Item: Public Hearing/Ordinance Amendment Relating to Snow Removal
Council Action Requested:
Conduct the public hearing and approve the second reading/ordinance amendment for amending
Section 95.23(A) of the City Code with regards to the time limit requiring snow removal on
sidewalks
Background Information:
At the January 18 Council meeting, the City Council approved the first reading and ordering a
public hearing and consideration of a second reading/ordinance amendment relating to this
section.
Recently, staff identified a discrepancy in City Code regarding when snow removal on sidewalks
must occur. Section 95.23(A) indicates that it must be removed within 24 hours of a snowfall;
Section 90.04(A) indicates that it must be removed within 48 hours. The proposed change before
the Council would make this requirement for snow removal on sidewalks consistent with a 48
hour timeline.
Staff supports this change to ensure consistency between these two provisions.

An Ordinance of the City of Hastings Declaring
Public Nuisances Affecting Public Peace and Safety
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HASTINGS:
HASTINGS CITY CODE CHAPTER 95 IS HEREBY AMENDED AND SECTION
95.23(A) IS AMENDED AS FOLLOWS:
§ 95.23 PUBLIC NUISANCES AFFECTING PEACE AND SAFETY.
The following are declared to be nuisances affecting public peace and safety:
(A) All snow and ice not removed from public sidewalks 24 48 hours after the snow
or other precipitation causing the condition has ceased to fall;
Council member _____________________ moved a second to this Ordinance, and upon being
put to a vote it was adopted by a majority of all Council members present.
