Public Hearing — 2009 Infrastructure Improvement Program Assessments
Council Action Requested:
Council is requested to approve the enclosed resolution adopting the proposed
assessments for the 2009 Industrial Park Area Improvements.
Background Information:
The Public Hearing for the 2009 Infrastructure Improvement Program Assessments will
include the following projects:
2009 -1 Industrial Park Area — Spiral Boulevard between Highway 316 and
Enterprise Avenue, Industrial Court, and Millard Avenue.
Improvements
This project consisted of the complete reconstruction of all streets, which included
upgrading of the street configuration to include concrete curb and gutter; some storm
sewer replacement and new installations; major restoration, repair, and reinforcement
of the industrial park drainage ravine; several water quality protection implements,
some minor sanitary sewer and water system improvements and replacements; and
the constriction of a new trail segment between east 31s Street and Vermillion Falls
Park via Millard Avenue and the industrial park ravine, including a connection to
Veterans Park.
Assessment Policy
Spiral Boulevard is on the City's Municipal State Aid Street system. All streets on
this system serve as collector roads, meaning that they benefit more than just the
immediate vicinity of properties in their function to convey traffic across larger
distances of the City.
Accordingly, assessments for reconstruction projects on these types of streets are
based on 25% of the estimated costs. A $47 /front foot rate was the result of the
project cost estimation and feasibility determination phase, and this rate was approved
by the City Council at the time the project was ordered to be constricted.
Though Millard Avenue and Industrial Court are not on the City's Municipal State
Aid system, the same assessment rate was applied to all properties within the project
boundaries, as they are all classified as being commercial and industrial uses.

Resolution to Adopt the Assessments for Project
2009-1, THE INDUSTRIAL PARK AREA IMPROVEMENTS
WHEREAS, pursuant to proper notice duly given as required by law, the City Council of
the City of Hastings has met, heard, and passes upon all objections to the proposed
assessments for the improvements of
2009 -1 Industrial Park Area Improvements - Spiral Boulevard from
Think Highway 316 to Enterprise Avenue, Millard Avenue, and
Industrial Court
These improvements included street, water, sewer, and storm sewer constriction and
reconstruction, drainage and water quality protection enhancements, and bituminous trail
constriction.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HASTINGS AS FOLLOWS:
The proposed assessments for project 2009 -1, the Industrial Park Area
Improvements, a copy of which is filed with the Hastings Engineering
Department, are hereby accepted and shall constitute the special assessment
against the lands named therein, and each tract of land therein included is hereby
found to be benefited by the constricted improvement in the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a
period of ten (10) years, the first of the installments to be payable with the first
property tax installment of 2011, and shall bear interest at the rate of 4.50% per
annum from November 4, 2010. To the first installment shall be added interest on
the entire assessment from November 4, 2010 until December 31, 2010. To each
subsequent installment, when due, shall be added interest for one year on all
unpaid installments.
The owner of any property so assessed may, at any time prior to certification of
the assessment to the County Auditor, pay the whole or part of the assessment on
such property with interest accrued to the date of the payment to the City Clerk,
except that no interest or Dakota County assessment certification fee shall be
charged if the entire assessment is paid within 30 days from the adoption of this
resolution; and he may, at any time thereafter, pay to the County Treasurer the
entire amount of the assessment remaining unpaid with interest accrued to
December 31 of the year in which such payment is made. Such payment must be
made before December 30, or interest will be charged through December 31 of
the next succeeding year.
4. The clerk shall forthwith, transmit a certified duplicate of this assessment to the
County Auditor to be extended on the property tax lists of the Count, and such
assessments shall be collected and paid over in the same manner as other
municipal taxes.
The amount specially assessed is hereby declared to be $425,608.50
ADOPTED BY THE CITY COUNCIL OF HASTINGS, MINNESOTA, THIS 4th
DAY OF OCTOBER, 2010.
