee introduced the item Mayor Hicks opened the public hearing at 7:50. Hearing no comments, the public hearing was closed at 7:50 p.m. Second Reading/Ordinance Amendment—Fees & License Amendments Moved by Councilmember Nelson, seconded by Councilmember Schultz to approve the ordinance amendment as presented. 7 Ayes; Nays, none. Remove from Table—Authorize Purchase of 11th Street Right of Way Moved by Councilmember Balsanek, seconded by Councilmember Alongi to remove this item from the table for further discussion. 7 Ayes; Nays, none. Montgomery introduced the item and stated that the Operations Committee has reviewed this issue again and did not provide a recommendation to the full Council for consideration. Jeremy Klyssen, 1102 Tyler Street, spoke in favor of letting the two impacted property owners resolve the situation independently. Kirk Kolehma, 315 West 11th Street, spoke in favor of the City’s participation in assisting with resolution to this issue. Councilmember Alongi stated that this is a private property dispute that should be resolved independent of the City. He recommended that this section of the street be removed from the project and be considered for reconstruction next year. Councilmember Schultz stated that there should be timeline for resolution on the issue. Councilmember Slavik inquired whether a previous similar situation resolution may apply in this situation as well. Montgomery noted that the circumstances of the two situations are not the same. Councilmember Balsanek stated that it was the hope of the Operations Committee members present at the most recent meeting that the property owners would be able to resolve the situation by this time. Mayor Hicks noted that he supports staff recommendation to have the City continue to remain involved in resolution of this issue and have the road improved. City of Hastings June 6, 2011 City Council Minutes Page 4 of 4 Moved by Councilmember Alongi, seconded by Councilmember Balsanek to remove this portion of the project from the 2011 improvements and allow the parties to continue to negotiate. Roll call vote was taken. 4 Ayes; Nays, three. Councilmembers Schultz and Hollenbeck, and Mayor Hicks voting against. 2011 Community Survey Moved by Councilmember Hollenbeck, seconded by Councilmember Schultz to approve as presented. 7 Ayes; Nays, none. Comments from the Audience Dean Markuson spoke on recent Beyond the Yellow Ribbon initiatives and upcoming events. He stated that volunteers are needed to continue the BYR activities. Updates: Alongi and Nelson will participate in the Cottage Grove Strawberry Festival Mayor’s Cup Bocce Ball on Saturday, June 18 at 3 p.m. HEDRA will meet Thursday, June 9 at 6:00 p.m. at City Hall Planning Commission will meet on Monday, June 13 at 7:00 p.m. at City Hall Hall Parks & Recreation Commission will meet on Tuesday, June 14, 2011 at 6:00 p.m. at City Hall.
