Regular Meeting
Chair Peine called the meeting to order at 7:01 p.m.

Approval of Minutes – May 9, 2011

Motion by Rohloff to approve the May 9, 2011 minutes. Seconded by Stevens.
Upon vote taken, Ayes 6, Nays 0. Motion carried.

Bryan Deane –
4.Variance #2011-18 – 1225 View Court.
Justin Fortney presented the staff report.
Commissioner Stevens asked when the home was built. Fortney said 1973. Stevens asked how long
the 20-foot setback has been in place. Fortney said for a long time, possibly even in 1973.
Bryan Deane, applicant said there are other possible locations for the garage on the site but they
would not look as good as this proposed location. Deane added that he explained the proposal to all
his neighbors who could see it and asked them if they would sign a petition, which they all did.
Commissioner Vaughan asked Fortney what was the main sticking point with the findings. Fortney
said mostly it is that the proposal is not in line with the intent or purpose of the ordinance. Hinzman
added that there needs to be something determined that sets this property apart from others. He also
said that this proposal is for a 75% variance to the requirement, usually we have approved smaller
variances. He added that the applicant has other options for the garage even if they are not as
desirable.

Commissioner Estenson said this lot could be so extraordinary in that its layout created a very small
rear yard. Had this been a property on a grid street there would be no need for a variance.
Hinzman said there must be something about the property that should differentiate it from others in
town.
Motion by Stevens to deny the variance based on staffs recommendations. Motion failed for lack
of a second.
Vaughan said maybe we could table this and give the applicant more time to consider alternative
proposals.
Deane asked for examples. Hinzman responded that they could look at other arraignments of the
garage around the property. Vaughan said maybe other ways of attaching it, like in front.
Commissioner Messina pointed out that other neighbors could build the proposed garage and still
have the required setbacks because their lots are square and do not have a cul-de-sac pushing the
home back.
Motion by Rohloff to table the variance review to the next meeting to give the applicant time to
consider alternatives. Second by Stevens.
Upon vote taken, Ayes 6, Nays 0. Motion carried.

Motion by Vaughan to adjourn the May 23, 2011, Planning Commission meeting. Seconded by
Rohloff.
Upon vote taken, Ayes 6, Nays 0. Motion carried.
