REQUEST The Planning Commission is asked to hold a public hearing to consider the attached amendments to Hastings City Code Chapters 114.20 (Adult Use definitions), 155.32 (C- 4), 155.35 (I-2), and 155.01 (official zoning map) HISTORY Planning Commission has previously discussed the proposed adult use regulations and provided comments, which guided staff to propose the attached amendments to the adult use and zoning ordinances. BACKGROUND INFORMATION There are no adult uses being proposed at this time. The proposed amendments are in response to the City Council determining that the character of the C-4 district has changed. Because of this, the City Council passed a Moratorium Ordinance in December of 2006 to allow time to make necessary changes to the ordinance in light of these changes. Staff has brought forward this ordinance amendment to assure the placement of adult uses does not adversely affect the health, safety, and welfare of citizens. Many studies conducted have cited numerous negative secondary effects of adult use establishments in residential and commercial neighborhoods. One study conducted by the St. Croix County Planning Department showed that such effects include decline of property/ rental values, economic decline leading to deterioration and blight, increase in crime, and a negative impact to quality of life. Staff has not found any studies linking the same negative effects to industrial properties. This may be due to industrial establishments having opposite hours of operation and limited on site patrons.  Minnesota courts have held that ordinances restricting adult uses to land comprising as low as 6.6% and 6.75% of total commercial and industrial property within a city are valid restrictions. However, these percentages do not provide a “safe harbor” for ordinances. If issues such as limited access, lack of utility services, close proximity to heavy industrial uses, or other factors would practically prevent a business from selecting a viable location for an adult use within the allowed areas, an ordinance allowing adult uses in areas much higher than the 6.6% figure would probably be struck down as unconstitutional if challenged. The amount of land staff is proposing for adult uses to be allowed in provides few additional limitations to their locating there. The current ordinance also allows for spacing between adult uses far less than other communities do. In addition, accessory adult uses are still being proposed to be allowed in the C-4 district. Given these circumstances, staff believes the proposed I-2 district containing 5.8% of the commercial and industrial land in the City provides a sufficient amount of land for this type of use. PURPOSE The intent of the change is to allow potential adult uses in less visible areas. ATTACHMENTS Proposed Ordinance Amendment Zoning Maps Applicable Ordinance Sections for further information C-4 District I-2 District Adult Use  DRAFT NO. 1 Planning Commission – March 10, 2008 114.20 definitions (adult uses) The purpose of this change is to specify accessory adult uses allowed in the C-4 district. This change will not negatively affect any existing businesses. ADULT USES; ACCESSORY. The offering of goods and/or services which are classified as adult uses on a limited scale (no more than 20% of the floor area of the establishment) and which are incidental to the primary activity and goods and/or services offered by the establishment. Examples Limited to of such items include adult magazines, adult movies, and adult novelties, and the like. 155.32 (C-4 Regional Shopping Center) Remove the following from The C-4 District: (2) Adult Use—Principal (as defined in Chapter 114) subject to the following minimum requirements: (a) Adult Uses—Principal and establishments shall be at least 200 feet from any property zoned residential; (b) An Adult Use—Principal or establishment shall be separated at least 200 feet from any other adult use or establishment; and (c) An Adult Use—Principal or establishment shall obtain all required city licenses before commencing operation. Change the following: (a) Adult Uses—Accessory and establishments shall be at least 200 feet from any residenceproperty zoned residential; 155.35 I-2 Industrial Park Storage/ Service: Add the following to the I-2 District: (2) Adult Use—Principal (as defined in Chapter 114) subject to the following minimum requirements: (a) Adult Uses—Principal and establishments shall be at least 200 feet from any residence; (b) An Adult Use—Principal or establishment shall be separated at least 200 feet from any other adult use or establishment; and (c) An Adult Use—Principal or establishment shall obtain all required city licenses before commencing operation.  Modify the intent statement as follows to more accurately describe the district: (A)Intent. The intent of this chapter in establishing an industrial park storage/service district is in recognition of the need to segregate for aesthetic and functional reasons uses that involve exterior storage of products, raw materials, equipment or vehicles and that require a lesser degree of public improvements that is typically provided in the I-1 Industrial Park District. It shall be recognized that the intensity and type of industrial uses that shall be permitted in the I-2 District will be based upon a determination by the city that an adequate level of public services to support the uses can be provided based upon the level of public improvements available to the district. The District serves to regulate existing I-2 uses. Further expansion of the I-2 District geographic limits is not anticipated. Future rezoning of land for industrial storage and services uses shall be designated I-1, subject to the provisions of § 155.34. (A)Intent. The Industrial Park Storage\service district is established to provide a limited area for certain industrial and commercial uses that by their nature have demonstrated negative secondary effects when located in close proximity to other commercial and residential uses. Negative effects to surrounding properties include decline of property/ rental values, economic decline leading to deterioration and blight, increase in crime, and a negative impact to quality of life (St. Croix Co., Wisconsin, “Regulation of Adult Use Establishments in St. Croix County” land use study, September 1993) 155.01 Establishment of districts; Official Zoning Map (Rezoning) Proposed rezoning from I-1 to I-2   City of Hastings Zoning Map  Applicable Ordinance Sections § 155.32 C-4 REGIONAL SHOPPING CENTER. (A) Intent. The intent of this chapter in establishing a regional shopping center district is in recognition of future needs for one or more large commercial areas to serve the city and surrounding areas. (B) Uses permitted. All uses permitted in C-3 Community Regional Commerce District. (C) Uses by special permit. (1) All uses permitted by special use in the C-3 Community Regional Commerce District and the following. (2) Adult Use—Principal (as defined in Chapter 114) subject to the following minimum requirements: (a) Adult Uses—Principal and establishments shall be at least 200 feet from any property zoned residential; (b) An Adult Use—Principal or establishment shall be separated at least 200 feet from any other adult use or establishment; and (c) An Adult Use—Principal or establishment shall obtain all required city licenses before commencing operation. (3) Adult Use—Accessory (as defined in Chapter 114) subject to the following minimum requirements: (a) Adult Uses—Accessory and establishments shall be at least 200 feet from any property zoned residential; (b) Adult Use—Accessory or establishment shall be separated at least 200 feet from any other adult use or establishment; (c) Adult Use—Accessory or establishment shall obtain all required city licenses before commencing operation; (d) Adult Use—Accessory shall be restricted from and prohibit access to minors by the physical separation of the items from areas of general public access. 1. Movie rentals. Display areas shall be restricted from general view and shall be located within a separate room, the access for which is in clear view and under the control of the persons responsible for the operation. 2. Magazines. Publications classified or qualifying as adult uses shall not be physically accessible to minors and shall be covered with a wrapper or other means to prevent display of any material other than the publication title. 3. Other use. Adult Uses—Accessory not specifically cited shall comply with the intent of this section subject to the approval of the Zoning Administrator. (e) Adult Use-Accessory shall be prohibited from both internal and external advertising and signing of adult materials and products. (4) Towers as regulated by § 155.07. (Prior Code, § 10.21)  (5) (a) Temporary auto sales may be allowed to support the activities of a non-profit community organization (i.e. fundraiser for a sports team or school). Each auto dealership may be allowed 1 sale per year, with the sale not to exceed 14 calendar days per year. Each parcel of land in the C-4 district is allowed 1 sale per year. If a business consists of more than 1 parcel, only 1 sale may be allowed. The provisions of this division (C)(5) shall expire on July 31, 2007. (b) The following shall be considered in granting a special use permit: 1. The affect on the total number of parking spaces at the business the sale is held. 2. The affect of the ingress and egress at the parking lot. 3. The affect on accessibility of emergency services. 4. (a) Motor vehicles cannot be kept in an impound lot for more than 14 days unless a police hold has been placed on the motor vehicle. (b) No sales of motor vehicles, salvaging, repairing, dismantling, or stripping of motor vehicles shall be allowed in the impound lot. (c) 100% opaque fencing or landscaping at least 6 feet high must be placed around the entire lot and must be adequately maintained. (d) All motor vehicles impounded shall be kept within the opaque fenced or landscaped area. (e) All buildings on the lot must be permanent structures with permanent foundations. (f) The entire impound lot shall be surfaced with a bituminous covering, and concrete curbing to city standards. (g) A sufficiently sized bituminous area shall be provided for the parking of vehicles that may be leaking fluids or other pollutants. (h) Any lighting in the impound lot shall not be obtrusive to neighboring property. (i) Employees of the city or its duly appointed representatives, shall be allowed on the property at any time to inspect the impound lot to verify compliance with the city code. (2) Any special use permit issued hereunder shall be reviewed annually and at other times deemed appropriate by the city, to verify compliance with the city code and any special conditions of the permit. As part of the review procedure, the city may hold a public hearing, preceded by the appropriate mailed and published notice. As part of any review procedure, the city may amend the permit by adding or deleting any conditions it deems necessary to protect the public health, safety, and welfare. (3) All conditions imposed by § 30.02 must be met. Additionally, the city may impose any other conditions it feels are necessary to protect the public, health, safety, and welfare.
